    COUNCIL COMMON POSITION 2008/81/CFSP

    of 28 January 2008

    amending Common Position 98/409/CFSP concerning Sierra Leone

    THE COUNCIL OF THE EUROPEAN UNION,

    Having regard to the Treaty on European Union, and in particular Article 15 thereof,

    Whereas:

    (1)

    On 29 June 1998, the Council adopted Common Position 98/409/CFSP concerning Sierra Leone (1) in order to implement the measures imposed by United Nations Security Council Resolution (UNSCR) 1171(1998).

    (2)

    On 21 December 2007, the United Nations Security Council adopted Resolution 1793(2007) providing for an exemption to the measures imposed by paragraph 5 of UNSCR 1171(1998). Common Position 98/409/CFSP should therefore be amended accordingly,

    HAS ADOPTED THIS COMMON POSITION:

    Article 1

    In Article 4 of Common Position 98/409/CFSP the following third paragraph shall be inserted:

    ‘The measure provided for in the first paragraph shall not apply to the travel of any witnesses whose presence at trial before the Special Court for Sierra Leone is required.’

    Article 2

    This Common Position shall take effect on the date of its adoption.

    Article 3

    This Common Position shall be published in the Official Journal of the European Union.
