Pytania prejudycjalne

1)

Co należy rozumieć pod zawartym w art. 3 ust. 1 dyrektywy 96/9/WE (1) w sprawie ochrony prawnej baz danych określeniem „bazy danych, które z powodu wyboru lub uporządkowania ich zawartości stanowią własną intelektualną twórczość autora”, a dokładniej:

a)

czy z takiego pojęcia należy wykluczyć wysiłek intelektualny i umiejętności związane ze stworzeniem danych?

b)

czy pojęcie wyboru lub uporządkowania obejmuje także czynność nadania dużego znaczenia wcześniej istniejącym danym (jak ma to miejsce w przypadku ustalenia daty meczu piłkarskiego)?

c)

czy „własna intelektualna twórczość autora” wymaga od autora czegoś więcej niż znacznego nakładu prac i dużych umiejętności? A jeśli tak, to czego?

2)

Czy dyrektywa stanowi przeszkodę dla stosowania przepisów prawa krajowego, które w przypadku baz danych ustanawiają inne prawa autorskie niż te przewidziane dyrektywą?
