o izmjeni Priloga Provedbenoj odluci 2020/1606 o određenim privremenim zaštitnim mjerama u vezi s visokopatogenom influencom ptica podtipa H5N8 u Nizozemskoj

EUROPSKA KOMISIJA,

uzimajući u obzir Ugovor o funkcioniranju Europske unije,

uzimajući u obzir Direktivu Vijeća 89/662/EEZ od 11. prosinca 1989. o veterinarskim pregledima u trgovini unutar Zajednice s ciljem uspostave unutarnjeg tržišta (1), a posebno njezin članak 9. stavak 3.,

uzimajući u obzir Direktivu Vijeća 90/425/EEZ od 26. lipnja 1990. o veterinarskim pregledima koji se primjenjuju u trgovini određenim živim životinjama i proizvodima unutar Unije s ciljem uspostave unutarnjeg tržišta (2), a posebno njezin članak 10. stavak 3.,

budući da:

Provedbena odluka Komisije (EU) 2020/1606 (3) donesena je nakon izbijanja visoko patogene influence ptica podtipa H5N8 na jednom gospodarstvu na kojem se drži perad u Nizozemskoj i nakon što je nadležno tijelo te države članice uspostavilo zaražena i ugrožena područja u skladu s Direktivom Vijeća 2005/94/EZ (4).

(2)	Provedbenom odlukom (EU) 2020/1606 predviđeno je da zaražena i ugrožena područja utvrđena u Nizozemskoj u skladu s Direktivom 2005/94/EZ sadržavaju najmanje područja koja su u Prilogu toj Provedbenoj odluci navedena kao zaražena i ugrožena.

Od datuma donošenja Provedbene odluke (EU) 2020/1606 Nizozemska je obavijestila Komisiju o dodatnom izbijanju visokopatogene influence ptica podtipa H5N8 na gospodarstvu na kojem se drži perad u pokrajini Gelderland te je poduzela potrebne mjere u skladu s Direktivom 2005/94/EZ, uključujući uspostavu zaraženih i ugroženih područja oko tog novog mjesta izbijanja bolesti.

Komisija je u suradnji s Nizozemskom pregledala navedene mjere i uvjerila se da su granice zaraženih i ugroženih područja koje su utvrdila nadležna tijela u toj državi članici na dovoljnoj udaljenosti od bilo kojeg gospodarstva na kojem je potvrđeno izbijanje visokopatogene influence ptica podtipa H5N8.

Kako bi se spriječili nepotrebni poremećaji trgovine u Uniji i izbjeglo da treće zemlje nametnu neopravdane prepreke trgovini, nužno je brzo na razini Unije, a u suradnji s Nizozemskom, opisati nova zaražena i ugrožena područja koja je uspostavila ta država članica u skladu s Direktivom 2005/94/EZ. Stoga bi trebalo izmijeniti zaražena i ugrožena područja navedena za Nizozemsku u Prilogu Provedbenoj odluci (EU) 2020/1606.

U skladu s time, do sljedećeg sastanka Stalnog odbora za bilje, životinje, hranu i hranu za životinje trebalo bi izmijeniti Prilog Provedbenoj odluci (EU) 2020/1606 radi ažuriranja regionalizacije na razini Unije kako bi se izmijenila zaražena i ugrožena područja uspostavljena u Nizozemskoj u skladu s Direktivom 2005/94/EZ te trajanja ograničenja koja se u njima primjenjuju.

(7)	Provedbenu odluku (EU) 2020/1606 trebalo bi stoga na odgovarajući način izmijeniti.

(8)	S obzirom na hitnost epidemiološke situacije u Uniji u pogledu širenja visokopatogene influence ptica podtipa H5N8, važno je da izmjene Priloga Provedbenoj odluci (EU) 2020/1606 uvedene ovom Odlukom stupe na snagu što je prije moguće.

(9)	Ova će se Odluka preispitati na sljedećem sastanku Stalnog odbora za bilje, životinje, hranu i hranu za životinje,

DONIJELA JE OVU ODLUKU:

Članak 1.

Prilog Provedbenoj odluci (EU) 2020/1606 zamjenjuje se tekstom iz Priloga ovoj Odluci.

Članak 2.

Ova je Odluka upućena Kraljevini Nizozemskoj.
