Komisijas Regula (EEK) Nr. 3774/92

(1992. gada 23. decembris),

ar ko groza Regulu (EEK) Nr. 2315/76, (EEK) Nr. 3143/85, (EEK) Nr. 570/88, (EEK) Nr. 429/90, (EEK) Nr. 3378/91 un (EEK) Nr. 3398/91

EIROPAS KOPIENU KOMISIJA,

ņemot vērā Eiropas Ekonomikas kopienas dibināšanas līgumu,

ņemot vērā Padomes 1968. gada 27. jūnija Regulu (EEK) Nr. 804/68 par piena un piena produktu tirgus kopīgo organizāciju [1], kurā jaunākie grozījumi izdarīti ar Regulu (EEK) Nr. 2071/92 [2], un jo īpaši tās 6. panta 7. punktu, 7.a panta 3. punktu, 12. panta 3. punktu un 28. pantu,

tā kā dažiem intervences vai tirgus produktiem var būt īpašs lietojums un/vai galamērķis;

tā kā Komisijas Regula (EEK) Nr. 569/88 [3], kurā jaunākie grozījumi izdarīti ar Regulu (EEK) Nr. 3274/92 [4], nosaka kopējus sīki izstrādātus noteikumus intervences produktu lietošanas un/vai galamērķa apstiprināšanai; tā kā sakarā ar kontroles un formalitāšu samazināšanu uz iekšējām robežām un turpmāko minētās regulas grozījumu dēļ, kā arī skaidrības un administratīvas efektivitātes labad minētā regula tika aizstāta ar Komisijas 1992. gada 16. oktobra Regulu (EEK) Nr. 3002/92 par jauniem sīki izstrādātiem noteikumiem attiecībā uz intervences produktu lietošanas un/vai galamērķa apstiprināšanu [5], lai nodrošinātu, ka intervences produkti nav novirzīti citam lietojumam un/vai no galamērķa;

tā kā noteikti ir lietderīgi izveidot vienotu apstiprināšanas sistēmu attiecībā uz intervences produktiem un tirgus produktiem, ja paredzēta identiska lietošana vai galamērķis; tā kā tādēļ saskaņā ar Komisijas Regulu (EEK) Nr. 429/90 [6] Regulas (EEK) Nr. 3002/92 darbības jomu vajadzētu paplašināt, piemērojot to arī tirgus produktiem;

tā kā jaunie sīki izstrādātie noteikumi rada nepieciešamību attiecībā uz Regulā (EEK) Nr. 569/88 paredzētajām atzīmēm grozīt šādas regulas:

- Komisijas 1975. gada 24. septembra Regulu (EEK) Nr. 2315/76 par sviesta pārdošanu no valsts rezervēm [7], kurā jaunākie grozījumi izdarīti ar Regulu (EEK) Nr. 1792/92 [8],

- Komisijas 1985. gada 11. novembra Regulu (EEK) Nr. 3143/85 par intervences sviesta, kas iebiezināta sviesta veidā paredzēts tiešam patēriņam, pārdošanu par pazeminātām cenām [9], kurā jaunākie grozījumi izdarīti ar Regulu (EEK) Nr. 1264/92 [10],

- Komisijas 1988. gada 16. februāra Regulu (EEK) Nr. 570/88 par sviesta pārdošanu par pazeminātām cenām un atbalsta piešķiršanu par krējumu, sviestu un iebiezinātu sviestu, ko izmanto mīklas izstrādājumu, saldējuma un citu pārtikas produktu ražošanā [11], kurā jaunākie grozījumi izdarīti ar Regulu (EEK) Nr. 124/92 [12],

- Regulu (EEK) Nr. 429/90 par atbalsta piešķiršanu konkursa kārtībā par iebiezinātu sviestu, kas paredzēts tiešam patēriņam Kopienā, kurā jaunākie grozījumi izdarīti ar Regulu (EEK) Nr. 1264/92,

- Komisijas 1991. gada 20. novembra Regulu (EEK) Nr. 3378/91, ar ko nosaka sīki izstrādātus noteikumus intervences krājumos esošā sviesta pārdošanai eksportam [13], kurā jaunākie grozījumi izdarīti ar Regulu (EEK) Nr. 1810/92 [14],

- Komisijas 1991. gada 20. novembra Regulu (EEK) Nr. 3398/91 par sausā vājpiena pārdošanu konkursa kārtībā barības maisījumu ražošanai [15], kurā jaunākie grozījumi izdarīti ar Regulu (EEK) Nr. 44/92 [16];

tā kā šajā regulā paredzētie pasākumi ir saskaņā ar Piena un piena produktu pārvaldības komitejas atzinumu,

IR PIEŅĒMUSI ŠO REGULU.

1. pants

Regulas (EEK) Nr. 2315/76 4.a pantu papildina ar šādu punktu:

"3. Uz pārdotajiem un no noliktavas izvestajiem sviesta iepakojumiem saskaņā ar 1. un 2. punktu skaidri redzamiem un salasāmiem burtiem norāda vienu vai vairākas šādas atzīmes:

- Mantequilla destinada al Reglamento (CEE) no 2191/81,

- Smør, der skal anvendes ifølge forordning (EØF) nr. 2191/81,

- Butter für die Zwecke der Verordnung (EWG) Nr. 2191/81,

- Βούτυρο προοριζόμενο για κανονισμό (EOK) αριθ 2191/81,

- Butter intended for the purposes of Regulation (EEC) No 2191/81,

- Beurre destiné au règlement (CEE) no 2191/81,

- Burro destinato al regolamento (CEE) n. 2191/81,

- Boter bestemd voor gebruik overeenkomstig Verordening (EEG) nr. 2191/81,

- Manteiga destinada a ser utilizada de acordo com o Regulamento (CEE) no 2191/81.

Papildus atzīmēm, kas paredzētas Komisijas Regulā (EEK) Nr. 3002/92 [17], T 5 kontroles kopijas 104. iedaļā jābūt vienai no iepriekš parādītajām atzīmēm."

2. pants

Ar šo Regulā (EEK) Nr. 3143/85 izdara šādus grozījumus:

1. Tekstu "Regulas (EEK) Nr. 1607/76 13. pants" 2. panta 4. punkta pirmajā ievilkumā aizstāj ar "Komisijas Regulas (EEK) Nr. 3002/92 5. pants [18]". Papildina ar attiecīgu zemsvītras piezīmi.

2. Tekstu "Regulas (EEK) Nr. 1687/76 2. pants" 7. panta 4. punktā aizstāj ar "Regulas (EEK) Nr. 3002/92 2. pants".

3. Tekstu "Regulas (EEK) Nr. 1687/76 11. panta 1. punkta a) un b) apakšpunkts" 9. panta 1. punktā aizstāj ar "Regulas (EEK) Nr. 3002/92 6. panta 1. punkta a) un b) apakšpunkts".

4. Tekstu "Regula (EEK) Nr. 1687/76" 9. panta 5. punktā aizstāj ar "Regula (EEK) Nr. 3002/92".

5. Ar šādu tekstu aizstāj 12. pantu:

3. pants

Ar šo Regulā (EEK) Nr. 570/88 izdara šādus grozījumus:

1. Ar šādu tekstu aizstāj 24. pantu:

"24. pants

Regulu (EEK) Nr. 3002/92 [19]mutatis mutandis piemēro produktiem, kas minēti šajā regulā, ja vien nav paredzēts citādi.

Uz 1. panta otrajā daļā minētajiem produktiem attiecina arī Regulas (EEK) Nr. 3002/92 2. pantā minēto kontroli, sākot no 6. pantā minēto operāciju sākuma līdz to izmantošanai gala produktā.

Īpaši ieraksti, kas jāizdara T 5 kontroles kopijas 104. un 106. iedaļā, ir uzskaitīti šī regulas VIII pielikumā."

2. Regulas numuru (EEK) "Nr. 569/88" 26. pantā aizstāj ar "Nr. 3002/92".

3. Šīs regulas pielikumu pievieno Regulai (EEK) Nr. 570/88 kā VIII pielikumu.

4. pants

Regulas (EEK) Nr. 429/90 14. pantu aizstāj ar šādu tekstu:

"14. pants

Komisijas Regulu (EEK) Nr. 3002/92 [20]mutatis mutandis piemēro produktiem, kas minēti šajā regulā, ja vien nav paredzēts citādi.

Attiecībā uz kontroles pasākumiem, kas paredzēti Regulas (EEK) Nr. 3002/92 2. pantā, tos piemēro produktiem, kas minēti šajā regulā, sākot no 9. pantā minēto darbību sākuma līdz laikam, kad izdarīts ieraksts, ka produktus pārņēmusi mazumtirdzniecība.

Nosūtot iepakoti iebiezinātu sviestu mazumtirdzniecībai citā dalībvalstī, papildus atzīmēm, kas paredzētas Regulā (EEK) Nr. 3002/92, T 5 kontroles kopijas 104. iedaļā ir viena no šīm atzīmēm:

- Mantequilla concentrada y envasada destinada al consumo inmediato en la Comunidad (para su aceptación por el comercio minorista),

- Emballeret koncentreret smør bestemt til direkte forbrug i Fællesskabet (til detailhandelen),

- Verpacktes Butterfett zum unmittelbaren Verbrauch in der Gemeinschaft (vom Einzelhandel zu übernehmen),

- Συμπυκνωμένο και συσκευασμένο βούτυρο που προορίζεται για άμεση κατανάλωση στην Κοινότητα (δα αναληφδεί από το λιανικό εμπόριο),

- Packed concentrated butter for direct consumption in the Community (to be taken over by the retail trade),

- Beurre concentré et emballé destiné à la consommation directe dans la Communauté (à prendre en charge par le commerce de détail),

- Burro concentrato ed imballato destinato al consumo diretto nella Comunità (da consegnare ai commercianti al minuto),

- Verpakt boterconcentraat bestemd voor rechtstreekse consumptie in de Gemeenschap (over te nemen door de detailhandel),

- Manteiga concentrada e embalada destinada ao consumo directo na Comunidade (com vista à sua tomada a cargo pelo comércio retalhista)."

5. pants

Ar šo Regulā (EEK) Nr. 3378/91 izdara šādus grozījumus:

1. Tekstu "Regulas (EEK) Nr. 569/88 18. pantu" 12. panta 1. punktā aizstāj ar "Komisijas Regulas (EEK) Nr. 3002/91 15. pantu [21]."

Papildina ar attiecīgu zemsvītras piezīmi.

7. pants

Šī regula stājas spēkā trešajā dienā pēc tās publicēšanas Eiropas Kopienu Oficiālajā Vēstnesī.

Šī regula uzliek saistības kopumā un ir tieši piemērojama visās dalībvalstīs.
