    DECISION OF THE EEA JOINT COMMITTEE

    No 193/2012

    of 26 October 2012

    amending Annex I (Veterinary and phytosanitary matters) and Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

    THE EEA JOINT COMMITTEE,

    Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

    Whereas:

    (1)

    Commission Regulation (EU) No 277/2012 of 28 March 2012 amending Annexes I and II to Directive 2002/32/EC of the European Parliament and of the Council as regards maximum levels and action thresholds for dioxins and polychlorinated biphenyls (1) is to be incorporated into the EEA Agreement.

    (2)

    Commission Recommendation 2012/154/EU of 15 March 2012 on the monitoring of the presence of ergot alkaloids in feed and food (2) is to be incorporated into the EEA Agreement.

    (3)

    This Decision concerns legislation regarding feedingstuffs and foodstuffs. Legislation regarding feedingstuffs and foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I and the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

    Annexes I and II to the EEA Agreement should therefore be amended accordingly,

    HAS ADOPTED THIS DECISION:

    Article 1

    Chapter II of Annex I to the EEA Agreement shall be amended as follows:

    (1)

    the following indent shall be added in point 33 (Directive 2002/32/EC of the European Parliament and of the Council):

    ‘—

    32012 R 0277: Commission Regulation (EU) No 277/2012 of 28 March 2012 (OJ L 91, 29.3.2012, p. 1).’;

    (2)

    the following point shall be inserted after point 40 (Regulation (EC) No 396/2005 of the European Parliament and of the Council):

    ‘40a.

    32012 H 0154: Commission Recommendation 2012/154/EU of 15 March 2012 on the monitoring of the presence of ergot alkaloids in feed and food (OJ L 77, 16.3.2012, p. 20).’.

    Article 2

    Under the heading ‘ ACTS OF WHICH THE CONTRACTING PARTIES SHALL TAKE NOTE ’ the following point shall be inserted after point 13 (Commission Recommendation 2010/161/EU) of Chapter XII of Annex II to the EEA Agreement:

    ‘14.

    32012 H 0154: Commission Recommendation 2012/154/EU of 15 March 2012 on the monitoring of the presence of ergot alkaloids in feed and food (OJ L 77, 16.3.2012, p. 20).’

    Article 3

    The texts of Regulation (EU) No 277/2012 and Recommendation 2012/154/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

    Article 4

    This Decision shall enter into force on 1 November 2012, provided that all the notifications under Article 103(1) of the EEA Agreement have been made to the EEA Joint Committee (*1).

    Article 5

    This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
