BESLUT nr 2/2006 AV ASSOCIERINGSRÅDET EU-CHILE
av den 16 oktober 2006
om ändring av bilaga I till avtalet om upprättandet av en associering mellan Europeiska gemenskapen och dess medlemsstater, å ena sidan, och Republiken Chile, å andra sidan, för att beakta införlivandet av de tullförmåner som beviljas Chile genom gemenskapens Allmänna preferenssystem (GSP)

ASSOCIERINGSRÅDET HAR BESLUTAT FÖLJANDE
med beaktande av avtalet om upprättandet av en associering mellan Europeiska gemenskapen och dess medlemsstater, å ena sidan, och Republiken Chile, å andra sidan, undertecknat i Bryssel den 18 november 2002 (nedan kallat ”associeringsavtalet”), särskilt artikel 60.5, och
av följande skäl:

I syfte att säkerställa tydlighet, långsiktig ekonomisk förutsägbarhet och rättslig säkerhet för de ekonomiska aktörerna har parterna enats om att i det bilaterala frihandelsavtalet införliva de återstående tullförmåner som Chile beviljas genom gemenskapens Allmänna preferenssystem och som ännu inte finns med i förteckningen över gemenskapens tullmedgivanden i bilaga I till associeringsavtalet. |

Genom artikel 60.5 i associeringsavtalet har associeringsrådet rätt att fatta beslut i syfte att påskynda tullsänkningarna så att dessa sker i snabbare takt än vad som anges i artiklarna 65, 68 och 71, eller i syfte att på annat sätt förbättra tillträdesvillkoren enligt dessa artiklar. |

Detta beslut ersätter de i artiklarna 65, 68 och 71 angivna villkoren för den berörda produkten. |

Det är önskvärt att sörja för en smidig övergång från Allmänna preferenssystemet till den bilaterala förmånssystemordning som inrättas genom associeringsavtalet, genom att tillåta att ursprungsintyg som utfärdats inom ramen för Allmänna preferenssystemet (ursprungscertifikat formulär A eller fakturadeklaration) uppvisas under en viss tidsperiod. |
HÄRIGENOM FÖRESKRIVS FÖLJANDE.
Artikel 1
Bilaga I till associeringsavtalet skall ändras i enlighet med bestämmelserna i bilagan till detta beslut.
Artikel 2
Detta beslut skall ersätta de villkor som fastställs i artiklarna 65, 68 och 71 i associeringsavtalet i fråga om import till gemenskapen av de berörda produkterna.
Artikel 3
Ursprungsintyg som utfärdats på korrekt sätt i Chile inom ramen för gemenskapens Allmänna preferenssystem (GPS) skall i Europeiska gemenskapen godtas som giltiga ursprungsintyg enligt den bilaterala förmånsordning som inrättas genom associeringsavtalet under förutsättning att
i) |
ursprungsintyget uppvisas inom fyra månader efter dagen för detta besluts ikraftträdande, |
ii) |
ursprungsintyget och transportdokumenten utfärdats senast dagen före detta besluts ikraftträdande, |
iii) |
ursprungsintyget uppvisas vid importen till Europeiska gemenskapen som stöd för en begäran om tullförmåner som tidigare beviljades inom ramen för Allmänna preferenssystemet men som genom detta beslut införlivas i associeringsavtalet. |
Artikel 4
Detta beslut träder i kraft den 1 januari 2006 eller, om beslutet antas efter den 1 januari 2006, samma dag som det antas.
Utfärdat i Bryssel den 16 oktober 2006.
