of 17 July 2025
on the harmonised standard EN 60335-2-14:2006 on particular requirements for kitchen machines drafted in support of Directive 2014/35/EU of the European Parliament and the Council

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1025/2012 of the European Parliament and of the Council of 25 October 2012 on European standardisation, amending Council Directives 89/686/EEC and 93/15/EEC and Directives 94/9/EC, 94/25/EC, 95/16/EC, 97/23/EC, 98/34/EC, 2004/22/EC, 2007/23/EC, 2009/23/EC and 2009/105/EC of the European Parliament and of the Council and repealing Council Decision 87/95/EEC and Decision No 1673/2006/EC of the European Parliament and of the Council (1), and in particular Article 11(1), point (a), thereof,
After consulting the committee established by Article 22(1) of Regulation (EU) No 1025/2012,
Whereas:

In accordance with Article 12 of Directive 2014/35/EU of the European Parliament and the Council (2), electrical equipment manufactured in conformity with a harmonised standard, the reference to which has been published in the Official Journal of the European Union, is to be presumed to comply with the essential health and safety requirements covered by such harmonised standard. |

By letter M/511 of 8 November 2012, the Commission made a request to the European Committee for Standardisation (CEN), the European Committee for Electrotechnical Standardisation (Cenelec), and the European Telecommunications Standards Institute (ETSI) to provide the full list of the titles of harmonised standards and for the drafting, revision and the completion of harmonised standards, for electrical equipment designed for use within certain voltage limits in support of Directive 2014/35/EU (‘the request’). |

On the basis of this request, CEN and Cenelec drafted harmonised standard EN 60335-2-14:2006, on particular requirements for kitchen machines, as amended by EN 60335-2-14:2006/A12:2016, EN 60335-2-14:2006/A11:2012, EN 60335-2-14:2006/A1:2008 and corrected by EN 60335-2-14:2006/AC:2007 and EN 60335-2-14:2006/A11:2012/AC:2016. The reference of the standard was last published in the Official Journal of the European Union by Commission communication 2016/C 173/06 (3). |

On 15 December 2014, Germany raised a formal objection in accordance with Article 11 of Regulation (EU) No 1025/2012 against harmonised standard EN 60335-2-14:2006, as amended by EN 60335-2-14:2006/A12:2016, EN 60335-2-14:2006/A11:2012, EN 60335-2-14:2006/A1:2008 and corrected by EN 60335-2-14:2006/AC:2007 and EN 60335-2-14:2006/A11:2012/AC:2016. Germany explained that the harmonised standard does not meet the safety objectives of points 1(d), 2(a) and 2(c) of Annex I to Directive 2006/95/EC, as the standard lays down inadequate provisions concerning the non-touchability of cutting blades in blenders (with the exception of hand-held blenders) when these are in operation. Germany argued that the test probe, which is used according to the standard, to assess the accessibility of a mixer’s cutting blades, is not based on the dimensions of the human body or anthropometric data. |

On 26 February 2014, Directive 2014/35/EU was adopted, repealing Directive 2006/95/EC from 20 April 2016. Harmonised standards were first published under Directive 2014/35/EU by Commission communication 2016/C 249/03 (4). The communication did not include a reference to harmonised standard EN 60335-2-14:2006, therefore there could no longer be a presumption of conformity with Directive 2014/35/EU. |

On 12 August 2021, Germany submitted a subsequent update concerning the formal objection of 15 December 2014 against harmonised standard EN 60335-2-14:2006, as last amended by EN 60335-2-14/A2:2021, explaining that it still did not fully comply with the safety objectives of points 1(c), 2(a), 2(c) and 3(b) of Annex I to Directive 2014/35/EU. |

The formal objection was discussed in the Committee on Electrical Equipment in its meeting on 25 June 2024. |

Having examined standard EN 60335-2-14:2006 as amended and corrected, together with Member States’ representatives of the Committee on Electrical Equipment, the Commission concluded that the harmonised standard fails to meet the safety objectives laid down in points 1(c), 2(a), 2(c) and 3(b) of Annex I to Directive 2014/35/EU. |

Taking into consideration the above, the reference to standard EN 60335-2-14:2006 ‘Household and similar electrical appliances – Safety – Part 2-14: Particular requirements for kitchen machines’ as amended by EN 60335-2-14:2006/A12:2016, EN 60335-2-14:2006/A11:2012, EN 60335-2-14:2006/A1:2008 and corrected by EN 60335-2-14:2006/AC:2007 and EN 60335-2-14:2006/A11:2012/AC:2016, should not be published in the Official Journal of the European Union, |
HAS ADOPTED THIS DECISION:
Article 1
The Commission hereby decides not to publish the reference of the harmonised standard EN 60335-2-14:2006 ‘Household and similar electrical appliances – Safety – Part 2-14: Particular requirements for kitchen machines’ as amended by EN 60335-2-14:2006/A12:2016, EN 60335-2-14:2006/A11:2012, EN 60335-2-14:2006/A1:2008 and corrected by EN 60335-2-14:2006/AC:2007 and EN 60335-2-14:2006/A11:2012/AC:2016, in the Official Journal of the European Union.
Article 2
This Decision shall enter into force on the day of its publication in the Official Journal of the European Union.
