Drugo poročilo o napredku strategije za poenostavitev zakonodajnega okolja

1. UVOD

STRATEGIJA ZA POENOSTAVITEV ZAKONODAJNEGA OKOLJA, ZASNOVANA OKTOBRA 2005 [1], določa tekoči program ukrepov za poenostavitev, ki jih je treba sprejeti med letoma 2005 in 2008, da bi se izboljšali kakovost in konkurenčnost pravnega reda Skupnosti in hkrati ohranili njegovi glavni cilji na posameznih političnih področjih.

To drugo poročilo o napredku, ki dopolnjuje sporočilo „ Drugi strateški pregled boljše pravne ureditve v Evropski uniji“ [2], opisuje v kakovostnem in količinskem smislu že dosežene rezultate, pot, ki je še pred zakonodajalcem EU, in si prizadeva dati nov zagon strategiji za poenostavitev, ki je bistveni element splošne politike boljše pravne ureditve in strategije za rast in delovna mesta Evropske unije.

To poročilo tudi kaže, da Komisija učinkovito izpolnjuje svoje obveznosti v okviru tekočega programa.

Državljani in podjetja so že opazili otipljive rezultate in jih bodo še več, ko bodo sprejete številne pobude, ki še čakajo na obravnavo zakonodajalca. Prizadevanja so osredotočena na projekte, ki prinašajo znatne koristi interesnim skupinami, kot so mala in srednje velika podjetja (MSP) ali posamezni podjetniki, ki se morajo še prevečkrat spopadati z nesorazmernimi zakonskimi zahtevami.

Komisija bo dokončala popoln pregled pravnega reda Skupnosti s preverjanjem, ali so veljavni instrumenti še potrebni, ali je uporabljen pravilen zakonodajni slog, in ali so vse naložene obveznosti kolikor je mogoče neobremenjujoče in združljive z želenimi rezultati politike. Ta proces bo tudi opredelil nove pobude, ki bodo vključene v posodobljeni tekoči program za poenostavitev, ki bo predstavljen v začetku leta 2009. Za zagotovitev resničnih rezultatov se mora ta zagon nadaljevati še v naslednjem zakonodajnem obdobju.

Kadar koli se bo pokazala rešitev za poenostavitev življenja podjetjem, ne da bi to vplivalo na temeljne cilje politike ali povzročalo druge znatne spremembe zakonodajnega okvira, bo Komisija uporabila tako imenovani mehanizem takojšnjega ukrepanja[3] za dosego zastavljenega cilja, ki je zmanjšanje upravnega bremena v EU za 25 %[4] do leta 2012. Večji projekt, ki ga bo začela Komisija za „ugotavljanje in oceno“ upravnega bremena na prednostnih področjih, bo dal zagon tudi programu za poenostavitev.

2. STANJE TEKOčEGA PROGRAMA ZA POENOSTAVITEV

2.1. Pregled

Strategija za poenostavitev iz oktobra 2005 je opredelila začetni sklop približno 100 pobud za tekoči program za obdobje od leta 2005 do 2008. Novembra 2006[5] je bilo dodanih 43 novih pobud in v oktobru 2007[6] še 16, s čimer se je obseg izvajanja poenostavitve razširil na vsa področja politik in podaljšal časovni razpored do leta 2009. Program uporablja zakonodajne tehnike, kot so razveljavitev, kodifikacija in preoblikovanje[7].

Tekoči program se izvaja v okviru predvidenega časovnega razporeda. Do sedaj je Komisija sprejela več kot polovico posodobljenega programa 2005–2009.

Komisija je realizirala 80 % pobud, ki so bile predvidene za sprejetje v letu 2007.

Do sedaj je Komisija sprejela 91 predlogov, od katerih jih je 24 tako imenovanih samostojnih aktov, sprejetih po postopku komitilogije, 16 jih je sprejel zakonodajalec, 44 jih je še vedno v obravnavi zakonodajalca, v sedmih primerih pa gre bodisi za revizije, kadar zakonodajni ukrep ni bil potreben, bodisi združene pobude.

V celoti je Komisija od oktobra 2005 predložila za razveljavitev, spremembo ali nadomestitev že približno 400 pravnih aktov. To pomeni, da bo približno 300 pravnih aktov, kar je približno 5 000 strani Uradnega lista, izbrisanih iz registra predpisov Skupnosti. Poleg tega je Komisija od začetka svojega delovanja sprejela ukrepe za odpravo ali pa predlagala, da se iz pravnega reda Skupnosti odpravi približno 2 500 zastarelih aktov.

2.2. Že sprejeta zakonodaja

Izvajanje strategije za poenostavitev zakonodajnega okolja je podjetjem in državljanom že prineslo dejanske koristi.

2.2.1. Akti, ki jih je sprejela Komisija

Do sedaj je bilo 24 pobud za poenostavitev sprejetih kot samostojni akti Komisije po postopku komitologije (Priloga 4). Na primer:

- v letu 2005 je Komisija sprejela uredbo o določitvi znižanih pristojbin in uvedbi sistema upravne pomoči za mala in srednje velika podjetja, ki registrirajo farmacevtske izdelke . To malim in srednje velikim podjetjem zagotavlja 90-odstotno znižanje pristojbin za znanstvena mnenja, znižanje pristojbin za mala in srednje velika podjetja pri vlogah za dovoljenje za promet in za pridobitev pomoči na področju predpisov. Te možnosti so že razširjene na mala in srednje velika podjetja, ki delujejo na tem področju;

- pravila glede dokazila o uvozu v tretje države (v zvezi z diferenciranimi izvoznimi nadomestili za nekatere kmetijske proizvode) so bila spremenjena, da izvoznikom, ki zaprosijo za nadomestila, omogočajo uporabo računalniških podatkov o sledenju in določanju položaja kontejnerskih ladij namesto običajnih carinskih dokumentov (ki jih je v nekaterih državah težko pridobiti);

- Komisija je že sprejela priporočilo glede trgov elektronskih komunikacij , ki se osredotoča na zakonsko ureditev na veleprodajni ravni, in je zmanjšala od 18 na 7 število trgov, ki so lahko predmet predhodnega urejanja. Ocenjeno je, da so upravni stroški znižani za približno 25–30 % za operaterje fiksnega omrežja in za približno 30–40 % za nacionalne regulativne organe (NRO). Poenostavljeni postopki pregleda trga bodo tudi omogočili dodatne prihranke NRO.

2.2.2. Ukrepi, ki jih sprejme zakonodajalec

Večji del programa je glede sprejetja odvisen od zakonodajalca, običajno v okviru postopka soodločanja. Do sedaj je bilo sprejetih 16 pobud za poenostavitev v tekočem programu 2005–2009 (Priloga 5), na primer:

- Na področju kmetijstva je zakonodajalec sprejel preoblikovanje 21 skupnih ureditev trgov v enotni sistem, da se racionalizira in poenostavi skupna kmetijska politika v skupno korist kmetov, uprav in družb iz kmetijskega sektorja. Ustanovitev enotne skupne ureditve trgov bo zmanjšala obseg zakonodaje v kmetijskem sektorju, izboljšala njeno preglednost, in omogočila lažji dostop do politike. To vključuje razveljavitev skoraj 50 aktov Sveta in nadomestitev več kot 650 zakonskih členov v veljavnih uredbah s približno 200, ki omogočajo veliko enostavnejše splošno zakonodajno okolje, ne da bi pri tem spreminjali temeljne politike.

- Direktiva o pravnih sredstvih na področju javnega naročanja . Leta 2003 je bila vrednost tega sektorja ocenjena na 1 500 milijard EUR, kar je 16,3 % BDP EU15. Nova direktiva izboljšuje nacionalne postopke pregleda, ki jih lahko podjetja uporabijo, kadar menijo, da je javni organ nepravično oddal naročilo. Direktiva zlasti uvaja obvezno obdobje mirovanja med objavo odločitve o oddaji naročila in podpisom pogodbe o javnem naročilu, da imajo ponudniki na voljo dovolj časa za preučitev odločitve in oceno, ali je primerno sprožiti revizijski postopek. Direktiva vsebuje dodatna pravila za zagotovitev njene učinkovitosti. Uvedba teh novih pravic in mehanizmov za zavrnjene ponudnike v vseh 27 državah članicah je odločilna za zagotovitev, da je naročilo na koncu oddano družbi, ki je dala najboljšo ponudbo, in za ustvarjanje zaupanja podjetij in javnosti v pravičnost postopkov javnega naročanja. Ukrepi za poenostavitev vključujejo razveljavitev veljavnih spravnih mehanizmov in potrdil, za katera podjetja niso nikoli pokazala dejanskega zanimanja in so sedaj neuporabljena.

- Direktiva o plačilnih storitvah prispeva k ustvarjanju „enotnega plačilnega območja“ v EU, ki bi gospodarstvu EU tako lahko prihranilo do 28 milijard EUR na leto. Cilj tega predloga je, da postanejo čezmejna plačila, ki se jih opravi s kreditno, debetno plačilno kartico ali z elektronskim bančnim nakazilom, neposredno bremenitvijo ali katerim koli drugim plačilnim instrumentom, prav tako preprosta, poceni in varna kot „nacionalna“ plačila v posamezni državi članici. Direktiva zagotavlja pravičen in odprt dostop do plačilnih trgov ter krepi in standardizira varstvo potrošnikov. Poenostavitev prinaša koristi zaradi uskladitev zahtev za dostop na trg, premagovanja razdrobitve, nastale zaradi različnih nacionalnih pravil in pravil EU o zahtevah po informacijah, in zaradi uskladitve temeljnih pravic in obveznosti uporabnikov in ponudnikov za boljšo varnost in učinkovitost. Bolj učinkovit in konkurenčen plačilni trg pomeni tudi, da Evropejci plačajo manj za osnovne bančne storitve, katerih povprečni letni strošek po EU znaša od 34 EUR pa do 252 EUR.

- Razveljavitev večine zahtev na področju predpakiranja je ukinila nacionalna pravila in pravila Skupnosti za približno 70 potrošniških izdelkov. Podjetja so sedaj lahko bolj prožna pri odzivanju na potrebe potrošnikov.

- Na carinskem področju je zakonodajalec sprejel Odločbo o e-carini, katere namen je ustvariti evropski elektronski sistem za izmenjavo podatkov med javnimi organi in podjetji. Racionalizirani carinski postopki z uporabo avtomatiziranih in med seboj povezanih carinskih sistemov bodo povečali mednarodno trgovino. Ko bo integrirani sistem v celoti deloval, bo podjetjem prihranil 2,5 milijarde EUR letno, kar je veliko več kot odplačevanje naložbe 40–50 milijonov EUR letno, ki so jih vložile Komisija in države članice. Sprejetje posodobljenega carinskega zakonika, ki bo revidiral carinsko zakonodajo Skupnosti, je predvideno za leto 2008.

2.3. Predlogi, ki čakajo na obravnavo zakonodajalca

Približno 44 predlogov za poenostavitev trenutno čaka na obravnavo zakonodajalca. Vključujejo številne pomembne predloge, katerih sprejetje bo prispevalo k poenostavitvi zakonodajnega okolja, kot so:

- Temeljna revizija zavarovalnega prava EU ( Solventnost II ) bo izboljšala varstvo zavarovanca po vsej EU z enotnejšimi zahtevami glede solventnosti zavarovalnic ob upoštevanju obsega tveganja. Solventnost II bo spodbudila boljše obvladovanje tveganja, boljšo cenovno politiko in okrepljen nadzor, kar bo povečalo zaupanje potrošnikov. Povečala bo tudi konkurenco (zlasti za panoge masovne prodaje na drobno, kot sta avtomobilsko in stanovanjsko zavarovanje), kar bo vplivalo na zniževanje cen nekaterih zavarovanj, spodbudila bo inovativnosti produktov in izboljšala mednarodno konkurenčnost evropskih zavarovateljev. Končno bo zakonodajno okolje bolj pregledno in bolj prijazno do uporabnika z eno direktivo, ki bo nadomestila sedanji skupek pravil, vsebovan v 14 različnih direktivah;

- Kodeks poslovanja računalniških sistemov rezervacij je bil oblikovan za trg, ki se je znatno razvil s prodajo letalskih družb in povečanjem rezervacij prek interneta, sedaj pa je zrel za uvedbo več konkurence. Komisija predlaga, da bi dali bolj proste roke silam trga pri spopadanju s stroški rezervacij, ki jih morajo plačevati letalske družbe in potniki, in so višje, kot je treba. Povečana konkurenca bo izboljšala kakovost ponujenih storitev in zmanjšala distribucijske stroške v sektorju letalskih prevozov: stroški rezervacij za posamezen del potovanja bodo predvidoma od 0,7 EUR do 0,9 EUR nižji, tako se bo strošek v celoti znižal za 190–240 milijonov EUR letno.

- Cilj spremembe pravil, ki urejajo elektronska komunikacijska omrežja in storitve , je zagotoviti učinkovito konkurenco, spodbujanje naložb, utrditev notranjega trga in okrepitev interesov potrošnikov. Precejšnje zmanjšanje obsega zakonodaje se priporoča tam, kjer je jasen trend konkurence. Z neodvisno študijo o razmerju med stroški in koristmi predlaganega organa za trg evropskih elektronskih komunikacij, je bilo ocenjeno, da bodo možne gospodarske koristi 10 do 30 krat presegle svoje operativne stroške (to je 250–800 milijonov EUR), zaradi zmanjšane zakonodajne negotovosti in hitrejšega reševanja zadev. Za ponudnike storitev, odvisne od radijskega spektra, revizija uvaja več prožnosti, zmanjšuje stroške poslovanja in odpravlja ovire za nove ponudnike pri vstopu. Rezultat tega bo večja izbira za potrošnike in nižje cene teh storitev.

- Nova direktiva o notranjem prevozu nevarnega blaga bo uvedla tri načine kopenskega prevoza (cestni, železniški in celinske plovne poti) v enem samem zakonodajnem aktu. Predlog vsebuje enotne določbe za vse tri (kadar je mogoče) in razveljavi zastarele določbe. Razveljavljeni bosta zlasti dve direktivi o svetovalcih na področju varnosti glede nevarnega blaga in štiri odločbe o nacionalnih odstopanjih. Rezultat tega bo do uporabnika prijazno, pregledno besedilo, ki bo zmanjšalo obseg pravnega reda Skupnosti za približno 2 000 strani.

- Revizija direktive o igračah bo posodobila varnostne zahteve in preprečila srednje in kratkoročne škodljive učinke na otroke, hkrati pa bo izboljšala delovanje notranjih trgov za igrače. Glavni cilj revizije je posodobitev varnostnih zahtev za igrače glede njihovih kemičnih, fizičnih in mehaničnih lastnosti. Za zagotovitev, da so na trgu EU na voljo samo varne igrače, bodo upoštevana zadnja znanstvena spoznanja. Poleg tega bo v državah članicah izboljšan način izvajanja direktive, obveze držav članic glede ustreznega in učinkovitega izvajanja nadzora trga pa bodo še večje.

2.4. Pobude Komisije v pripravi (2008–2009)

Prizadevanja Komisije se bodo v naslednjih dveh letih okrepila. Posodobljeni program 2008–2009 (Priloga 1) sestavlja 45 pobud za leto 2008 in 9 pobud za leto 2009. Prihodnje pobude za poenostavitev:

- Revizija zakonodaje na področju prava družb, pravnega reda Skupnosti na področju računovodstva in revizije bo odpravila ali zmanjšala vrsto upravnih zahtev, ki se sedaj štejejo za zastarele, odvečne ali podvojene. Odpravila bo nekatere zahteve po informacijah iz direktiv o gospodarskih družbah, poenostavila zahteve glede razkritja za gospodarske družbe in omogočila državam članicam, da še nadalje zmanjšajo zahteve v zvezi s poročanjem in revizijo za mala in srednje velika podjetja.

- Revizija uredbe o splošni skupinski izjemi (GBER) bo v enem dokumentu zbrala vse določbe o državni pomoči, izvzete od obveznosti priglasitve in tako zmanjšala upravno breme upravičencem, državam članicam in Komisiji. Nova uredba o splošni skupinski izjemi bo zajemala področja, ki jih že vsebujejo skupinske izjeme v zvezi z usposabljanjem, zaposlovanjem ter malimi in srednje velikimi podjetji, ter tudi nova področja, kot so okolje, rizični kapital in regionalna pomoč. Zelo bo izboljšala tudi dostop malih in srednje velikih podjetij do programov državne pomoči, na primer „dodatek za MSP“ bo poleg običajne veljavne osnovne pomoči za naložbe in zaposlovanje usklajen in zvišan s 15 % na 20 % za mala podjetja in s 7,5 % na 10 % za srednje velika podjetja.

- Revizija sistema Intrastat bo zmanjšala breme, naloženo podjetjem s sistemom zbiranja statističnih podatkov Skupnosti v zvezi s trgovinsko menjavo med državami članicami. Komisija bo v kratkem predlagala nadaljnjo poenostavitev sistema po običajnih metodah z zmanjšanjem števila postavk nomenklature carinske tarife in povečanjem pragov za izvzetje velikega števila podjetij. Ocenjeno je, da do 190 000 podjetij lahko izvzetih iz obveznosti sporočanja statističnih podatkov. Hkrati bo Komisija preučila druge dolgoročne možnosti vključno z možnim prehodom na enosmerni sistem poročanja[8]

- Prihodnja uredba o naprednih varnostnih ukrepih in pnevmatikah bo nadomestila približno 50 različnih direktiv z eno samo uredbo. To bo bistveno olajšalo breme državam članicam, ki jim ne bo treba več prenašati pravil ES na tem področju. Poleg tega bodo direktna sklicevanja na uredbe Gospodarske komisije Združenih narodov za Evropo (UNECE) občutno pospešila usklajevanje zakonodaje EU s pravili UNECE, kar bo industriji omogočilo, da se bo hitreje prilagajala tehnološkemu razvoju na mednarodni ravni.

- Revizija direktive o odpadni električni in elektronski opremi (WEEE) in direktiva o omejitvi uporabe nekaterih nevarnih snovi v električni in elektronski opremi (RoHS) bo pojasnila koncepte, olajšala njihovo izvajanje in uveljavljanje, zmanjšala upravne stroške za proizvajalce, poleg tega pa izvajalcem zagotovila bolj pregledno področje delovanja.

- Predlog okvirne direktive o pravicah potrošnikov bo zagotovil skupne opredelitve in uredil glavne pogodbene pravice potrošnikov in pravna sredstva. Zakonodajni okvir, ki bo enostavnejši in jasnejši za podjetja in za potrošnike, bo prispeval k delovanju notranjega trga in ustvarjanju zaupanja potrošnikov.

- Posodobitev in prenovitev nadzornega sistema skupne ribiške politike (SRP) bosta zmanjšali ovire za sektor in povečali uporabo orodij informacijske tehnologije za zmanjšanje obveznosti poročanja.

Pobude za poenostavitev, ki so zlasti pomembne za mala in srednje velika podjetja, bodo poudarjene tudi v „Zakonu o malem gospodarstvu za Evropo“ , ki je predviden v letu 2008.

2.5. Poenostavitev po zaključitvi tekočega programa

Poenostavitev se ne konča s ciljnimi programi, kot je tekoči program za poenostavitev, program za zmanjšanje upravnih bremen in program za kodifikacijo. Ista nujna zahteva po enostavnosti mora postati splošno veljavna za vse zakonodajne predloge in tudi za vse operativne postopke. Na primer:

- Na področju raziskav – ključnem elementu lizbonske strategije – so bili predlagani konkretni ukrepi[9] za poenostavitev 7. okvirnega programa za raziskave, tehnološki razvoj in predstavitvene dejavnosti . Upravna in finančna pravila so bila ustrezno spremenjena, upravljanje okvirnega programa in posameznih raziskovalnih projektov pa je bilo racionalizirano.

- Komisija je predlagala poenostavitev strukture programa Erasmus Mundus v njegovi drugi fazi (2009–13). Ukrepanje Skupnosti na področju visokega šolstva v povezavi s tretjimi državami bo postalo bolj usklajeno z racionalizacijo številnih sedanjih programov, katerih upravljanje urejajo različna pravila, čeprav v bistvu zajemajo ista področja. S tem bo ustvarjena enotna vstopna točka za interesne skupine, vključene v akademsko sodelovanje s tretjimi državami in mednarodna mobilnost.

- Komisija je posodobila štiri različna obvestila o različnih vprašanjih pravne pristojnosti in jih nadomestila z enim prečiščenim obvestilom o pravni pristojnosti v skladu z Uredbo ES o združitvah. To je takoj poenostavilo upravno prakso in usmerjanje.

- Uvedba „ elektronskega ribolovnega dnevnika “ v ribištvu je zagotovila v celoti elektronski proces poročanja ribiških podatkov za ribiče in nacionalne uprave.

- Nove uredbe za obdobje 2007–2013 o kohezijski politiki so zmanjšale število skladov in korakov pri načrtovanju programov ter poenostavile finančno poslovodenje in s tem povečale prožnost za lokalne organe, ki upravljajo programe na terenu. Pravila, ki urejajo Kohezijski sklad in strukturni sklad, so bila usklajena, tako da lokalni organi in upravičenci uporabljajo samo en sklop pravil za oba sklada. V istem duhu je ena uredba o izvajanju strukturnih skladov nadomestila 10 izvedbenih uredb.

Nadalje je dokončna vzpostavitev notranjega trga najprimernejši način za izboljšanje poslovnega okolja. Odprava ovir med državami članicami je povečala BDP EU za 223 milijard EUR ali 2,2 % v desetih letih po dokončni vzpostavitvi enotnega trga leta 1993. To ustreza 1 450 EUR dodatnega dohodka na gospodinjstvo. Poleg tega se je zaposlovanje povečalo za 1,4 %, kar pomeni 2,75 milijona delovnih mest. Enotni sklop pravil EU pomeni, da podjetjem ne bo treba več iskati in si razlagati 27 različnih sklopov nacionalnih pravil, prilagajati svoje izdelke ali storitve tem pravilom in potem še dokazati skladnost z njimi. Na primer:

- Komisija je nedavno predlagala spremembo homologacij vozil EU z uvedbo usklajenih pravil za vozila na vodikov pogon, ki omogočajo proizvajalcem, da izkoristijo ekonomijo obsega z večjimi serijami proizvodnje za celoten evropski trg, poleg tega pa potrošnikom EU lahko zagotovijo, da ta inovativna vozila izpolnjujejo visoke varnostne in okoljevarstvene standarde. Prilagajanje sistema homologacij vozil jutrišnjim tehnologijam bo tudi omogočilo, da bo avtomobilska industrija EU z zboljšanjem svoje konkurenčnosti na trgih tretjih držav lahko držala korak s svojimi glavnimi svetovnimi konkurenti.

- Komisija je decembra 2007 predlagala novo direktivo s ciljem odprave ovir za trgovanje z obrambnimi izdelki znotraj Skupnosti . Do sedaj je promet takih proizvodov znotraj notranjega trga oviral cel skupek nacionalnih postopkov, ki niso le podjetjem in javnim organom nalagali upravnega bremena, ki je presegal 430 milijonov EUR na leto, ampak tudi povzročali zelo dolge roke, tudi po več mesecev. To breme je nedvomno nesorazmerno s sedanjimi potrebami nadzora, kar je pokazalo dejstvo, da so bile kljub približno 11 500 izdanim dovoljenjem za prenose znotraj Skupnosti letno v obdobju 2004–2006 zavrnjene samo 3 vloge. Ta predlog bo prispeval k ekonomsko in tehnološko konkurenčnejši evropski obrambni industriji, izboljšanju pogojev za mala in srednje velika podjetja pri vključevanju v razvoj in proizvodnjo oborožitve, omogočil državam članicam, da bodo po nižjih cenah zadovoljile svoje vojaške potrebe v okviru lastnih varnostnih razmer, ter prispeval k povečanju zanesljivosti dobave za javna naročila in industrijskega sodelovanja.

2.6. Instrumenti sporočanja in posvetovanje z interesnimi skupinami

Jasne in pregledne informacije o napredku pri izvajanju programa za poenostavitev so zelo pomembne za zagotavljanje zagona programa. Zato je Komisija vzpostavila spletno stran za poenostavitev[10] za zagotovitev splošnih informacij o strategiji za poenostavitev in da se interesnim skupinam omogoči preverjanje napredka tekočega programa. Poleg tega je v številnih sektorjih (npr. kmetijstvo) posvetovanje s strokovnjaki v sektorju in interesnimi skupinami držav članic organizirano prek sektorskih skupin.

Trdno odločena, da zasidra poenostavitev v praktične izkušnje interesnih skupin, je Komisija jeseni 2007 vzpostavila novo spletno posvetovalno stran, da bi se seznanila s skrbmi in predlogi podjetij glede bremen, ki jim jih nalaga zakonodaja in upravni postopki na splošno. Komisija bo prispevke interesnih skupin čim bolj koristno uporabila. Čeprav so bili prvotno namenjeni za „Akcijski program za zmanjševanje upravnih obremenitev v Evropski uniji“ bodo vsi prispevki, ki obravnavajo širša vprašanja, pomembna za vsebino zakonodaje, upoštevani pri oblikovanju strategije za poenostavitev.

3. KODIFIKACIJSKI PROGRAM

Kodifikacija[11] je ključni element prizadevanj Komisije za zmanjšanje obsega pravnega reda Skupnosti in za njegovo boljšo dostopnost.

Program kodifikacije obsega približno 400 kodificiranih aktov, od katerih je večina zakonodajnih predlogov. Uspešno je bilo kodificiranih 87 aktov, ki so bili sprejeti in objavljeni v UL (62 aktov Komisije ter 25 aktov Evropskega parlamenta in Sveta). Teh 87 aktov nadomešča prejšnjih 348 aktov. Poleg tega 65 aktov čaka na obravnavo pred zakonodajalcem, 4 akte pa bo Komisija sprejela v kratkem. Komisija je tako že dokončala 152 kodifikacijskih aktov.

Za dokončno vzpostavitev kodifikacijskega programa do konca leta 2008 (Priloga 2) so bili sprejeti ukrepi za odpravo zaostankov prevodov v nove jezike EU besedil, ki so v fazi kodificiranja. Zakonodajalec sprejema kodificirane akte v skladu s pravili, določenimi v medinstitucionalnem sporazumu o pospešenem delovnem postopku za uradno kodifikacijo zakonodajnih besedil z dne 20. decembra 1994.

4. MEDINSTITUCIONALNI VIDIKI

4.1. Predlogi, ki čakajo na obravnavo zakonodajalca

Za uspešno poenostavitev so odgovorni vsi tisti, ki so vključeni v postopek odločanja. Zakonodajalec je leta 2007 uspel odpraviti zaostanke predlogov iz programa za poenostavitev za obdobje 2003–2004.

Vendar 44 predlogov iz tekočega programa za obdobje 2005–2009 še vedno čaka na obravnavo pred zakonodajalcem (Priloga 3). Kadar gre za direktive, je treba potem pravila ES prenesti v nacionalno zakonodajo. Zato se lahko zgodi, da bo preteklo še nekaj let, preden bodo državljani in podjetja lahko uživali (in občutili) koristi poenostavitve.

Komisija je zato spodbudila druge institucije, da sprejmejo predloge za poenostavitev z najkrajšimi možnimi roki.

4.2. Poenostavitev in druge institucije

V okviru lizbonske strategije za rast in delovna mesta Svet za konkurenčnost spremlja izvajanje načrta za boljšo pravno ureditev in poročilo o napredku na koncu vsakega predsedovanja, z navedbo med drugim tudi napredka tekočega programa za poenostavitev. Medtem ko Komisija pozdravlja stalen interes Sveta za boljšo pravno ureditev na splošno in zlasti poenostavitev, opaža, da se delovne metode Sveta za preučitev predlogov za poenostavitev še niso bistveno spremenile, kljub zavezi v medinstitucionalnem sporazumu o boljšem oblikovanju zakonodaje.

V svoji resoluciji o strategiji za poenostavitev zakonodajnega okolja[12] je Evropski parlament pozdravil kodifikacijski program Komisije in se strinja, da je treba program z poenostavitev spodbuditi in podpreti z ustreznimi nacionalnimi pobudami za poenostavitev. Parlament tudi poziva vse tri institucije, da sklenejo medinstitucionalni sporazum o pospešenem delovnem postopku za ukrepe za poenostavitev . Komisija ceni konstruktivno podporo Parlamenta in že sprejeti ukrep za izvajanje načrta za boljšo pravno ureditev. Komisija zlasti pozdravlja spremembo notranjih postopkov Parlamenta za preverjanje kodifikacije in predlogov za preoblikovanje, ki razjasnjuje razdelitev odgovornosti med odbori in preprečuje, da bi bili kodificirani deli po nepotrebnem spremenjeni glede vsebine.

Komisija zato spodbuja Svet in Parlament, da zagotovita hitri sprejem svojih predlogov za poenostavitev, in da se vsebina poenostavitve med postopkom obdrži.

4.3. Sodelovanje z Evropskim ekonomsko-socialnim odborom in Odborom regij

Komisija je skušala bolje organizirati anketiranje organizirane civilne družbe glede kakovosti pravne ureditve pravnega reda Skupnosti.

Na zahtevo Komisije je Evropski ekonomsko-socialni odbor septembra 2007 izdal svoje mnenje o obsegu poenostavitve zakonodajnega okvira v strojnem sektorju. Ta bi morala zajeti pravila, ki so posebna za sektor, in širšo zakonodajo, ki zadeva stroje, na primer v zvezi z zdravjem, varnostjo in varstvom okolja. Komisija namerava nadaljevati to sodelovanje in je na Odbor že naslovila podobne zahteve, da bi pridobila nadaljnja poročila o drugih ključnih sektorjih, kot so gradbeni sektor in poslovne storitve.

Komisija tudi pozdravlja poročilo o boljši pravni ureditvi, ki ga je oktobra 2007 sprejel Odbor regij[13].

5. SKLEPI / ZAKLJUčNE OPOMBE

Skrajšanje upravnih postopkov je zdaj trdno zasidrano v političnem načrtu Komisije. Prav tako kakor druge komponente načrta za boljši pravni red, ki ga je pripravil Komisija ob začetku svojega mandata, je strategija za poenostavitev dosegla ustaljeno hitrost, njene koristi pa se že občutijo. Komisija bo končala pregled približno 95 000 strani pravnega reda Skupnosti, da bo določila možna področja, na katera bi se lahko osredotočile dejavnosti poenostavitve, in vključila rezultate v posodobljeni tekoči program za poenostavitev, ki bo predstavljen v začetku leta 2009. Komisija je odločena izpeljati do konca sedanji tekoči program in kolikor je mogoče poenostaviti, oklestiti in posodobiti pravni red Skupnosti. Metoda je bila uporabljena v praksi in je dala dobre rezultate.

Vendar je jasno, da zakonodajnega okvira ne more izboljšati Komisija sama. Bolj kot kdaj koli je bistvenega pomena resnična, usklajena in odločna zaveza na vseh zakonodajnih ravneh za prenos želenih političnih namer v otipljive rezultate in zagotovitev, da bodo izpolnjena dejanska pričakovanja državljanov in podjetij. Evropski parlament in Svet si na svoji strani delita institucionalno odgovornost, da predloge Komisije privedeta do končne faze sprejetja. Do danes je ne glede na priznana prizadevanja sprejetih manj kot četrtina vseh predlogov za poenostavitev, ki jih je predložila Komisija in jih mora sprejeti zakonodajalec. Očitno je nujno, da se bistvo poenostavitve teh predlogov ohrani med postopkom odločanja.

Nacionalni, regionalni in lokalni organi, katerih naloga je prenesti in izvajati zakonodajo EU, si morajo prizadevati, da na isti način dokončajo delo, opravljeno v Bruslju. Prepogosto pozni prenosi ali pa pretiravanje pokvarijo učinek poenostavitve pravil EU. Pričakuje se, da bo do sedaj opravljeno delo za ugotavljanje in ocenitev upravnega bremena na nekaterih področjih politike dalo zanimive rezultate v tem pogledu. V skladu s svojim nedavnim sporočilom „Evropa rezultatov – uporaba prava Skupnosti“ bo Komisija okrepila svoja prizadevanja za preprečevanje kršitev prava ES z izboljšanjem kakovosti pomoči, ki jo nudi državam članicam za olajšanje pravilnega prenosa in uporabe direktiv.

Ker se večina zakonodajnega okolja ne oblikuje na ravni Skupnosti, je treba programe za poenostavitev razviti ali pa izboljšati na nacionalni (in po potrebi na regionalni) ravni, da bi se zmanjšale gore papirja, ki nastajajo neodvisno od zakonodaje EU. V prihodnosti bo Komisija dala več poudarka temu vidiku, kadar bo preučevala nacionalne programe za reformo, predložene v okviru programa lizbonske strategije.

89 | Eco-label award scheme: revision of Regulation (EC) No 1980/2000 of the European Parliament and of the Council of 17 July 2000 on a revised Community eco-label award scheme | Revision | The revision aims at enhancing effectiveness and market impact by increasing the range of eligible product groups and the number of eco-labelled goods and services actually available to the consumer. For this purpose, the procedure of developing and adopting eco-label criteria will be thoroughly changed and simplified. Economic stakeholders will be involved to a greater extent into the process, thereby increasing ownership and self-regulatory aspects of the scheme, whereas the administrative burden put on Member States will be reduced. Once the criteria are adopted, it will be easy for economic operators to apply for the award of the eco-label to their products. 93 | Ozone layer: revision of Regulation (EC) No 2037/2000 on substances that deplete the ozone layer | Recast | As the production and consumption of the substances covered have been reduced or phased out, many provisions of the Regulation, after seven years in force, need to be repealed or updated. Other provisions may benefit from simplification such as clarification of definitions and procedures and interaction with other pieces of legislation. This will reduce the cases of ambiguous interpretation and the risk of infringements and consequent administrative burdens. In particular, most of the administrative cost reduction will result from ending exemption provisions on some uses of ozone depleting substances. The beneficiaries will be the Member States and the Commission. Overall, the cost savings from ending the exemptions is expected to exceed any additional cost associated with new control measures to combat illegal trade of ozone depleting substances. |

Any presence of prohibited constituents of animal origin in feed is considered as a breach of the feed ban i.e. the zero-tolerance. The recasting of the Directive is part of package on the Strategic Energy Review and included in the Energy Efficiency Action Plan. The amendments will cover some articles of the Directive and add new ones. The "simplification" will consist of using the "recasting" technique to facilitate reading and comprehension for the implementing authorities and for the many stakeholders affected. | X |

Modernise the Marine Equipment Directive 96/98/EC | Recast or Revision | The objective is to modernise and reform the existing system established by Council Directive 96/98/EC on marine equipment. Its main objectives are: 1) to produce a consolidated version of the text following the successive amendments of the Directive 2) to improve the functioning of the Directive's system by addressing the existing shortcomings ; 3) to adapt it to the reform of the New Approach. It is intended to abrogate the existing Directive and replace it with an entirely new one, while recourse to recast is not excluded. Furthermore, the adaptation of the directive to the new regulatory framework for the free movement of goods (revision of the new approach) is expected to improve the readability of this instrument and reduce the administrative burden on the industry.
