    Operative part of the judgment

    The Court:

    1)

    Dismisses the appeal;

    2)

    Orders the Kingdom of Spain to pay its own costs and those incurred by Lenzing AG;

    3)

    Orders the Commission of the European Communities to bear its own costs.
