    COMMISSION DECISION (EU) 2023/1576

    of 28 July 2023

    confirming the participation of Ireland in Regulation (EU) 2021/2303 of the European Parliament and of the Council on the European Union Agency for Asylum

    THE EUROPEAN COMMISSION,

    Having regard to Protocol No 21 on the position of the United Kingdom and Ireland in respect of the Area of Freedom, Security and Justice, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, and in particular Article 4 thereof,

    Having regard to the notification by Ireland of its wish to accept and be bound by the Regulation (EU) 2021/2303 of the European Parliament and of the Council of 15 December 2021 on the European Union Agency for Asylum and repealing Regulation (EU) No 439/2010 (1),

    Whereas:

    By letter of 27 March 2023, Ireland notified its wish, in accordance with Article 4 of Protocol (No 21), to accept and be bound by Regulation (EU) 2021/2303.

    All Member States participating in the European Union Agency for Asylum (EUAA) provide a certain number of experts to the asylum reserve pool referred to in Article 19(6) of Regulation (EU) 2021/2303. In order to allow Ireland to participate in Regulation (EU) 2021/2303, it is necessary to set out, as a specific condition to be fulfilled by Ireland, that Ireland should provide to the asylum reserve pool a specific number of experts. As Ireland, in the same way as the Member States already participating in the EUAA, has accepted to provide a specific number of experts to the asylum reserve pool, the conditions of participation of Ireland have been fulfilled, and its participation in Regulation (EU) 2021/2303 should be confirmed, in accordance with the procedure provided for in Article 331(1) of the Treaty on the Functioning of the European Union.

    Ireland should provide the specific number of experts to the asylum reserve pool referred to in Article 19(6) of Regulation (EU) 2021/2303 until Regulation (EU) 2021/2303 is amended with regard to the asylum reserve pool,

    HAS ADOPTED THIS DECISION:

    Article 1

    1.   The participation of Ireland in Regulation (EU) 2021/2303 is confirmed.

    2.   Ireland shall make available 8 experts to the asylum reserve pool referred to in Article 19(6) of Regulation (EU) 2021/2303.

    Article 2

    This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
