KOMISIJOS ĮGYVENDINIMO SPRENDIMAS (ES) 2020/1670,

2020 m. lapkričio 10 d.

kuriuo iš dalies keičiamas Įgyvendinimo sprendimo (ES) 2020/1606 dėl tam tikrų laikinųjų apsaugos priemonių, susijusių su labai patogenišku H5N8 potipio paukščių gripu Nyderlanduose, priedas

EUROPOS KOMISIJA,

atsižvelgdama į Sutartį dėl Europos Sąjungos veikimo,

atsižvelgdama į 1989 m. gruodžio 11 d. Tarybos direktyvą 89/662/EEB dėl veterinarinių patikrinimų, taikomų Bendrijos vidaus prekyboje, siekiant sukurti vidaus rinką (1), ypač į jos 9 straipsnio 3 dalį,

atsižvelgdama į 1990 m. birželio 26 d. Tarybos direktyvą 90/425/EEB dėl Sąjungos vidaus prekyboje tam tikrais gyvūnais ir produktais taikomų veterinarinių patikrinimų, siekiant užbaigti vidaus rinkos kūrimą (2), ypač į jos 10 straipsnio 3 dalį,

kadangi:

Komisijos įgyvendinimo sprendimas (ES) 2020/1606 (3) buvo priimtas po labai patogeniško H5N8 potipio paukščių gripo protrūkio viename ūkyje Nyderlanduose, kuriame laikomi naminiai paukščiai, tos valstybės narės kompetentingai institucijai pagal Tarybos direktyvą 2005/94/EB (4) nustačius apsaugos ir priežiūros zonas;

(2)	Įgyvendinimo sprendime (ES) 2020/1606 numatyta, kad apsaugos ir priežiūros zonos, kurias Nyderlandai nustatė pagal Direktyvą 2005/94/EB, turi apimti bent tas teritorijas, kurios to įgyvendinimo sprendimo priede yra nurodytos kaip apsaugos ir priežiūros zonos;

(3)

po Įgyvendinimo sprendimo (ES) 2020/1606 priėmimo dienos Nyderlandai pranešė Komisijai apie papildomą labai patogeniško H5N8 potipio paukščių gripo protrūkį ūkyje Gelderlando provincijoje, kuriame laikomi naminiai paukščiai, ir ėmėsi pagal Direktyvą 2005/94/EB būtinų priemonių, be kita ko, aplink šio naujo protrūkio vietą nustatydami apsaugos ir priežiūros zonas;

(4)	bendradarbiaudama su Nyderlandais Komisija išnagrinėjo tas priemones ir įsitikino, kad šios valstybės narės kompetentingos institucijos nustatytų apsaugos ir priežiūros zonų ribos yra pakankamai toli nuo bet kurio ūkio, kuriame patvirtintas labai patogeniško H5N8 potipio paukščių gripo protrūkis;

kad būtų išvengta bet kokių nereikalingų Sąjungos vidaus prekybos trikdymų ir trečiųjų šalių sudaromų nepagrįstų prekybos kliūčių, būtina bendradarbiaujant su Nyderlandais skubiai Sąjungos lygmeniu apibrėžti šioje valstybėje narėje pagal Direktyvą 2005/94/EB nustatytas naujas apsaugos ir priežiūros zonas. Todėl į Įgyvendinimo sprendimo (ES) 2020/1606 priedą įtrauktos Nyderlandų apsaugos ir priežiūros zonos turėtų būti iš dalies pakeistos;

todėl, kol įvyks kitas Augalų, gyvūnų, maisto ir pašarų nuolatinio komiteto posėdis, Įgyvendinimo sprendimo (ES) 2020/1606 priedas turėtų būti iš dalies pakeistas, kad būtų atnaujintas Sąjungos lygmeniu nustatomas skirstymas į regionus ir iš dalies pakeistos Nyderlandų pagal Direktyvą 2005/94/EB nustatytos apsaugos ir priežiūros zonos ir jose taikytinų apribojimų trukmė;

(7)	todėl Įgyvendinimo sprendimas (ES) 2020/1606 turėtų būti atitinkamai iš dalies pakeistas;

(8)	atsižvelgiant į tai, kad į epizootinę padėtį Sąjungoje dėl labai patogeniško H5N8 potipio paukščių gripo plitimo reikia reaguoti skubiai, svarbu, kad šiuo sprendimu padaryti Įgyvendinimo sprendimo (ES) 2020/1606 priedo pakeitimai įsigaliotų kuo greičiau;

(9)	šis sprendimas bus persvarstytas kitame Augalų, gyvūnų, maisto ir pašarų nuolatinio komiteto posėdyje,

Įgyvendinimo sprendimo (ES) 2020/1606 priedas pakeičiamas šio sprendimo priedo tekstu.
