V IMENU naslednjih članic Svetovne trgovinske organizacije ("STO") in držav ali ločenih carinskih območij v postopku pristopanja k STO, ki so se v Singapuru dogovorili o širitvi svetovne trgovine z izdelki informacijske tehnologije in ki pokrivajo več kakor 80 odstotkov svetovne trgovine s temi izdelki ("pogodbenice"):

OB UPOŠTEVANJU ključne vloge trgovine z izdelki informacijske tehnologije pri razvoju informacijskih industrij in pri dinamični rasti svetovnega gospodarstva,

OB PRIZNAVANJU ciljev zvišanja življenjskega standarda ter povečanja blagovne proizvodnje in menjave,

V ŽELJI, da bi dosegli čim večjo svobodo v svetovni trgovini z izdelki informacijske tehnologije,

V ŽELJI, da bi spodbujali stalni tehnološki razvoj industrije informacijske tehnologije v svetovnem merilu,

ZAVEDAJOČ SE pozitivnega prispevka informacijske tehnologije h globalni gospodarski rasti in blaginji,

PO DOGOVORU, da uresničijo rezultate teh pogajanj, ki poleg koncesij, vključenih v liste, priložene Marakeškemu protokolu k Splošnemu sporazumu o carinah in trgovini 1994, zajemajo še dodatne koncesije, in

OB PRIZNAVANJU, da rezultati teh pogajanj zajemajo tudi nekatere koncesije, ponujene med pogajanji, ki so pripeljala do oblikovanja list, priloženih Marakeškemu protokolu,

IZJAVLJAJO:

1. Trgovinski režim vsake od pogodbenic se razvija na način, ki izdelkom informacijske tehnologije povečuje možnosti dostopa na trg.

2. V skladu s podrobnimi določbami, predvidenimi v Prilogi k tej deklaraciji, se vsaka pogodbenica zaveže in odpravi carine ter druge dajatve in pristojbine vseh vrst v smislu člena II:1(b) Splošnega sporazuma o carinah in trgovini iz leta 1994 v zvezi z:

(a) vsemi izdelki, ki so razvrščeni (ali jih je mogoče razvrstiti) v tarifne številke Harmoniziranega sistema (1996) ("HS"), navedenimi v Dodatku A k Prilogi k tej deklaraciji, in

(b) vsemi izdelki, navedenimi v Dodatku B k Prilogi k tej deklaraciji, ne glede na to, ali so zajeti v Dodatku A ali ne,

z enakimi znižanji carinskih stopenj z začetkom leta 1997 in koncem leta 2000, in pri tem priznava, da bo v določenih okoliščinah znižanja mogoče treba izvajati v podaljšanih fazah, pred začetkom izvajanja pa morda tudi razširiti seznam izdelkov.

3. Ministri izražajo zadovoljstvo zaradi obsežnosti seznama izdelkov, navedenih v dodatkih k Prilogi k tej deklaraciji. Svojim uradnikom naročajo, naj si v dobri veri prizadevajo za končanje večstranskih tehničnih razgovorov v Ženevi na podlagi teh podrobnih določb in to opravijo do 31. januarja 1997 ter s tem zagotovijo, da bo to deklaracijo izvajalo kar največje število udeleženk.

4. Ministri pozivajo ministre drugih članic STO in države ali ločena carinska območja v postopku pristopanja k STO, naj dajo njihovim uradnikom podobna navodila, da se bodo lahko udeležili tehničnih razgovorov, navedenih v odstavku 3 zgoraj, in polno sodelovali pri širitvi svetovne trgovine z izdelki informacijske tehnologije.

PRILOGA

PODROBNE DOLOČBE IN ZAJETI IZDELKI

Vsaka članica Svetovne trgovinske organizacije ali država ali ločeno carinsko območje v postopku pristopanja k STO lahko sodeluje pri širitvi svetovne trgovine z izdelki informacijske tehnologije v skladu z naslednjimi podrobnimi določbami:

1. Vsaka udeleženka vključi ukrepe, opisane v odstavku 2 deklaracije, v svojo listo k Splošnemu sporazumu o carinah in trgovini iz leta 1994, poleg tega pa bodisi na ravni nacionalne tarifne številke bodisi na ravni 6-mestne oznake Harmoniziranega sistema (1996) ("HS") še v svojo uradno carinsko tarifo ali katero koli drugo objavljeno carinsko tarifo, ki jo običajno uporabljajo uvozniki in izvozniki. Vsaka udeleženka, ki ni članica STO, do svojega pristopa k STO te ukrepe izvaja samostojno in jih vključi v svojo listo za dostop na trg za blago v okviru STO.

2. V ta namen vsaka udeleženka čim prej, vendar najpozneje do 1. marca 1997, vsem drugim udeleženkam pošlje dokument, ki vsebuje (a) podrobnosti o tem, kako se bo v njeni listi koncesij v okviru STO zagotavljala ustrezna carinska obravnava, in (b) podroben seznam tarifnih številk HS, ki zajemajo izdelke, navedene v Dodatku B. Ti dokumenti se pregledajo in soglasno odobrijo, postopek pregleda pa se zaključi najpozneje do 1. aprila 1997. Takoj ko je postopek pregleda za kateri koli tak dokument zaključen, se dokument predloži kot sprememba liste zadevne udeleženke v skladu s Sklepom z dne 26. marca 1980 o postopkih za spremembe in popravke list tarifnih koncesij (BISD 27S/25).

(a) Koncesije, ki jih predlaga vsaka udeleženka kot spremembe svoje liste, zavežejo in odpravijo vse carine ter druge dajatve in pristojbine vseh vrst za izdelke informacijske tehnologije, kakor sledi:

(i) carine se odpravijo z zniževanjem carinskih stopenj v enakih korakih, razen če se udeleženke dogovorijo drugače. Če se udeleženke ne dogovorijo drugače, vsaka udeleženka najpozneje do 1. julija 1997 zaveže vse tarife za postavke, navedene v dodatkih, pri čemer začne prvo tako znižanje veljati najpozneje do 1. julija 1997, drugo najpozneje do 1. januarja 1998, tretje najpozneje do 1. januarja 1999, carine pa se odpravijo najpozneje do 1. januarja 2000. Udeleženke soglašajo, da bodo spodbujale avtonomno odpravo carin že pred temi roki. Znižane stopnje se v vsaki fazi zaokrožijo na eno decimalko in

(ii) carine ter druge dajatve in pristojbine vseh vrst v smislu člena II:1(b) Splošnega sporazuma se odpravijo do 1. julija 1997, razen če je v dokumentu udeleženke, ki je bil predložen drugim udeleženkam v pregled, določeno drugače.

(b) Spremembe, ki jih glede svoje liste predlaga udeleženka, da bi zavezala in odpravila carine za izdelke informacijske tehnologije, dosežejo svoj namen:

(i) pri tarifnih številkah HS, navedenih v Dodatku A, po potrebi z oblikovanjem podrazdelkov v svoji listi na ravni nacionalne tarifne postavke in

(ii) pri izdelkih, navedenih v Dodatku B, s priložitvijo Priloge k svoji listi, vključno z vsemi izdelki iz Dodatka B, v kateri morajo biti za vse te izdelke navedene podrobne tarifne številke HS bodisi na ravni nacionalne tarifne postavke bodisi na ravni 6-mestne oznake HS.

Vsaka udeleženka nemudoma spremeni svojo nacionalno carinsko tarifo, da prikaže spremembe, ki jih je predlagala, takoj ko začnejo veljati.

3. Udeleženke se pod okriljem Sveta za blagovno menjavo redno sestajajo, da pregledajo seznam zajetih izdelkov, naveden v dodatkih, in se soglasno dogovorijo, ali bi bilo treba z vidika tehnološkega razvoja, izkušenj pri uporabi tarifnih koncesij ali sprememb nomenklature HS dodatke spremeniti tako, da bi vključili dodatne izdelke, ter da se posvetujejo o netarifnih ovirah pri trgovanju z izdelki informacijske tehnologije. Ta posvetovanja ne posegajo v pravice in obveznosti v okviru Sporazuma STO.

4. Udeleženke se sestanejo takoj, ko je to mogoče, v vsakem primeru pa najpozneje do 1. aprila 1997, da pregledajo stanje prispelih sprejemov in ocenijo sklepne ugotovitve, ki jih je potrebno sprejeti. Udeleženke izvedejo ukrepe, predvidene v deklaraciji, pod pogojem, da do takrat sporoči svoj sprejem toliko udeleženk, da skupaj predstavljajo približno 90 odstotkov svetovne trgovine [1] z izdelki informacijske tehnologije, in pod pogojem, da so se udeleženke med seboj dogovorile o poteku faz. Pri ocenjevanju, ali naj izvedejo ukrepe, predvidene v deklaraciji, če je odstotek svetovne trgovine z izdelki informacijske tehnologije, ki ga predstavljajo udeleženke, nekoliko nižji od 90 odstotkov, lahko udeleženke upoštevajo obseg udeležbe držav ali ločenih carinskih območij, ki zanje predstavlja znaten del njihove lastne trgovine s takšnimi izdelki. Na tem sestanku udeleženke ugotovijo, ali so ta merila izpolnjena.

5. Udeleženke se sestanejo tako pogosto, kot je potrebno, vendar najpozneje do 30. septembra 1997, da proučijo kakršna koli medsebojna razhajanja pri uvrščanju izdelkov informacijske tehnologije, pri čemer začnejo z izdelki, navedenimi v Dodatku B. Udeleženke soglašajo s skupnim ciljem, da po potrebi dosežejo skupno uvrstitev za te izdelke v okviru obstoječe nomenklature HS ob upoštevanju razlag in odločitev Sveta za carinsko sodelovanje (znanega tudi kot Svetovna carinska organizacija ali "WCO"). V vsakem primeru, pri katerem razhajanje v uvrščanju ostane, udeleženke proučijo, ali lahko WCO predložijo skupni predlog za ažuriranje obstoječe nomenklature HS ali za rešitev razhajanja pri razlagi nomenklature HS.

6. Udeleženke razumejo, da se bo člen XXIII Splošnega sporazuma uporabil v primeru, da se ugodnosti, ki jih ima udeležena članica STO neposredno ali posredno z izvajanjem te deklaracije, izničijo ali omejijo zaradi uporabe nekega ukrepa s strani druge udeležene članice STO, ne glede na to, ali je ta ukrep v nasprotju z določbami Splošnega sporazuma ali ne.

7. Vsaka udeleženka z naklonjenostjo prouči kakršno koli prošnjo katere koli druge udeleženke za posvetovanje v zvezi z zgoraj navedenimi zavezami. Ta posvetovanja ne posegajo v pravice in obveznosti v okviru Sporazuma STO.

8. Udeleženke, ki delujejo pod okriljem Sveta za blagovno menjavo, o teh podrobnih določbah obvestijo druge članice STO in države ali ločena carinska območja, ki so v postopku pristopanja k STO, in začnejo posvetovanja, da bi olajšale njihovo udeležbo pri širitvi trgovine z izdelki informacijske tehnologije na podlagi te deklaracije.

9. V okviru teh podrobnih določb pomeni pojem "udeleženka" tiste članice STO ali države ali ločena carinska območja, ki najpozneje do 1. marca 1997 predložijo dokument, opisan v odstavku 2.

10. To prilogo lahko sprejmejo vse članice STO in katera koli država ali ločeno carinsko območje, ki je v postopku pristopanja k STO. Sprejemi se pisno sporočijo generalnemu direktorju, ki o tem obvesti vse udeleženke.

Priloga ima dva dodatka.

V Dodatku A so navedene tarifne številke HS in deli tarifnih številk, ki jih je treba zajeti.

V Dodatku B so navedeni specifični izdelki, ki jih mora ITA zajeti, kjer koli že so razvrščeni v HS.

Attachment B

Positive list of specific products to be covered by this agreement wherever they are classified in the HS.

Where parts are specified, they are to be covered in accordance with HS Notes 2 (b) to Section XVI and Chapter 90, respectively.

- Computers: automatic data processing machines capable of (1) storing the processing program or programs and at least the data immediately necessary for the execution of the program; (2) being freely programmed in accordance with the requirements of the user; (3) performing arithmetical computations specified by the user; and (4) executing, without human intervention, a processing program which requires them to modify their execution, by logical decision during the processing run.

The agreement covers such automatic data processing machines whether or not they are able to receive and process with the assistance of central processing unit telephony signals, television signals, or other analogue or digitally processed audio or video signals. Machines performing a specific function other than data processing, or incorporating or working in conjunction with an automatic data processing machine, and not otherwise specified under Attachment A or B, are not covered by this agreement,

- Electric amplifiers when used as repeaters in line telephony products falling within this agreement, and parts thereof,

- Flat panel displays (including LCD, electro luminescence, plasma and other technologies) for products falling within this agreement, and parts thereof,

- Network equipment: local area network (LAN) and wide area network (WAN) apparatus, including those products dedicated for use solely or principally to permit the interconnection of automatic data processing machines and units thereof for a network that is used primarily for the sharing of resources such as central processor units, data storage devices and input or output - including adapters, hubs, in-line repeaters, converters, concentrators, bridges and routers and printed circuit assemblies for physical incorporation into automatic data processing machines and units thereof,

- Monitors: display units of automatic data processing machines with a cathode ray tube with a dot screen pitch smaller than 0,4 mm not capable of receiving and processing television signals or other analogue or digitally processed audio or video signals without assistance of a central processing unit of a computer as defined in this agreement. The agreement does not, therefore, cover televisions, including high definition televisions [1],

- Optical disc storage units, for automatic data processing machines (including CD drives and DVD-drives), whether or not having the capability of writing/recording as well as reading, whether or not in their own housings,

- Paging alert devices, and parts thereof,

- Plotters whether input or output units of HS heading nr 8471 or drawing or drafting machines of HS heading nr 9017,

- Printed circuit assemblies for products falling within this agreement, including such assemblies for external connections such as cards that conform to the PCMCIA standard.

Such printed circuit assemblies consist of one or more printed circuits of heading 8534 with one or more active elements assembled thereon, with or without passive elements "Active elements" means diodes, transistors, and similar semiconductor devices, whether or not photosensitive, of heading 8541, and integrated circuits and micro assemblies of heading 8542,

- Projection type flat panel display units used with automatic data processing machines which can display digital information generated by the central processing unit,

- Proprietary format storage devices including media therefore for automatic data processing machines, with or without removable media and whether magnetic, optical or other technology, including Bernouilli Box, Syquest, or Zipdrive cartridge storage units,
