Must Article 6(1) of Directive 93/13/EEC of 5 April 1993 on unfair terms in consumer contracts (2) (‘Directive 93/13/EEC’) and Article 23, read in conjunction with Article 10(2), of Directive 2008/48/EC of 23 April 2008 on credit agreements for consumers and repealing Council Directive 87/102/EEC (3) (‘Directive 2008/48/EC’), be interpreted as meaning that where, in a case concerning the application to a consumer credit agreement of a penalty for failure to fulfil the obligation to provide information, introduced by national provisions into the legal order of a Member State pursuant to Article 23 of Directive 2008/48/EC, read in conjunction with Article 10(2) thereof, a court finds that there are grounds for applying the national provisions which introduce into the legal order of a Member State penalties for unfair terms used in a contract concluded with a consumer by a seller or supplier under Article 6(1) of Directive 93/13/EEC, in so far as the contractual terms covered by that abovementioned obligation to provide information are concerned, there are no grounds for applying the penalty for failure to fulfil the obligation to provide information introduced by national provisions into the legal order of the Member State pursuant to Article 23 of Directive 2008/48/EC, read in conjunction with Article 10(2) thereof?
