on the exercise of the power to adopt delegated acts conferred on the Commission pursuant to Regulation (EU) 2018/1091 of the European Parliament and of the Council on integrated farm statistics

1. INTRODUCTION

Articles 5(5), 8(3) and 9(1) of Regulation (EU) 2018/1091 of the European Parliament and of the Council of 18 July 2018 1 confer on the Commission the power to adopt delegated acts.

The Commission is empowered to adopt delegated acts in line with Article 16 of Regulation (EU) 2018/1091 for the purposes described below.

·Amending the variables listed in Annex III, where necessary, in order to harmonise them with the data sources specified in Article 4(2) for 2023 and 2026.

·Amending the detailed topics listed in Annex IV for 2023 and 2026.

·Supplementing the module data set out in Annex IV if collecting additional information is deemed necessary. Those delegated acts must specify:

(a)the topics and detailed topics to be provided in the ad hoc module and the reason for these additional statistical needs;

(b)the reference year.

The same Regulation states that delegated acts referred in Articles 5(5) and 8(3) must ‘be adopted by 30 September 2021 for the reference year 2023 and by 30 September 2024 for the reference year 2026’.

Delegated acts referred to in Article 9(1) can be adopted starting with the reference year 2023 and at 3-year intervals. The Commission must not propose ad hoc modules for reference years during which data collection is carried out as part of a census (which was only the case for 2020).

2. LEGAL BASIS

Under Article 16 of Regulation (EU) 2018/1091, the Commission is empowered to adopt delegated acts for a period of 5 years from 27 August 2018. The delegation of power must be tacitly extended for periods of an identical duration unless the European Parliament or the Council opposes such an extension no later than 3 months before the end of each period.

The Commission must draw up a report in respect of the delegation of power no later than 9 months before the end of the 5-year period.

This report fulfils that obligation.

3. EXERCISE OF THE DELEGATION

The Commission has not yet exercised the power to adopt delegated acts conferred on it by Regulation (EU) 2018/1091.

The Commission may still adopt delegated acts for the 2026 data collection, with a deadline of 30 September 2024 for delegated acts:

·amending the lists of variables of the core

·amending the lists of variables of the modules

·proposing new ad hoc modules.

4. CONCLUSION

The Commission has not yet exercised the power to adopt delegated acts conferred on it by Regulation (EU) 2018/1091.

The Commission considers that it should continue to have the delegated powers as it may need to adopt delegated acts in the future for the 2026 data collection and to supplement the module data set out in Annex IV under the conditions laid down in Regulation (EU) 2018/1091.
