    1.

    The action of Mr Marcuccio is dismissed as manifestly lacking any foundation in law.

    2.

    Mr Marcuccio is ordered to bear the costs incurred by the European Commission in addition to his own costs.

    3.

    Mr Marcuccio is ordered to repay the Tribunal the sum of EUR 1 000 pursuant to Article 94 of the Rules of Procedure.
