VFc takes part in exhibitions with a view to sharing knowledge.

Duration of scheme or individual aid award: Until 31.12.2008

Objective of aid: Compensation for damage caused by epizootic disease.

The legal basis is Article 10 of Regulation (EC) No 1857/2006.

The aid is planned to cover eligible damage resulting from the depopulation period or the slaughter of animals due to overcrowding for animal welfare or to prevent the spread of the disease.

The periods when farming is suspended for health reasons and the number of animals present and slaughtered will be certified by way of declarations of the competent regional health authorities.

The loss of income will be dealt with in various ways for the farms using stamping out measures (2 km from the outbreaks) where the slaughter of animals and the suspension of farm activities have taken place, and the farms in the buffer zone (2 to 3 km from the outbreaks) where all animal movement will be stopped, which entails higher maintenance costs and a depreciation of the commercial value of animals.

Therefore:

For the farms affected or which are suspected of being contaminated located in the inner part (2 km) of the protection zone (stamping out), compensation shall be granted for the waiting period ordered by the competent health authorities, for up to a maximum of six months. For breeding farms compensation shall be granted for the entire period of suspension of farm activities ordered by the health authorities. For fattening farms compensation shall be granted on the basis of the number of days of closure (from the 30th day of being placed in the waiting period) using the FADN gross margin.

For farms in the outer part (2 to 3 km) of the protection zone, breeding animals will not be taken into account, and the period of mandatory inactivity of farms will be considered only in respect of potentially unsold animals. For closed-cycle and fattening farms the aid which may be granted is determined by the actual depreciation of the commercial value. The same method will be used for open cycle farms, but the number of days of the mandatory movement ban will run from the 30th day of being placed in the protection zone. If the farm must carry out the slaughter and destruction of the animals due to overcrowding, for animal welfare or to prevent the spread of the disease (determined by the competent health authorities), a contribution based on the market value (according to ISMEA tables) and a reimbursement of the costs of slaughtering and destroying the animals shall be made.

The objective of the aid is to support organic farming by paying for the costs of controls.

Regarding the costs in point 1 above, further clarifications are given below in response to the question posed by the Commission.

Under Article 15 of Regulation (EEC) No 2092/91, the Commission asks each year for a report on the supervision of organic production, containing the relevant data (cultivated area, number of animals, number of inspections and analyses carried out, number of undertakings by NACE code, etc.).

In order to produce a thorough report, the Flemish authorities have since 2005 set additional requirements for the inspection bodies.

Because the recognised inspection bodies are expected to supply at least the data required under Article 15, in the form stipulated by the national authorities, the amount of EUR 18 000 is to be divided between them. This amount covers the costs arising from the changes they have to make to their IT systems and the additional administrative burden of collecting the required data.

This amount is to be paid to the inspection bodies in order to avoid the additional burden and costs being passed on to the producers

up to 100 % of actual costs as regards investment in non-productive features,

up to 75 % of actual costs as regards investment in productive assets on farms in less-favoured areas, or 60 % in other areas,

additional aid may be granted at a rate of up to 100 % to cover the extra costs incurred by using traditional materials necessary to maintain the heritage features of buildings.

3.   Relocation of farm buildings in the public interest:

up to 100 % of the actual costs, where relocation simply consists of the dismantling, removal and re-erection of existing facilities,

where the relocation results in the farmer benefiting from more modern facilities, the farmer must contribute at least 60 %, or 50 % in less-favoured areas, of the increase in the value of the facilities concerned after relocation. If the beneficiary is a young farmer, this contribution shall be at least 55 % or 45 % respectively,

where the relocation results in an increase in production capacity, the contribution from the beneficiary must be at least 60 %, or 50 % in less-favoured areas, of the expenses relating to this increase. If the beneficiary is a young farmer, this contribution shall be at least 55 % or 45 % respectively.

4.   Aid towards the payment of insurance premiums:

the amount of municipal co-financing is the difference between the amount of co-financing of insurance premiums from the national budget and up to 50 % of the eligible costs of an insurance premium for insuring crops and fruit and for insuring livestock against disease.

5.   Aid for land reparcelling:

up to 100 % of actual legal and administrative costs incurred.

6.   Aid to encourage the production of quality agricultural products:

up to 100 % of actual costs incurred; this is to be provided in the form of subsidised services and must not involve direct payments of money to producers.

7.   Provision of technical support:

Maximum aid intensity: The General Council's aid will take the form of partially defraying the costs for the provision of labour to clean up the infected orchards.

The provision of labour will be calculated in relation the surface area to be treated, on the basis of at most two rounds of cutting the infected branches and, depending on the season, burning them.

A limit of 3 000 hours, corresponding to a maximum aid amount of EUR 44 700 per agricultural holding, will be imposed.

The Department will pay a maximum of 65 % of the financing needed to cover the costs of labour, i.e. a maximum of EUR 29 055 per agricultural holding, with the remaining 35 %, i.e. EUR 15 645 to be paid by the owners of the holding

Duration of the aid scheme: Autumn-winter 2007-2008

Objective and type of aid: To enable the small and medium-sized agricultural enterprises of the Bouches-du-Rhône which reported fire blight to the State, to clean up their pome fruit orchards.

Particularly favourable climate conditions have meant that since spring 2007 there has been an exceptional spread of fire blight, which is an incurable disease that causes the brutal withering of all or part of the vegetation affected. Depending on the intensity of the outbreak, from 1 to 10 rounds of cutting and waste-elimination a year may be needed during the period for combating the disease.

Of the 120 farmers who reported the disease to the State, via the Regional Plant Protection Service (Service Régional de Protection des Végétaux), 25 have requested aid for cleaning up their orchards, representing a total surface area of 418 ha to be cleaned up. The clean up should be done before the trees shed their leaves. This ad hoc aid will be provided as soon as the clean-up operations have been carried out.

As the capped aid is awarded in the form of subsidised services, not paid directly to the producers, the application of the measure is based on Article 10(1) of Regulation (EC) No 1857/2006 concerning ‘aid in respect of animal and plant diseases and pest infestations’

The following costs are eligible under the aid scheme:

compensation for damage to structures and means of production on agricultural holdings, livestock holdings and apiaries that is not covered by insurance,

animal deaths not covered by insurance.

Aid for agricultural and livestock production is conditional on the beneficiaries having suffered losses exceeding 30 % of their production, and on such holdings having valid policies which are covered by the combined agricultural insurance plan for 2007. Production the relevant insurance contract period for which had not begun on the date of the incident will also be admitted, provided that the aforementioned insurance had been taken out in the previous marketing year. So too will production not included in the combined agricultural insurance plan, unless guaranteed by another form of insurance.

As regards damage to facilities, the aid will determined on the basis of the cost approved by the Directorate-General for Agriculture, based on the maximum-cost modules established to that end.

As regards aid intended to remedy the flood damage to infrastructure for agricultural processing and marketing, the beneficiaries must also meet the requirements in Regulation (EC) No 1998/2006, including the requirement that the total de minimis aid received by any undertaking should not exceed EUR 200 000 over any period of three fiscal years

(1)  Directive 98/34/EC (OJ L 204, 21.7.1998, p. 37) consolidates Council Directive 83/189/EEC, as amended principally by Directives 88/182/EEC and 94/10/EC of the European Parliament and of the Council. Directive 98/34/EC was amended by Directive 98/48/EC (OJ L 217, 5.8.1998, p. 18) which broadened its scope to include information society services. This came into effect on 5 August 1999.

(2)  Article 8(2) of the Directive.

(3)  Article 9(2) of the Directive (‘detailed opinion … to the effect that the envisaged measure may create obstacles to the free movement of goods or services or to freedom of establishment of service operators within the internal market’).

(4)  On the basis of the Agreement on the European Economic Area, the EFTA countries contracting parties to this Agreement apply Directive 98/34/EC adapted as necessary in accordance with Annex II, Chapter XIX, point 1, and may thus issue observations relating to drafts notified by Member States of the Community. Switzerland may also issue such observations on the basis of an informal agreement for the exchange of information in the field of technical regulations.

(5)  The 98/34 procedure was extended to Turkey in the context of the Association Agreement concluded with that country (Association Agreement between the European Economic Community and Turkey (OJ 217, 29.12.1964, p. 3687)) and Decisions No 1/95 and No 2/97 of the EC-Turkey Association Council.

(6)  Article 9(3) of the Directive requiring Member States to postpone the adoption of a notified draft (except for draft regulations concerning services) for twelve months from receipt by the Commission if the latter announces its intention to propose or adopt a Directive, Regulation, or Decision on the matter.

(7)  Article 9(4)of the Directive requiring Member States to postpone the adoption of a notified draft for twelve months from the receipt by the Commission if the latter announces its finding that the draft concerns a matter which is covered by a proposal for a Directive, Regulation or Decision presented to the Council.

(8)  The Agreement on the European Economic Area (see note 4) requires EFTA countries which are contracting parties to this Agreement to notify draft technical regulations to the Commission.

Call for proposals — EACEA/14/08 under the Lifelong Learning programme

Award of grants for projects to test and develop the credit system for vocational education and training (ECVET)

(2008/C 132/08)

1.   Objectives and description

The purpose of this call for proposals is to award grants to around a dozen proposals for the organisation of two types of actions that must be combined into one project:

actions to set up or consolidate partnerships between competent institutions to establish an operational framework to develop tests on the European credit system for vocational education and training (ECVET),

experimental measures in the vocational education and training credit system (ECVET) field with a view to putting this system into practice for the benefit of various groups (e.g. employed adults, jobseekers, young people leaving initial training without qualifications).

2.   Eligible applicants

Partnerships formed from European, national, regional or sectoral bodies or undertakings working in the vocational education and training (VET) and professional qualifications sector may apply for grants under this call for proposals.

Applicants and their partners must have technical expertise and experience in the VET and professional qualification fields. They must also have the institutional legitimacy to enter into commitments and act at technical, political and operational levels in the VET and professional qualifications fields, and particularly in all aspects of the testing, development and implementation of the ECVET system.

Applications for financing may only be submitted by consortia comprising at least four bodies from at least four different eligible countries.

Applicants must be legal entities that have been established as such for more than three years.

Organisations that are established in any one of the following countries may apply:

the 27 Member States of the European Union,

the three EEA/EFTA countries (Iceland, Liechtenstein and Norway),

Turkey.

3.   Budget and project duration

The total cofinancing budget for projects under this call for proposals is EUR 3 000 000. Financial aid from the European Commission may not amount to more than 75 % of total eligible costs. Grants must total between EUR 200 000 and EUR 300 000.

Activities must start by the end of March 2009 at the latest. The projects must run for no less than 24 months and no more than 36 months.

Applications must reach the Education, Audiovisual and Culture Agency before 13 August 2008 (date as postmark).

Award of grants for actions to develop and implement the european qualifications framework (EQF), including national and sectoral qualifications frameworks

1.   Objectives and description

The objective of this call for proposals is to award grants to approximately 10-12 proposals, with participants from the maximum number of countries and sectors, to organise actions to facilitate consortia:

in supporting the implementation and development of the EQF, including by relating national and sectoral qualifications systems and frameworks to the EQF as a common reference, and strengthening the relationship with the European Higher Education Area,

in developing and implementing National Qualifications Frameworks.

2.   Eligible applicants

The submission of applications for grants under this call is open especially to consortia of European, national, regional and sectoral organisations, including, for example, ministries, qualifications authorities, sectoral associations, social partners and other key stakeholders with an interest and role in qualifications systems. Applicants should also be sufficently representative in terms of the sector, labour market or education and training system(s) that their project is intended to benefit.

Applications for funding may only be made by consortia consisting of organisations drawn from 5 or more countries.

Applications may be submitted by organisations established in one of the following countries:

the 27 EU Member States,

the three EFTA-EEA countries (Iceland, Liechtenstein, Norway),

Turkey.

3.   Budget and project duration

The total budget earmarked for the co-financing of projects under this call amounts to EUR 2 million. Grants will amount to between EUR 50 000 and EUR 200 000 per project.

The Community financial contribution will not exceed 75 % of the total eligible costs.

Activities must start not later than end of March 2009. The maximum duration of projects is 24 months.

Lifelong learning strategies

1.   Objectives and description

The objectives of the call for proposals are:

to support trans-national cooperation in the development and implementation of coherent and comprehensive national lifelong learning strategies at both the national and regional level, covering all types and levels of learning,

to support the identification of the main critical factors influencing the successful putting into place of national lifelong learning strategies,

to exchange experiences and good practice and to jointly experiment, test and transfer innovation in relation to the development and implementation of lifelong learning strategies,

to ensure strong institutional commitment, coordination and partnership with all stakeholders,

to implement lifelong learning strategies to achieve efficiency and equity.

2.   Eligible applicants

Beneficiaries can exclusively be public authorities or bodies at the national or regional level who are responsible for developing and implementing coherent and comprehensive lifelong learning strategies.

Applications for funding may only be made by consortia consisting of organisations drawn from 3 or more countries. A designated co-ordinator will manage each project or network, mandated by the partner organisations.

Applications may be submitted by organisations established in one of the following countries:

the 27 EU Member States,

the three EFTA-EEA countries (Iceland, Liechtenstein, Norway),

Turkey.

3.   Budget and project duration

The total budget earmarked for the co-financing of projects amounts to 1 500 000 EUR. The maximum grant per project will be 200 000 EUR.

Financial contribution from the Community cannot exceed 75 % of the total eligible costs.

Activities must start between 1 January 2009 and 31 March 2009. The maximum duration of projects is 12 months.

Prior notification of a concentration

1.

On 21 May 2008, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Spar Magyarország Kereskedelmi Korlátolt Felelősségű Társaság (‘Spar Hungary’, Hungary) belonging to the Austrian Spar group acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking Plus Élelmiszer Diszkont Kft. (‘Plus Hungary’, Hungary) by way of purchase of shares.

2.

The business activities of the undertakings concerned are:

for Spar Hungary: retail trade in food and non food products,

for Plus Hungary: retail trade in food and non food products.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
