declare that, by not adopting the laws, regulations and administrative provisions necessary to ensure the application of Directive 2002/15/EC of the European Parliament and of the Council of 11 March 2002 on the organisation of the working time of persons performing mobile road transport activities, (1) with regard to self-employed drivers, and in any event by not notifying the Commission of those provisions, the Republic of Poland has failed to fulfil its obligations under Articles 2(1), 3 to 7 and 11 of that directive;

order the Republic of Poland to pay the costs of the proceedings.

Pleas in law and main arguments

Directive 2002/15/EC has been applicable to self-employed drivers since 23 March 2009.
