Proposal for a Council Regulation on the conclusion of the Protocol establishing the fishing rights and financial compensation provided for in the Agreement between the European Community and Cape Verde on fishing off Cape Verde for the period from 6 September 1994 to 5 September 1997 (COM(94)0388 - C4-0166/94 - 94/0201(CNS))

The proposal was approved with the following amendments:

(Amendment 1)

Recital 2a (new)

Whereas it is essential to improve the information provided to the budgetary authority, and whereas the Commission should draw up an annual report on the state of implementation of this Agreement, with a view to facilitating decision- making during the annual budgetary procedure;

(Amendment 2)

Recital 2b (new)

Whereas it is essential to improve the information provided to the European Parliament, and whereas the Commission should draw up an annual report on the state of implementation of this Agreement, particularly as regards its impact on the state of fisheries resources and the scientific activities financed within the framework of this Protocol;

(Amendment 3)

Article 2a (new)

The Commission shall, by 15 May of each year at the latest, submit to the budgetary authority a report on the state of application of the Agreement.

(Amendment 4)

Article 2b (new)

During the last year in which this Protocol is in force and prior to entering into any agreement for its renewal, the Commission shall submit to the Council and Parliament a report on the implementation and conditions of application of the Agreement.

(Amendment 5)

Article 2c (new)

On the basis of the above report, and following consultation with the European Parliament, the Council shall mandate the Commission to negotiate the protocols relating to the implementation of this Agreement.

(Consultation procedure)

The European Parliament,

- having regard to the Commission proposal to the Council, COM(94)0388 - 94/0201(CNS),

- having been consulted by the Council pursuant to Articles 43 and 228(2) and (3), first subparagraph, of the EC Treaty (C4-0166/94),

- having delegated the power of decision to the Committee on Fisheries, pursuant to Rule 52 of the Rules of Procedure,

- having regard to the report of the Committee on Fisheries and the opinions of the Committee on Budgets and the Committee on Development and Cooperation (A4-0032/95),

1. Approves the Commission proposal, subject to Parliament's amendments;

2. Calls on the Council to notify Parliament should it intend to depart from the text approved by Parliament;

3. Asks to be consulted again should the Council intend to make substantial modifications to the Commission proposal;

4. Instructs its President to forward this opinion to the Council and Commission.
