Form of order sought

declare that, by failing to adopt all the laws, regulations and administrative provisions necessary to comply with the Council Directive of 5 April 1993 to facilitate the free movement of doctors and the mutual recognition of their diplomas, certificates and other evidence of formal qualifications, (1) or in any event by failing to notify them to the Commission, the Czech Republic has failed to fulfil its obligations under Article 44 of that directive;

order the Czech Republic to pay the costs.

Pleas in law and main arguments

The period prescribed for transposing the directive into national law expired on 30 April 2004.
