Questions referred

1)

For the purposes of the application of Article 8(1)(c) of the Framework Decision [2002/584/JHA] (1), must the expression ‘the existence of an ... arrest warrant’ be understood to refer to a national — domestic — arrest warrant issued in accordance with the criminal procedural rules of the issuing Member State, and therefore distinct from the European arrest warrant?

2)

If the first question is answered in the affirmative, may the non-existence of a national — domestic — arrest warrant constitute an implied reason for non-execution of the European arrest warrant?
