KOMISJONI OTSUS,
5. detsember 2006,
millega muudetakse nõukogu direktiive 64/432/EMÜ, 90/539/EMÜ, 92/35/EMÜ, 92/119/EMÜ, 93/53/EMÜ, 95/70/EÜ, 2000/75/EÜ, 2001/89/EÜ, 2002/60/EÜ ja otsust 2001/618/EÜ riiklike referentlaborite ja asutuste loetelu osas

EUROOPA ÜHENDUSTE KOMISJON,
võttes arvesse Euroopa Ühenduse asutamislepingut,
võttes arvesse nõukogu 26. juuni 1964. aasta direktiivi 64/432/EMÜ ühendusesisest veiste ja sigadega kauplemist mõjutavate loomatervishoiu probleemide kohta, (1) eriti selle artiklit 8, artikli 9 lõiget 2, artikli 10 lõiget 2 ja artikli 16 lõike 1 teist lõiku,
võttes arvesse nõukogu 15. oktoobri 1990. aasta direktiivi 90/539/EMÜ kodulindude ja haudemunade ühendusesisest kaubandust ning kolmandatest riikidest importimist reguleerivate loomatervishoiunõuete kohta, (2) eriti selle artiklit 34,
võttes arvesse nõukogu 29. aprilli 1992. aasta direktiivi 92/35/EMÜ, milles sätestatakse hobuste Aafrika katku kontrollieeskirjad ja tõrjemeetmed, (3) eriti selle artiklit 18,
võttes arvesse nõukogu 17. detsembri 1992. aasta direktiivi 92/119/EMÜ, millega seatakse sisse üldised ühenduse meetmed teatavate loomahaiguste tõrjeks ja konkreetsed meetmed seoses sigade vesikulaarhaigusega, (4) eriti selle artikli 24 lõiget 2,
võttes arvesse nõukogu 24. juuni 1993. aasta direktiivi 93/53/EMÜ, millega kehtestatakse minimaalsed ühenduse meetmed teatavate kalahaiguste tõrjeks, (5) eriti selle artikli 18 lõike 4 teist lõiku,
võttes arvesse nõukogu 22. detsembri 1995. aasta direktiivi 95/70/EÜ, millega sätestatakse minimaalsed ühenduse meetmed teatavate kahepoolmelisi limuseid mõjutavate haiguste tõrjeks, (6) eriti selle artikli 9 teist lõiku,
võttes arvesse nõukogu 20. novembri 2000. aasta direktiivi 2000/75/EÜ, millega kehtestatakse erisätted lammaste katarraalse palaviku tõrjeks ja likvideerimiseks, (7) eriti selle artikli 19 teist lõiku,
võttes arvesse nõukogu 23. oktoobri 2001. aasta direktiivi 2001/89/EÜ ühenduse meetmete kohta sigade klassikalise katku tõrjeks, (8) eriti selle artikli 25 lõiget 2,
võttes arvesse nõukogu 27. juuni 2002. aasta direktiivi 2002/60/EÜ, millega kehtestatakse erisätted sigade aafrika katku tõrjeks ja muudetakse direktiivi 92/119/EMÜ seoses Tescheni haiguse ja sigade aafrika katkuga, (9) eriti selle artikli 26 lõiget 1,
ning arvestades järgmist:

Direktiivis 64/432/EMÜ on sätestatud tuberkuliinide ja reaktiivide ametliku kontrollimise eest vastutvate riiklike asutuste ja referentlaborite (varem: tugilaborite) loetelu, veiste brutselloosiga tegelevate riiklike referentlaborite (varem: tugilaborite) loetelu, samuti nende riiklike asutuste loetelu, kes vastutavad eelkõige veiste ensootilise leukoosi puhul laboris kasutatava standardantigeeni kalibreerimise eest ametliku EMÜ standardseerumi (EI-seerumi, mida saadakse Kopenhaagenis asuvast Statens Veterinære Serumlaboratorium’ist) suhtes.

Direktiivis 90/539/EMÜ on sätestatud, et iga liikmesriik määrab riikliku referentlabori (varem: kontroll-labori) vastutama diagnostikameetodite kooskõlastamise ja nende meetodite kasutamise eest heakskiidetud laborites. Need riiklikud referentlaborid on loetletud kõnealuses direktiivis.

Direktiivis 92/35/EMÜ on sätestatud, et iga liikmesriik määrab riikliku referentlabori vastutama diagnostikameetodite kooskõlastamise ja nende meetodite kasutamise eest heakskiidetud laborites. Need riiklikud referentlaborid on loetletud kõnealuses direktiivis.

Direktiivis 92/119/EMÜ on sätestatud, et iga liikmesriik määrab iga kõnealuses direktiivis osutatud haiguse jaoks riikliku labori. Sigade vesikulaarhaiguse riiklike diagnostikalaborite nimekiri on sätestatud kõnealuses direktiivis.

Direktiivis 93/53/EMÜ on sätestatud, et iga liikmesriik määrab iga kõnealuses direktiivis loetletud haiguse jaoks riikliku referentlabori (varem: riigi tugilabori). Riiklike referentlaborite loetelu kalahaiguste jaoks on sätestatud kõnealuses direktiivis.

Direktiivis 95/70/EÜ on sätestatud, et iga liikmesriik määrab proovide võtmiseks ja laboriuuringuteks riikliku referentlabori (varem: riigi tugilabori). Kahepoolmeliste limuste haiguste osas pädevate riiklike referentlaborite loetelu on esitatud kõnealuses direktiivis.

Direktiivis 2000/75/EÜ on sätestatud, et iga liikmesriik määrab laboriuuringuteks siseriikliku labori. Need siseriiklikud laborid on loetletud kõnealuses direktiivis.

Direktiivis 2001/89/EÜ on sätestatud, et liikmesriigid peavad tagama siseriikliku labori olemasolu, mis vastutab diagnostikastandardite ja -meetodite koordineerimise eest. Need siseriiklikud laborid on loetletud kõnealuses direktiivis.

Direktiivis 2002/60/EÜ on sätestatud, et liikmesriigid tagavad, et igas liikmesriigis on riiklik labor, mis vastutab diagnostikastandardite ja -meetodite koordineerimise eest. Need riiklikud laborid on loetletud kõnealuses direktiivis.

Komisjoni 23. juuli 2001. aasta otsuses 2001/618/EÜ (Aujeszky haigusega seotud lisatagatiste kohta ühendusesiseses sigadega kauplemises, Aujeszky haigust käsitleva teabe esitamise kriteeriumide kohta ja otsuste 93/24/EMÜ ja 93/244/EMÜ kehtetuks tunnistamise kohta) (10) kehtestatakse nende asutuste loetelu, kes vastutavad ELISA-meetodi kvaliteedi kontrollimise eest igas liikmesriigis ning eelkõige ühenduse võrdlusseerumitele vastavate riiklike võrdlusseerumite tootmise ja standardimise eest. Asutuste loetelu on esitatud kõnealuses otsuses.

Peaaegu kõikide liikmesriikide pädevad asutused on nõudnud mitmetes direktiivides ja ühes otsuses loetletud riiklike referentlaboreid käsitlevate andmete ajakohastamist. Lisaks tuleks panna neis õigusaktides loetletud riiklikud referentlaborid ja asutused vastava liikmesriigi ISO-koodi alusel tähestiku järjekorda.

Ühenduse õigustiku selguse ja järjepidevuse huvides on asjakohane kõnealustes direktiivides ja nimetatud otsuses esitatud loetelud asendada.
|

Seega tuleb direktiive 64/432/EMÜ, 90/539/EMÜ, 92/35/EMÜ, 92/119/EMÜ, 93/53/EMÜ, 95/70/EÜ, 2000/75/EÜ, 2001/89/EÜ, 2002/60/EÜ ja otsust 2001/618/EÜ vastavalt muuta.

Käesoleva otsusega ettenähtud meetmed on kooskõlas toiduahela ja loomatervishoiu alalise komitee arvamusega,

ON VASTU VÕTNUD KÄESOLEVA OTSUSE:
Artikkel 1
Direktiive 64/432/EMÜ, 90/539/EMÜ, 92/35/EMÜ, 92/119/EMÜ, 93/53/EMÜ, 95/70/EÜ, 2000/75/EÜ, 2001/89/EÜ, 2002/60/EÜ ja otsust 2001/618/EÜ on muudetud vastavalt käesoleva otsuse lisale.
Artikkel 2
Käesolevat otsust kohaldatakse alates kolmandast päevast pärast selle avaldamist Euroopa Liidu Teatajas.
Artikkel 3
Käesolev otsus on adresseeritud liikmesriikidele.
