    An action against the Portuguese Republic was brought before the Court of Justice of the European Communities on 14 December 2004 by the Commission of the European Communities, represented by R. Vidal Puig, acting as Agent, with an address for service in Luxembourg.

    The applicant claims that the Court should:

    Declare that, by failing to adopt the laws, regulations and administrative provisions needed to implement Commission Directive 2000/56/EC (1) of 14 September 2000, which amends Council Directive 91/439/EEC on driving licences, and in any event by failing to give notice thereof to the Commission, the Portuguese Republic has failed to fulfil its obligations under that directive;

    Order the Portuguese Republic to pay the costs.

    Pleas in law and main arguments

    The period for transposition of Directive 2000/56/EC expired on 30 September 2003.
