Objet

By its action based on Article 263 TFEU, the applicant seeks the annulment of the decision of the Fourth Board of Appeal of the European Union Intellectual Property Office (EUIPO) of 21 April 2021 (Case R 1195/2020-4).

Operative part of the order

There is no longer any need to adjudicate on the action.

2.

Etablissements Nicolas and St. Nicolaus a.s. shall bear their own costs and shall each pay half of the costs incurred by the European Union Intellectual Property Office (EUIPO).
