    Form of order sought

    declare that, by failing to adopt the laws, regulations and administrative provisions necessary to comply with Directive 2006/21/EC of the European Parliament and of the Council of 15 March 2006 on the management of waste from extractive industries and amending Directive 2004/35/EC, (1) or in any event by failing to inform the Commission thereof, the Republic of Estonia has failed to fulfil its obligations under the directive;

    order the Republic of Estonia to pay the costs.

    Pleas in law and main arguments

    The time-limit for transposing the directive into national law expired on 1 May 2008.
