    Form of order sought

    Declare that, by failing to adopt the laws, regulations and administrative provisions necessary to comply with Commission Directive 2004/116/EC (1) of 23 December 2004 amending the Annex to Council Directive 82/471/EEC as regards the inclusion of Candida guilliermondii or, in any event, by failing to communicate those provisions to the Commission, the Italian Republic has failed to fulfil its obligations under Article 2(1) of that directive;

    Order the Italian Republic to pay the costs.

    Pleas in law and main arguments

    The period for transposition of the directive expired on 30 June 2005.
