COMMISSION REGULATION (EEC) No 2011/92 of 20 July 1992 amending Annex II to Regulation (EEC) No 2752/89 and determining the quantity of potatoes required for the manufacture of one tonne of starch and the minimum price payable for that quantity

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Regulation (EEC) No 2727/75 of 29 October 1975 on the common organization of the market in cereals (1), as last amended by Regulation (EEC) No 1738/92 (2),

Having regard to Council Regulation (EEC) No 1008/86 of 25 March 1986 laying down detailed rules for production refunds applicable to potato starch (3), as last amended by Regulation (EEC) No 1744/92 (4), and in particular Article 3 thereof,

Having regard to Council Regulation (EEC) No 1745/92 of 1 July 1992 fixing the minimum price for potatoes to be paid by the starch manufacturer to the potato producer for the 1992/93 cereals marketing year (5), and in particular Article 2 thereof,

Whereas Article 1 of Regulation (EEC) No 1008/86 provides for the fixing by the Council of a minimum price to be paid by the starch manufacturer to the potato producer for the quantity of potatoes required to manufacture one tonne of starch and whereas that price is to be adjusted according to the quantity and starch content of the potatoes actually delivered; whereas Regulation (EEC) No 1745/92 fixes the said minimum price at ECU 241,21 for the 1992/93 cereals marketing year;

Whereas Regulation (EEC) No 1744/92 fixes the premium to be paid to producers of potato starch at ECU 18,67 per tonne of potato starch produced for the 1992/93 marketing years; whereas the premium is determined on the basis of the quantity and starch content of potatoes actually delivered;

Whereas the exact minimum price and the exact premium to be paid must be established in accordance with the provisions referred to above;

Whereas the measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Cereals,

HAS ADOPTED THIS REGULATION:

Article 1

Annex II to Commission Regulation (EEC) No 2752/89 (6) is hereby replaced by the Annex hereto.

Article 2

1. The quantity of potatoes required for the manufacture of one tonne of starch and the minimum delivered factory price to be paid by the starch manufacturer shall be as set out in the Annex hereto.

2. Where the starch content of potatoes is calculated by Reimann's or Perow's scales and corresponds to a figure which appears on two or three lines in the second column of the Annex, the scales applicable shall be those corresponding to the second or to the third line.

Article 3

Commission Regulation (EEC) No 1846/90 (7) is hereby repealed.

Article 4

This Regulation shall enter into force on the day of its publication in the Official Journal of the European Communities.

It shall apply from 1 July 1992. This Regulation shall be binding in its entirety and directly applicable in all Member States.
