The applicant claims that the Court should:

annul the decision of the First Board of Appeal of OHIM of 25 October 2004, in Case R 513/2002-1;

order OHIM to pay the costs.

Incorrect interpretation of Article 8(1)(b) of Regulation (EC) No 40/94.
