The Federal Competition Authority was established in 2002 as an independent, monocratic investigation authority on competition matters for the purposes of maintaining effective competition, combating cases of distortion or restriction of competition within the meaning of Austrian antitrust law or European competition rules, and ensuring compatibility with Community law and the decisions of regulators in the application of antitrust law (Section 1 of the Competition Act). Under Section 2(1) point 7 of the Competition Act, the tasks of the Federal Competition Authority now include the filing of actions for injunctive relief pursuant to Section 14(1) of the 1984 Unfair Competition Act (UWG), BGBl. No 448, in its latest applicable version. In the carrying out of the tasks of the Federal Competition Authority, it was found that cases of abuse of market power often also concern unfair competition. The Federal Competition Authority has therefore been granted a comprehensive and wide-ranging right to bring actions for injunctions in the interest of consumers in the field of fair trading law. Like the Office of Fair Trading (OFT) in the UK, the Federal Competition Authority is now also responsible for the enforcement both of competition laws and consumer protection laws. In line with established practice and case law, the granting of the right to take actions for injunctions to the associations and entities listed in Section 14 UWG - and also to the Federal Competition Authority - ensures that in addition to the interests of competitors, consumer interests are also taken into account by the entities in question. In accordance with Section 14 in conjunction with Sections 1 and 2(1) UWG (in the currently applicable version), within the meaning of Article 3(a) of Directive 98/27/EC the Federal Competition Authority is also competent to protect the collective interests of consumers as referred to in Directive 84/450/EEC on misleading advertising. |
