    COUNCIL DECISION (CFSP) 2022/1626

    of 20 September 2022

    amending Decision 2013/798/CFSP concerning restrictive measures against the Central African Republic

    THE COUNCIL OF THE EUROPEAN UNION,

    Having regard to the Treaty on European Union, and in particular Article 29 thereof,

    Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

    Whereas:

    (1)

    On 23 December 2013, the Council adopted Decision 2013/798/CFSP (1) concerning restrictive measures against the Central African Republic.

    (2)

    The Council considers that the title of Decision 2013/798/CFSP should be amended.

    (3)

    On 29 July 2022, the United Nations Security Council adopted Resolution 2648 (2022), That Resolution extends the measures and amends the exceptions to the arms embargo.

    (4)

    Decision 2013/798/CFSP should therefore be amended accordingly,

    HAS ADOPTED THIS DECISION:

    Article 1

    Decision 2013/798/CFSP is amended as follows:

    (1)

    the title is replaced by the following:

     

    ‘Council Decision 2013/798/CFSP of 23 December 2013 concerning restrictive measures in view of the situation in the Central African Republic’;

    (2)

    Article 2 is amended as follows:

    (a)

    in paragraph 1, point (c) is replaced by the following:

    ‘(c)

    the sale, supply, transfer or export of arms and related materiel brought into the CAR by Chadian or Sudanese forces solely for their use in international patrols of the tripartite force established on 23 May 2011 in Khartoum by the CAR, Chad and Sudan, to enhance security in the common border areas, in cooperation with MINUSCA, as notified in advance to the Committee;’;

    (b)

    in paragraph 1, point (g) is replaced by the following:

    ‘(g)

    the sale, supply, transfer or export of weapons and ammunition, military vehicles and equipment, and the provision of related assistance, to the CAR security forces, including state civilian law enforcement institutions, where such weapons, ammunition, vehicles or equipment are intended solely for support of, or use in, the CAR process of SSR, as notified in advance to the Committee; or’;

    (c)

    in paragraph 1, point (h) is deleted;

    (d)

    paragraph 2 is replaced by the following:

    ‘2.   Member States shall notify the Committee in advance of the delivery of any sale, supply, transfer or export as permitted in points (a), (b), (c), (d), (f) and (g) of paragraph 1.’.

    Article 2

    This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.
