Notice of intention to carry out a review of an anti-dumping measure (90/C 132/04)

The Commission has received a request for a review of the measure mentioned below in accordance with Article 15 (3) of Council Regulation (EEC) No 2423/88 of 11 July 1988 (1) on protection against dumped or subsidized imports from countries not members of the European Economic Community. Following an examination of the facts and allegations contained in this request regarding the foreseeable effects of the expiry of the measure in question, the Commission has concluded, subject to a further analysis, that there is sufficient evidence that the expiry of this measure would lead again to injury or threat thereof. In support of these allegations, the Community industry has supplied evidence of an aggressive marketing policy by the Japanese exporters which has resulted in a strong position on the world market. Having a dominant position on their home market, Japanese exporters have captured the American and EFTA countries market. The only other major market left is the European Community which continues to resist. It is also alleged that the capacity in the exporting country considerably exceeds domestic requirements. The Commission therefore, after consultation, gives notice of its intention to carry out a review of the anti-dumping duty mentioned hereinafter. The measure shall remain in force pending the outcome of this review. A notice of initiation of a review will be published in due course. >TABLE>
