    Operative part of the judgment

    The Court:

    1.

    Annuls the decision of the Fourth Board of Appeal of the European Union Intellectual Property Office (EUIPO) of 29 August 2016 (Case R 1248/2015 4) in respect of the grounds of opposition set out in Article 8(3) and (4) of Council Regulation (EC) No 207/2009 of 26 February 2009 on the European Union trade mark;

    2.

    Dismisses the action as to the remainder;

    3.

    Orders CEDC International sp. z o.o., EUIPO and Underberg AG to bear their own costs.
