The Court:

1.

Sets aside the order of the European Union Civil Service Tribunal of 13 July 2006 in Case F-102/05 Eistrup v Parliament (not yet published in the ECR);

2.

Dismisses the action brought by Mr Eistrup before the Civil Service Tribunal in Case F-102/05 as inadmissible;

3.

Orders each party to bear its own costs relating to both the proceedings at first instance and the appeal.
