Does European Union public procurement law — in the case under examination, concerning excluded contracts and the general principles of free competition, equal treatment, transparency and proportionality — preclude national legislation under which contracts for the provision of ambulance and health-related transport services may be awarded directly to voluntary organisations organised predominantly on the basis of unpaid work and in return for genuine reimbursement of costs?

If such an award is regarded as compatible with Community law, can ‘the genuine reimbursement of costs’ also cover the ‘indirect and general’ costs relating to the activities carried out on a regular basis by the voluntary organisation, such as the special maintenance of the vehicles used to provide the service, meals for personnel, remuneration for the administrative staff and the services coordinator, and the necessary telephonic and radio links between the ambulance despatch centre and the voluntary organisation’s communications points?
