Form of order sought

A declaration that the Republic of Slovenia, by failing to adopt the laws, regulations and administrative provisions necessary to comply with Directive 2004/35/EC (1) of the European Parliament and of the Council of 21 April 2004 on environmental liability with regard to the prevention and remedying of environmental damage, has failed to fulfil its obligations under that directive;

an order that the Republic of Slovenia should pay the costs.

Pleas in law and main arguments

The period prescribed for implementation of Directive 2004/35/CE expired on 30 April 2007.
