COMMISSION DECISION
of 22 December 2006
laying down transitional measures for the marketing of certain products of animal origin obtained in Bulgaria and Romania
(notified under document number C(2006) 7028)

Article 1
This Decision shall apply to products of animal origin which:
fall within the scope of Regulation (EC) No 853/2004; and
were obtained in establishments in Bulgaria and Romania until 31 December 2006.
Article 2
In addition, milk products obtained in establishments in Bulgaria may be exported to third countries until 31 December 2007 provided that the export is carried out in accordance with Article 12 of Regulation (EC) No 178/2002 of the European Parliament and of the Council ( 5 ).
Article 3
By way of derogation from Article 2(1), Member States shall from 1 January to 31 December 2007 authorise the trade in products referred to in Article 1 which are obtained in establishments authorised to export to the Community provided that the products:
bear the Community export health mark or identification mark as provided for in Article 5(1) of Regulation (EC) No 853/2004 of the establishments concerned;
are accompanied by a document as provided for in Article 14 of Regulation (EC) No 854/2004 of the European Parliament and of the Council ( 7 ) in which the competent authority of the new Member States of origin certifies the following:
‘Produced before 1 January 2007, in conformity with Commission Decision 2007/30/EC’.
Article 4
Stocks of reprinted wrapping and packaging material and labels bearing the mark prescribed in the new Member State of origin before 1 January 2007 for products of animal origin fit for human consumption, may be used until 31 December 2007, for the placing on the domestic market as provided for in Article 2.
Article 5
This Decision shall apply subject to and as from the date of entry into force of the Treaty of Accession of Bulgaria and Romania.
Article 6
This Decision is addressed to the Member States.
