DECISIÓN DE EJECUCIÓN (UE) 2020/1670 DE LA COMISIÓN

de 10 de noviembre de 2020

por la que se modifica el anexo de la Decisión de Ejecución 2020/1606, relativa a determinadas medidas provisionales de protección en relación con la gripe aviar de alta patogenicidad del subtipo H5N8 en los Países Bajos

LA COMISIÓN EUROPEA,

Visto el Tratado de Funcionamiento de la Unión Europea,

Vista la Directiva 89/662/CEE del Consejo, de 11 de diciembre de 1989, relativa a los controles veterinarios aplicables en los intercambios intracomunitarios con vistas a la realización del mercado interior (1), y en particular su artículo 9, apartado 3,

Vista la Directiva 90/425/CEE del Consejo, de 26 de junio de 1990, relativa a los controles veterinarios aplicables en los intercambios dentro de la Unión de determinados animales vivos y productos con vistas a la realización del mercado interior (2), y en particular su artículo 10, apartado 3,

Considerando lo siguiente:

La Decisión de Ejecución (UE) 2020/1606 de la Comisión (3) se adoptó a raíz de un brote de gripe aviar de alta patogenicidad (GAAP) del subtipo H5N8 en una explotación en la que se crían aves de corral situada en los Países Bajos y del establecimiento de zonas de protección y de vigilancia por la autoridad competente de ese Estado miembro de conformidad con la Directiva 2005/94/CE del Consejo (4).

(2)	La Decisión de Ejecución (UE) 2020/1606 dispone que las zonas de protección y de vigilancia establecidas por los Países Bajos de conformidad con la Directiva 2005/94/CE abarquen, como mínimo, las zonas de protección y vigilancia que figuran en el anexo de dicha Decisión de Ejecución.

Desde la fecha de adopción de la Decisión de Ejecución (UE) 2020/1606, los Países Bajos han notificado a la Comisión un brote adicional de GAAP del subtipo H5N8 en una explotación en la que se crían aves de corral situada en la provincia de Gelderland, y han adoptado las medidas necesarias exigidas de conformidad con la Directiva 2005/94/CE, incluido el establecimiento de zonas de protección y de vigilancia en torno a este nuevo brote.

La Comisión ha examinado dichas medidas en colaboración con los Países Bajos y considera que los límites de las zonas de protección y de vigilancia establecidas por la autoridad competente de ese Estado miembro se encuentran a una distancia suficiente de cualquier explotación en la que se ha confirmado un brote de GAAP del subtipo H5N8.

Con objeto de prevenir cualquier perturbación innecesaria del comercio dentro de la Unión y evitar la imposición de obstáculos injustificados al comercio por parte de terceros países, es necesario describir rápidamente a nivel de la Unión, en colaboración con los Países Bajos, las nuevas zonas de protección y de vigilancia establecidas en dicho Estado miembro de conformidad con la Directiva 2005/94/CE. Por consiguiente, deben modificarse las zonas de protección y de vigilancia referentes a los Países Bajos que figuran en el anexo de la Decisión de Ejecución (UE) 2020/1606.

En consecuencia, a la espera de la próxima reunión del Comité Permanente de Vegetales, Animales, Alimentos y Piensos, debe modificarse el anexo de la Decisión de Ejecución (UE) 2020/1606 para actualizar la regionalización a nivel de la Unión a fin de modificar las zonas de protección y de vigilancia establecidas por los Países Bajos de conformidad con la Directiva 2005/94/CE y la duración de las restricciones aplicables en ellas.

(7)	Procede, por tanto, modificar la Decisión de Ejecución (UE) 2020/1606 en consecuencia.

(8)	Dada la urgencia de la situación epidemiológica en la Unión por lo que respecta a la propagación de la GAAP del subtipo H5N8, es importante que las modificaciones introducidas en el anexo de la Decisión de Ejecución (UE) 2020/1606 mediante la presente Decisión surtan efecto lo antes posible.

(9)	La presente Decisión debe reexaminarse en la próxima reunión del Comité Permanente de Vegetales, Animales, Alimentos y Piensos.

HA ADOPTADO LA PRESENTE DECISIÓN:

Artículo 1

El anexo de la Decisión de Ejecución (UE) 2020/1606 se sustituye por el texto del anexo de la presente Decisión.

Artículo 2

El destinatario de la presente Decisión es el Reino de los Países Bajos.
