1. || Review of EU political and legal framework for organic production || Legislative/Non-legislative || As foreseen in the REFIT programme, this review will assess the relevance of the current framework for organic production (Regulation 834/2007 and Communication COM(2004) 415) to the future evolution of the sector.

2. || Review of regime for agriculture in the outermost regions (POSEI) || Legislative/Non-legislative || The initiative will review the POSEI arrangements in the light of the CAP reform.

Climate, energy and environment

3. || 2030 framework for climate and energy policies || Legislative/Non-legislative || The initiative will frame energy and climate policies beyond 2020 for the period up to 2030 to provide a long-term perspective for investments, achieve a more sustainable, secure and competitive EU energy system and ensure that the EU post 2020 is on track to meet climate and energy objectives.

4. || Framework for safe and secure unconventional hydrocarbon extraction || Legislative/Non-legislative || The aim is to ensure that opportunities to diversify energy supplies and improve competitiveness, including by production of unconventional hydrocarbon, can be safely and effectively taken up in those Member states that choose to do so. The framework would target clarity and predictability for both market operators and citizens including for exploration projects, full consideration of greenhouse gas emissions and management of climate and environmental risks, including to health, in line with public expectations.

Competition, including agriculture

5. || State aid modernization in key sectors || Non-legislative || The package completes state aid modernization in key sectors, including an assessment of the application of state aid guidelines to airports and airlines, the revision of the environmental aid guidelines, the guidelines on Research, Development and Innovation and the guidelines on rescue and restructuring aid, as well as new guidelines for state aid for agriculture and forestry.

6. || State aid modernization: General Block Exemption Regulation || Non-legislative || The revision of the GBER, as part of State Aid Modernisation, will refine general compatibility criteria to make spending more effective and to further simplify administration. The package includes a new block exemption regulation for agriculture and forestry.

Competition

7. || Review of competition rules for technology transfer agreements || Non-legislative || The aim of the review is to update the current rules that expire in 2014 by promoting licensing of intellectual property rights thus stimulating innovation while safeguarding competition.

Development and Environment

8. || Follow-up towards the post-2015 development framework || Non-legislative || This is part of the process that brings together the Millennium Development Goals (MDGs) that expire in 2015 with the Sustainable Development Goals (SDGs) into a single framework for an ambitious post-2015 development agenda. The timing of the Communication will depend on on-going international preparatory discussions.

Employment, Social Affairs and Inclusion

9. || Labour mobility package || Legislative/non-legislative || The initiative will facilitate the free movement of persons within the EU by means of a better coordination of social security schemes, thus making citizens' rights more effective and contributing to growth and jobs. The package will present recent achievements and include the revision of Regulation 883/2004 and Regulation 987/2009 on social security coordination as well as the initiative on highly mobile workers.

10. || Communication on job creation in the 'green economy' || Non-legislative || The Communication will focus on main actions to support job creation and improve resource efficiency at the workplace as one of the main challenges for Europe's competitiveness. It will focus on key economic sectors and on anticipation and emerging skills development for a more resource efficient economy.

Energy

11. || State of implementation of the internal energy market and Action Plan to implement the internal energy market at retail level || Non-legislative || In view of the objective to complete the internal energy market by 2014, the Commission will report on progress in implementation of the energy acquis and the actions identified in the Action Plan outlined in the Communication on Internal Energy market from November 2012. The Commission will also issue a retail market initiative aiming at facilitating consumer engagement, fostering competition and strengthening energy system architecture to the benefit of energy consumers.

Enterprise and Industry

12. || Industrial policy package || Non-legislative || The Communication on industrial policy will further look at manufacturing and related services in the EU with a view to enhancing competitiveness of European companies. The package will include a review of the internal market legislation for industrial products, aimed at eliminating the remaining barriers to trade, increasing the quality and efficiency of legislation and bringing the acquis up to date with the latest practices and developments.

13. || Action plan for the defence industry || Non-legislative || The initiative will set out a concrete set of actions for improving the competitiveness of the defence industry.

Environment

14. || Resource efficiency and waste || Legislative || The initiative will build on progress in implementation of the Roadmap to Resource Efficient Europe and set out the key building blocks needed to unlock EU economic potential to be more productive whilst using fewer resources and advancing towards a circular economy. It will include conclusions drawn from the development of  suitable indicators and targets; and the review of the key targets in EU waste legislation (in line with the review clauses in the Waste Framework Directive, the Landfill Directive and the Packaging Directive) and carry out an ex-post evaluation of waste stream directives, including an assessment of options to enhance coherence between them.

Equality

15. || Tackling the gender pay gap || Non-legislative || This initiative would promote and facilitate effective application of the principle of equal pay in practice and assist Member States in finding the right approaches to reduce the persisting gender pay gap.

European Convention on Human Rights (EU accession)

16. || EU Accession to the ECHR – internal rules || Legislative || The initiative sets out legal rules which are required to make the forthcoming accession to the European Convention on Human Rights operational internally.

External Action and Maritime

17. || EU Maritime Security Strategy || Non-legislative || A Joint Communication with the High Representative will set out a coherent strategic framework, combining internal and external security, and building on civilian and military cooperation, complementarities and shared resources, for better addressing major maritime security concerns.

Home  Affairs

18. || Countering violent extremism || Non-legislative || Communication suggesting to Member States how to develop new tools to counter or prevent violent forms of extremism. The Communication will draw on recommendations made by the Anti-Radicalisation Network, set up in 2011, and also contain elements for revising the EU Strategy on radicalisation and recruitment.

Humanitarian Aid

19. || Preparing an EU position on the post-Hyogo framework || Non-legislative || The initiative will frame the EU contribution to the discussions on the post-2015 international framework for action in disaster risk reduction.

Justice and Home Affairs

20. || Future priorities in the areas of justice and home affairs || Non-legislative || With the Stockholm Programme coming to an end in 2014 and policies on freedom, security and justice fully integrated into the EU system, the Commission will present a Communication on the future of the EU justice policy and a new European Agenda for home affairs.

Justice and Enterprise

21. || European Accessibility Act || Legislative/Non-legislative || The initiative will improve the market of goods and services that are accessible for persons with disabilities and elderly persons, based on a “design for all” approach. This business friendly initiative will include binding measures to promote procurement and harmonisation of accessibility standards. The initiative is currently in a consultation process with industry and stakeholders.

22. || A new approach to business failure and insolvency || Legislative/Non-legislative || The objective of this initiative is to set up minimum standards in the field of pre-insolvency procedures (reorganisation) and second chance for honest entrepreneurs. It aims to remove obstacles to cross-border trade and investment by providing a level-playing field for debtors and creditors situated in different Member States.

Internal Market and Services

23. || Follow-up to the Green Paper on long-term financing of the EU economy || Legislative/Non-legislative || The main policy objective is to increase the supply of capital to long-term investment. This may require adapting or changing framework conditions and in particular financial markets regulation in order to ensure that financial markets are better able to provide long term finance.

24. || Review of the copyright acquis || Legislative/Non-legislative || The purpose is to review the provisions of the EU copyright framework which are relevant for the online availability of material protected by copyright and related rights, with a view to ensuring that this framework is fit for purpose in the digital age. This means, inter alia, a modern framework that fosters innovative market practices, guarantees effective recognition and remuneration of rightholders, provides sustainable incentive for creativity, cultural diversity and innovation, increases the choice of and open up access to legal offers by end users, allows new business models to emerge and more effectively contributes to combating illegal offers and piracy.

25. || Framework for crisis management and resolution for financial institutions other than banks || Legislative || With a view to enhancing financial stability and in parallel to the framework for the banking sector, the initiative will ensure that non-bank financial institutions can be effectively resolved without causing systemic impact.

Protection of the EU's financial interests

26. || OLAF Reform || Legislative || Following the Communication on improving OLAF's governance and reinforcing procedural safeguards in investigations, further systemic improvements of the OLAF Regulation could be made, inspired by the procedural safeguards in the Commission's proposal on establishment of a European Public Prosecutor’s Office but which can be transposed to OLAF's administrative investigations and enacted even before the EPPO is established. This could include strengthening the legal review of investigative measures through the new office of an independent Controller of procedural safeguards, and enhanced procedural safeguards for acts similar to searches and seizures carried out by OLAF in the institutions.

Research and Innovation and Economic and Monetary Affairs

27. || Research and innovation as new sources of growth || Non-Legislative || Following from the Innovation Union, this Communication will assess how the innovation economy promotes competitiveness and provide an evidence base for identifying priority investments alongside the necessary structural reforms in the context of fiscal consolidation and unlocking growth potential.

Rule of Law

28. || The rule of law in the European Union || Non-legislative || The Communication will take forward the reflection on a framework for a consistent response where the rule of law is challenged.

Taxation and Customs Union

29. || Towards a definitive VAT system || Non-legislative || The initiative follows the December 2011 Communication on the future of VAT and aims at giving guidance on how to implement the principle of destination for the taxation of the supplies of goods and services within the EU as the best achievable way forward, abandoning the long-term objective of taxation in the Member State of origin.

Annex III: REFIT actions

1. || Recast and merger of three Directives in the area of information and consultation of workers[4] || Legislative (Recast) || Recast and mergerof three Directives further to a fitness check published in July 2013[5] in order to address some of the issues raised by the Commission SWD (and improve the operation of the Directives). This initiative is subject to a consultation of social partners.

2. || Revision of Food Hygiene legislation || Legislative (Simplification, Replacement) || Hygiene provisions will be replaced by a new act, procedures simplified and a flexible approach for SMEs will be reinforced.

3. || Simplification of the veterinary medicines legislation || Legislative (Simplification) || A marketing authorisation is required for placing veterinary medicine on the market in the EU. Administrative burden to the veterinary pharmaceutical industry will be reduced through simplified and more efficient procedures to obtain and maintain a marketing authorisation.

4. || Framework Regulation for Integrating Business Statistics (FRIBS)[6] || Legislative || This initiative aims at integrating business statistics in a common legal framework to streamline and rationalise the reference architecture for European business statistics, reducing unnecessary burden on respondents.

5. || Framework Regulation for integrating social statistics[7] || Legislative || This initiative aims at integrating social statistics in a common legal framework to streamline and rationalise the reference architecture for European social statistics, reducing unnecessary burden on respondents.

6. || Reform of the Farm Survey System. || Legislative || The basic act will be shortened and streamlined and accompanied by a delegated act in view of the next farm survey planned for 2020.

7. || Recast of eight Directives in company law[8] || Legislative (Codification) || Company law directives deal with the setting up and functioning of firms. They cover the setting up and registration of companies, protection of investors (e.g. through capital requirements,), mergers and divisions, as well as certain aspects of reporting. Some aspects of the current legal system in this area are difficult to apply, in particular for SMEs.[9] Work is underway to create one, user-friendly set of rules on company law by codifying altogether eight existing company law directives[10]. The new legal instrument will follow the “life cycle of a company" – from its incorporation until its dissolution. It will include a common section with definitions and reporting obligations and result in a significant simplification of applicable EU-rules on private and public limited liability companies.

8. || Revision and simplification of State Aid rules in the agricultural sector || Legislative (Revision) || State Aid rules in the area of agriculture will be revised with a view to making them more economically significant, focusing on cases with real impact on competition and trade in the Single Market as well as simplifying rules and procedures and relieving burden on SMEs.

9. || Revision and simplification of the legal framework for organic farming || Legislative (Revision) || The revision of the organic farming legislation will target inconsistencies, gaps and ineffective measures, simplify rules and reduce regulatory costs.

10. || Codification of twenty-six Council Regulations following the adoption of two enabling regulations relating to common commercial policy[11] || Legislative (Codification) || These proposals will codify respective legislation and bring it in line with the TFEU.

11. || Export for Recovery of non-hazardous waste  Regulation 1418/2007[12] || Legislative (Simplification) || The Regulation will be updated, procedures will be simplified and administrative burden reduced.

12. || Simplification of provisions on access to the international road haulage market [13] || Legislative (Simplification) || This proposal will simplify and clarify provisions on access to the international road haulage market and on the provision of transport services by road haulage undertakings. It will also simplify enforcement rules and enable targeted and effective checks by national authorities.

13. || Fishing Authorisation Regulation[14] || Legislative (Recast) || Recast of the current Fishing Authorisation Regulation (FAR) in order to simplify the current system, mitigate the issues of highly variable data requirements from Member States, improve consistency between FAR and the combat of illegal, unreported and unregulated fishing and the control framework as well as more broadly with the objectives of the External Dimension of the CFP policy.

14. || Technical measures for the protection of marine organisms || Legislative || Technical measures will be simplified, brought in line with with the objectives of the new Common Fisheries Policy and regrouped in a new Framework Regulation.

15. || Repeal of Directive 1999/45/EC on the classification, packaging and labelling of dangerous preparations: || Legislative (Repeal) || This Directive has become obsolete further to the adoption of new rules on classification, labelling and packaging of substances and mixtures in 2008.

16. || Repeal of Council directive on assistance to the Commission and cooperation by the Member States in the scientific examination of questions relating to food[15] || Legislative (Repeal) || The Directive has been overtaken by changes in legislation and structure of scientific cooperation. These tasks are now assured by EFSA (European Food Safety Authority).

17. || Repeal of the Regulation on Steel Statistics[16] || Legislative (Repeal) || Steel statistics are now collected though different arrangements. The legislation is therefore no longer necessary.

18. || Repeal of a Council Decision concerning arrangements for cooperation between financial intelligence units of the Member States in respect of exchanging information[17] || Legislative (Repeal) || This legislation will be taken over by the Anti-Money Laundering Directive. The timing of the repeal will depend on adoption and implementation of Anti-Money Laundering Directive proposal, adopted by Commission 5/02/2013 which will make Decision 2000/642/JHA obsolete.

19. || Repeal of Directive 2007/38/EC on the retrofitting of mirrors to heavy goods vehicles || Legislative (Repeal) || The directive is no longer relevant. Its content has been taken up by regulations on the type approval of heavy goods vehicles.

20. || Repeal of Directive 2009/33/EC on the promotion of clean and energy-efficient road transport vehicles || Legislative (Repeal) || The Directive is no longer necessary as its content has been taken over into new horizontal public procurements rules.

21. || Repeal of the Council decision on the setting of a Community target for a reduction in the consumption of primary sources of energy in the event of difficulties in the supply of crude oil and petroleum products[18] || Legislative (Repeal) || The Decision is outdated; today the release of emergency stocks is generally considered as the main response tool in case of an oil supply disruption – it can replace the missing volumes quickly and without disturbing the economic activity of the EU and the life of its citizens. The new Oil Stocks Directive (adopted 2009 –all provisions in force since 2013) covers emergency stocks and includes the possibility of a target for consumption reductions.

Annex V: Legislation that becomes applicable in 2014

On 1 January, a wide variety of important proposals will enter into force, notably the programmes agreed for the Multi-Annual Financial Framework 2014-2020 and a series of  major policy initiatives which are being introduced at the same time. The Commission also expects that the proposals set out in Annex I will also enter into force.

In addition, the following legislation becomes applicable in 2014[20]:

1 January || · Directive 2013/36/EU of the European Parliament and of the Council of 26 June 2013 on access to the activity of credit institutions and the prudential supervision of credit institutions and investment firms, amending Directive 2002/87/EC and repealing Directives 2006/48/EC and 2006/49/EC.

· Regulation (EC) No 595/2009 of the European Parliament and of the Council of 18 June 2009 on type-approval of motor vehicles and engines with respect to emissions from heavy duty vehicles (Euro VI) and on access to vehicle repair and maintenance information.

· Commission Regulation (EU) No 143/2013 of 19 February 2013 amending Directive 2007/46/EC of the European Parliament and of the Council and Commission Regulation (EC) No 692/2008 as regards the determination of CO2 emissions from vehicles submitted to multi-stage type-approval.
