In a case concerning an infringement of a prohibition laid down in Directive 2000/43/EC (1) where the person wronged claims compensation for discrimination, must a Member State, if so requested by the person wronged, always examine whether discrimination has occurred — and where appropriate conclude that that was the case — regardless of whether the person accused of discrimination has or has not admitted that discrimination has occurred, in order for the requirement in Article 15 for effective, proportionate and dissuasive sanctions to be regarded as satisfied?
