VERORDNUNG (EWG) Nr. 1461/93 DES RATES vom 8. Juni 1993 betreffend den Zugang zu den öffentlichen Aufträgen für Bieter aus den Vereinigten Staaten von Amerika

DER RAT DER EUROPÄISCHEN GEMEINSCHAFTEN -

gestützt auf den Vertrag zur Gründung der Europäischen Wirtschaftsgemeinschaft, insbesondere auf Artikel 113,

auf Vorschlag der Kommission,

in Erwägung nachstehender Gründe:

Am 25. Mai 1993 haben die Europäische Wirtschaftsgemeinschaft und die Vereinigten Staaten von Amerika eine Vereinbarung für die Zusammenarbeit über das öffentliche Beschaffungswesen, nachstehend "Vereinbarung" genannt, unterzeichnet, mit der ein Rahmen ausgewogener Rechte und Pflichten über die Öffnung von Teilen ihrer jeweiligen Märkte für öffentliche Aufträge im Hinblick auf eine Liberalisierung und Expansion des Handels geschaffen werden soll.

Die Gemeinschaft und die Vereinigten Staaten haben ferner vereinbart, Verhandlungen im Hinblick auf eine ausgewogene, umfassende Vereinbarung über das Beschaffungswesen mit einem hohen Erfassungsgrad bezueglich der Einrichtungen der Zentralregierung, der Einrichtungen auf der Ebene unter der Zentralregierung und sonstiger staatlicher Einrichtungen und eine eigenständige Vereinbarung über Telekommunikationsbeschaffungen fortzuführen.

Die Vereinigten Staaten haben ungeachtet der bedeutsamen Fortschritte in der Liberalisierung des Beschaffungswesens Strafmaßnahmen nach Titel VII des amerikanischen Trade Act 1988 verhängt, die es Bietern aus der Gemeinschaft verwehren würden, sich um öffentliche Aufträge der Bundesbehörden der Vereinigten Staaten zu bewerben, die nicht von der Vereinbarung erfasst sind. Nach Auffassung der Gemeinschaft sind solche Strafmaßnahmen diskriminierend und ungerechtfertigt.

Die Gemeinschaft muß deshalb geeignete Vorkehrungen treffen, um in ähnlicher Weise den Zugang von Bietern aus den Vereinigten Staaten von Amerika zu bestimmten Aufträgen bestimmter öffentlicher Auftraggeber zu beschränken. Diese Maßnahmen dürfen nicht gegen die Verpflichtungen der Gemeinschaft und ihrer Mitgliedstaaten in bezug auf die Vereinbarung des GATT-Übereinkommen über das öffentliche Beschaffungswesen verstossen.

Es muß dafür Sorge getragen werden, daß in Ausnahmefällen Maßnahmen, die den Zugang von Bietern aus den Vereinigten Staaten zu öffentlichen Aufträgen in der Gemeinschaft beschränken, aus Gründen des Allgemeininteresses und der öffentlichen Sicherheit nicht angewendet werden -

HAT FOLGENDE VERORDNUNG ERLASSEN:

Artikel 1

Unbeschadet der Verpflichtungen der Gemeinschaft und ihrer Mitgliedstaaten gegenüber Drittländern weisen die in Anhang I aufgeführten öffentlichen Auftraggeber Angebote von Lieferanten, Auftragnehmern und Dienstleistungserbringern zurück, die in den Vereinigten Staaten ansässig und von dort aus tätig sind,

a) für die Vergabe öffentlicher Lieferaufträge im Sinne der Richtlinie 77/62/EWG des Rates vom 21. Dezember 1976 über die Koordinierung der Verfahren zur Vergabe öffentlicher Lieferaufträge(1) , deren geschätzter Wert ohne Mehrwertsteuer unter dem gegenwärtig 125 576 ECU betragenden Schwellenwert des GATT-Übereinkommens über das öffentliche Beschaffungswesen liegt,

b) für die Vergabe öffentlicher Dienstleistungsaufträge im Sinne der Richtlinie 92/50/EWG des Rates vom 18. Juni 1992 über die Koordinierung der Verfahren zur Vergabe öffentlicher Dienstleistungsaufträge(2) , deren geschätzter Wert ohne Mehrwertsteuer unter 200 000 ECU liegt, und für die Vergabe aller in der Liste des Anhangs II genannten Dienstleistungsaufträge,

c) für die Vergabe öffentlicher Bauaufträge im Sinne der Richtlinie 71/305/EWG des Rates vom 26. Juli 1971 über die Koordinierung der Verfahren zur Vergabe öffentlicher Bauaufträge(3) , deren geschätzter Wert ohne Mehrwertsteuer unter 5 000 000 ECU liegt.

Artikel 2

Die Mitgliedstaaten können jedoch ihre in Artikel 1 genannten öffentlichen Auftraggeber ermächtigen, solche Angebote anzunehmen, wenn sie im Einzelfall der Auffassung sind, daß die Zulassung solcher Angebote notwendig ist, um

a) eine Beschränkung des Wettbewerbs auf einen einzigen Lieferanten, Auftragnehmer oder Dienstleistungserbringer zu vermeiden;

b) die Kontinuität der Belieferung oder Dienstleistungserbringung sicherzustellen;

c) Waren oder Dienstleistungen mit besonderen Merkmalen zu erhalten, die anderweitig nicht verfügbar sind;

d) unverhältnismässige Kosten für den betreffenden öffentlichen Auftraggeber zu vermeiden;

e) ihre Sicherheit zu schützen.

Die Mitgliedstaaten melden solche Fälle unverzueglich der Kommission. Die Kommission kann den durch Beschluß 71/306/EWG(4) eingesetzten Beratenden Ausschuß für das öffentliche Auftragswesen anhören.

Artikel 3

Die Kommission kann Fälle im Sinne des Artikels 2 vor den Ausschuß nach Artikel 113 des Vertrages bringen, um durch geeignete Maßnahmen eine koordinierte Anwendung von Artikel 2 der vorliegenden Verordnung in der gesamten Gemeinschaft sicherzustellen.

Artikel 4

Diese Verordnung tritt am Tag nach ihrer Veröffentlichung im Amtsblatt der Europäischen Gemeinschaft in Kraft.

Diese Verordnung ist in allen ihren Teilen verbindlich und gilt unmittelbar in jedem Mitgliedstaat.
