It-tieni rapport ta’ progress dwar l-istrateġija għas-simplifikazzjoni ta' l-ambjent regolatorju

1. DAĦLA

Mibdija f’Ottubru 2005, l-istrateġija għas-simplifikazzjoni ta' l-ambjent regolatorju[1] stabbiliet programm kontinwu ta’ miżuri ta’ simplifikazzjoni li għandhom jiġu adottati bejn l-2005 u l-2008 bl-għan li ttejjeb il-kwalità u l-effikaċja ta’ l-acquis filwaqt li żżomm l-għanijiet ta’ politika ewlenin tagħha.

It-tieni rapport ta’ progress, li jikkumplimenta l-Komunikazzjoni dwar “ It-tieni reviżjoni strateġika dwar Regolamentazzjoni Aħjar fl-Unjoni Ewropea ”[2], jiddeskrivi f’termini kwalitattivi kif ukoll kwantitattivi r-riżultati miksuba diġà, iħejji t-triq ’il quddiem għal-leġiżlatura ta’ l-UE u jimmira li jagħti spinta ġdida lill-istrateġija ta' simplifikazzjoni li hija element essenzjali tal-Politika globali għal Regolamentazzjoni Aħjar u l-Istrateġija għat-Tkabbir u l-Impjiegi ta' l-Unjoni Ewropea.

Dan ir-rapport juri wkoll li l-Kummissjoni qed twettaq b’mod effettiv l-impenji tagħha skond il-programm kontinwu.

Iċ-ċittadini u l-kumpaniji diġà raw riżultati tanġibbli u se jaraw aktar hekk kif jiġi adottat l-għadd kbir ta’ inizjattivi li bħalissa hemm pendenti quddiem il-leġiżlatura. L-isforz qed ikun iffokat fuq proġetti li jġibu magħhom benefiċċji sinifikanti għall-partijiet interessati, bħal impriżi żgħar u ta' daqs medju (IŻM) jew intraprendituri individwali, li ħafna drabi jħabbtu wiċċhom ma’ talbiet regolatorji sproporzjonati.

Il-Kummissjoni se tlesti proċess sħiħ ta’ eżami ta’ l-acquis Komunitarju, filwaqt li tiċċekkja jekk għadhomx meħtieġa l-istrumenti eżistenti, li jintuża l-istil regolatorju tajjeb u li kull piż impost ikun ħafif kif hu kompatibbli mar-riżultati ta’ politika mixtieqa. Dan il-proċess se jidentifika wkoll inizjattivi ġodda għal inklużjoni fil-programm kontinwu ta’ simplifikazzjoni aġġornat li għandhom jiġu ppreżentati fil-bidu ta’ l-2009. Biex tassew issir differenza, dan il-momentum irid jissokta anki fil-leġiżlatura li jmiss.

Fl-istess waqt, kull meta jinstab mod li jħaffef il-ħajja għan-negozji mingħajr ma jaffettwa l-għanijiet ta' politika sottostanti jew jipproponi bidliet sinifikanti oħra għall-qafas regolatorju, il-Kummissjoni se tagħmel użu mill-hekk imsejjaħ mekkaniżmu ta’ azzjonijiet mgħaġġla[3] li jgħin biex jitnaqqas il-piż amministrattiv fl-UE b’25 %[4] kif inhi l-mira sa l-2012. L-eżerċizzju ewlieni mniedi mill-Kummissjoni biex 'tħejji u tkejjel’ il-piż amministrattiv f’oqsma prijoritarji jista’ wkoll jagħti spinta lill-programm ta' simplifikazzjoni.

2. IL-QAGħDA PREżENTI TAL-PROGRAMM KURRENTI TA’ SIMPLIFIKAZZJONI

2.1. Ħarsa ġenerali

L-istrateġija ta’ simplifikazzjoni ta’ Ottubru 2005 identifikat sensiela inizjali ta’ madwar 100 inizjattiva għall-programm kontinwu ta’ l-2005 sa l-2008. F’Novembru 2006 ġew miżjuda 43 inizjattiva ġdida[5] u 16 oħra f’Ottubru 2007[6], u dan wessa’ l-ambitu ta’ l-eżerċizzju ta’ simplifikazzjoni għall-oqsma kollha ta’ politika u estenda l-iskeda ta’ żmien sa l-2009. Il-programm juża tekniki leġiżlattivi bħalma huma r-revoka, il-kodifikazzjoni u l-abbozzar ġdid[7].

L-implimentazzjoni tal-programm kontinwu fil-biċċa l-kbira tiegħu qiegħed iżomm ma' l-iskeda. Sa issa, il-Kummissjoni adottat aktar min-nofs tal-programm aġġornat ta' l-2005-2009.

Mill-inizjattivi skedati għall-adozzjoni fl-2007, 80 % tal-programm twettaq mill-Kummissjoni.

Sa issa, il-Kummissjoni adottat 91 proposta li jikkonsistu f’24 hekk imsejħa atti awtonomi adottati permezz ta’ proċedura ta’ komitoloġija, 16 adottati mil-leġiżlatura, 44 għadhom pendenti quddiem il-leġiżlatura u sebgħa li huma jew reviżjonijiet fejn ma kienitx meħtieġa azzjoni leġiżlattiva, jew inizjattivi amalgamati.

B’mod ġenerali, sa minn Ottubru 2005, il-Kummissjoni diġà ppreżentat madwar 400 att legali għal revoka, modifika jew sostituzzjoni. B’riżultat ta’ dan, madwar 300 att legali li jirrappreżentaw madwar 5 000 paġna tal-Ġurnal Uffiċjali se jitħassru mill-ktieb ta’ l-istatut tal-Komunità. Barra minn hekk, minn mindu l-Kummissjoni ħadet il-ħatra, hi ħadet azzjoni jew ipproponiet it-tneħħija ta’ 2 500 att skadut mill- acquis.

2.2. Leġiżlazzjoni diġà adottata

L-implimentazzjoni ta’ l-istrateġija għas-simplifikazzjoni ta’ l-ambjent regolatorju diġà ġabet magħha benefiċċji reali għan-negozji u ċ-ċittadini.

2.2.1. Atti adottati mill-Kummissjoni

Sa issa, ġew adottati 24 inizjattiva ta’ simplifikazzjoni bħala atti awtonomi tal-Kummissjoni permezz tal-proċedura ta’ komitoloġija (l-Anness 4). Per eżempju:

- Fl-2005, il-Kummissjoni adottat regolament li jelenka l-ħlasijiet imnaqqsa u jintroduċi skema ta’ għajnuna amministrattiva għall-IŻM li jirreġistraw il- farmaċewtiċi Dan jipprovdi għall-IŻM tnaqqis ta’ 90 % fil-ħlasijiet għal parir xjentifiku, ħlasijiet imnaqqsa għall-IŻM meta japplikaw għal awtorizzazzjonijiet ta’ tqegħid fis-suq u l-għoti ta’ għajnuna regolatorja għall-IŻM. Diġà qed isir użu estensiv minn dawn il-possibbiltajiet mill-IŻM attivi f’dan il-kamp.

- Ir-regoli li jikkonċernaw il- prova ta' importazzjoni f'pajjiżi terzi (b'rabta ma' rifużjonijiet ta' l-esportazzjoni differenzjati għal ċerti prodotti agrikoli) ġew emendati biex jippermettu lill-esportaturi japplikaw għal rifużjonijiet biex jużaw l-informazzjoni kompjuterizzata dwar il-monitoraġġ u l-intraċċar tal-kontejner tat-trasportatur bħala alternattiva għad-dokumenti doganali normali (li huma diffiċli biex jinkisbu f’ċerti pajjiżi).

- Il-Kummissjoni diġà adottat Rakkomandazzjoni dwar swieq tal-komunikazzjonijiet elettroniċi li tiffoka r-regolamentazzjoni fuq il-livell tal-bejgħ bl-ingrossa u naqqset in-numru ta’ swieq li huma suxxettibbli għal regolamentazzjoni ex ante minn 18 għal 7. B’riżultat ta’ dan, huwa stmat li l-ispejjeż amminsitrattivi qegħdin jitnaqqsu b'madwar 25-30 % għal operaturi ta’ netwerks fissi u b’madwar 30-40 % għal awtoritajiet regolatorji nazzjonali (ARN). Il-proċeduri semplifikati ta’ reviżjoni tas-swieq se jġibu magħhom ukoll tfaddil addizzjonali għall-ARN.

2.2.2. Atti adottati mil-leġiżlatura

Il-biċċa l-kbira tal-programm tiddependi għall-adozzjoni tagħha fuq il-leġiżlatura, tipikament skond il-proċedura ta’ kodeċiżjoni. Sa llum, 16-il inizjattiva ta’ simplifikazzjoni fil-programm kontinwu ta’ l-2005-2009 ġew adottati (l-Anness 5), per eżempju:

- Fil-qasam ta’ l-agrikoltura, il-leġiżlatura adottat l-abbozzar tal- 21 Organizzazzjoni ta’ Suq Komuni fi skema waħdanija biex tarmonizza u tissimplifika l-Politika Agrikola Komuni għall-benefiċċju komuni tal-bdiewa, l-amministrazzjonijiet u l-kumpaniji li jimmaniġġjaw il-prodotti agrikoli. Il-ħolqien ta’ OSK waħdanija se jqassar il-leġiżlazzjoni fis-settur tal-biedja, itejjeb it-trasparenza tagħha u jagħmel il-politika iktar aċċessibbli. Dan jimplika r-revoka ta’ kważi 50 att tal-Kunsill u jibdel aktar minn 650 artikolu legali fir-regolamenti attwali b’madwar 200 li joħolqu ambjent regolatorju globali ħafna aktar sempliċi mingħajr ma jbiddlu l-politiki sottostanti.

- Id-direttiva dwar ir-rimedji fl- akkwist pubbliku. Fl-2003, dan is-settur kien stmat għal € 1 500 biljun, li jammonta għal 16.3 % tal-PGD ta’ l-UE15. Id-direttiva l-ġdida ttejjeb il-proċeduri ta’ reviżjoni nazzjonali li n-negozji jistgħu jużaw jekk iqisu li awtorità pubblika tat kuntratt b'mod inġust. B'mod partikolari, id-direttiva tintroduċi perjodu ta’ waqfien obbligatorju bejn in-notifika tad-deċiżjoni ta’ l-għoti u l-iffirmar tal-kuntratt, biex dawk li jitfgħu l-offerta jkollhom ċans jeżaminaw id-deċiżjoni u jevalwaw jekk għandhomx jibdew proċedura ta’ reviżjoni. Id-Direttiva tinkludi regoli supplimentari maħsuba biex jiżguraw l-effikaċja. L-introduzzjoni ta’ dawn id-drittijiet u l-mekkaniżmi ġodda għal dawk li l-offerta tagħhom ma tintlaqax fis-27 Stat Membru hija kruċjali biex jiġi żgurat li l-kuntratti finalment jingħataw lill-kumpanija li għamlet l-aħjar offerta, u għalhekk biex tinħoloq fiduċja fost in-negozji u l-pubbliku li l-proċeduri ta’ akkwist pubbliku huma ġusti. Il-miżuri ta’ simplifikazzjoni jinkludu r-revoka ta' mekkaniżmi eżistenti ta' konċiljazzjoni u attestazzjoni li għalihom in-negozji ma esprimew l-ebda interess reali u li bħalissa mhumiex użati.

- Id-direttiva dwar is- servizzi ta’ ħlas tikkontribwixxi għall-ħolqien ta’ "Żona Unika ta’ Pagamenti" fl-UE li tista’ tiffranka lill-ekonomija ta’ l-UE sa € 28 biljun kull sena. L-għan hu li l-ħlasijiet elettroniċi fl-UE – b’karta ta’ kreditu, karta ta’ debitu, trasferiment ta’ kreditu, debitu dirett jew mezzi oħrajn – isiru faċli, orħos u sikuri bħalma huma l-ħlasijiet ‘domestiċi’ fi Stat Membru llum il-ġurnata. Id-direttiva tiggarantixxi aċċess ġust u miftuħ għas-swieq tal-pagamenti u żżid u tistandardizza l-ħarsien tal-konsumatur. Il-benefiċċji ta’ simplifikazzjoni joriġinaw mill-armonizzazzjoni tar-rekwiżiti ta’ aċċess għas-suq, mill-ġlieda kontra l-effett ta’ frammentazzjoni li jirriżulta mid-diverġenza tar-regoli nazzjonali u ta’ l-UE dwar ir-rekwiżiti tat-tagħrif u mill-armonizzazzjoni tad-drittijiet u l-obbligi bażiċi ta' l-utenti u l-fornituri fl-interess taċ-ċertezza u l-effiċjenza. Suq tal-pagamenti aktar effiċjenti u kompetittiv ifisser ukoll li l-Ewropej iħallsu anqas għal servizzi bankarji bażiċi, li l-ispiża medja annwali tagħhom tvarja minn € 34 sa € 252 fl-UE kollha.

- Ir-revoka ta’ ħafna mir-rekwiżiti eżistenti ta' qabel l-ippakkjar neħħiet ir-regoli nazzjonali u Komunitarji għal madwar 70 prodott tal-konsumatur. In-negozji issa għandhom aktar flessibbiltà biex iwieġbu għall-ħtiġijiet tal-konsumatur;

- Fil-qasam tad- dwana , il-leġiżlatur adotta d-deċiżjoni e-Customs (dwana elettronika) li se toħloq sistema elettronika Ewropea għall-iskambju ta’ data bejn l-awtoritajiet pubbliċi u l-kumpaniji. Il-proċeduri doganali armonizzati li jużaw sistemi doganali awtomatizzati u konnessi bejniethom se jagħtu spinta lill-kummerċ internazzjonali. Meta taħdem b’mod sħiħ, is-sistema integrata għandha tiffranka lin-negozji € 2.5 biljun fis-sena, aktar mill-ħlas ta’ l-investiment ta’ € 40 – 50 miljun kull sena li jsir mill-Kummissjoni u mill-Istati Membri. • Huwa previst li l-Kodiċi Doganali modernizzat, li se jirrevedi l-leġiżlazzjoni doganali Komunitarja, se jiġi adottat fl-2008.

2.3. Proposti pendenti quddiem il-leġiżlatura

Madwar 44 proposta ta’ simplifikazzjoni bħalissa jinsabu pendenti quddiem il-leġiżlatura. Dawn jinkludu għadd ta’ proposti importanti li l-adozzjoni tagħhom se tgħin biex tissimplifika l-ambjent regolatorju, per eżempju:

- Ir-reviżjoni innovattiva tal-liġi ta’ l-assigurazzjoni ta’ l-UE ( Solvency II ) se ttejjeb il-ħarsien tat-titolari tal-polza fl-UE kollha permezz ta’ rekwiżiti ta’ solvenza sensittivi għar-riskju għal impriżi ta’ assigurazzjoni. Solvency II se jippromwovi ġestjoni aħjar tar-riskju, ipprezzar sod u superviżjoni msaħħa, u b’hekk isaħħaħ il-fiduċja tal-konsumatur. Se jżid ukoll il-kompetizzjoni (speċjalment għal negozji involuti fil-bejgħ bl-imnut fil-kobor bħall-assigurazzjoni ta' vetturi u djar), inaqqas uħud mill-prezzijiet ta' l-assigurazzjoni, iħeġġeġ l-innovazzjoni tal-prodott u jtejjeb il-kompetittività internazzjonali ta’ l-assiguraturi Ewropej. Fl-aħħarnett, l-ambjent regolatorju se jkun aktar trasparenti u faċli għall-utent b’direttiva waħda li tissostitwixxi t-taħlita ta’ regoli atttwali li jinsabu f’14-il direttiva differenti.

- Il- kodiċi ta’ kondotta għal sistemi ta’ prenotazzjoni kompjuterizzata ġie żviluppat għal suq li evolva b’mod sinifikanti mat-tneħħija tal-linji ta’ l-ajru u ż-żieda fil-prenotazzjonijiet bl-internet u issa huwa l-waqt li jintroduċi aktar kompetizzjoni. Il-Kummissjoni tipproponi li jingħata aktar spazju lill-forzi tas-suq biex jingħelbu l-prezzijiet ta' prenotazzjoni ogħla milli meħtieġ, imħallsa mil-linji ta' l-ajru u mill-passiġġieri. Iż-żieda fil-kompetizzjoni se ttejjeb il-kwalità tas-servizzi offruti u tnaqqas l-ispejjeż ta’ distribuzzjoni fis-settur tat-trasport bl-ajru: il-prezzijiet ta’ prenotazzjoni għal kull segment ta’ vjaġġ huma mistennija li jsiru bejn € 0.7 sa € 0.9 orħos, u b’hekk l-ispejjeż totali jitnaqqsu b’€ 190-240 miljun fis-sena;

- L-għan tat-tibdil fir-regoli li jirregolaw in-netwerks u s-servizzi ta’ komunikazzjonijiet elettroniċi huwa li jiżgura kompetizzjoni effettiva, jippromwovi l-investiment, jikkonsolida s-suq intern u jsaħħaħ l-interessi tal-konsumatur. It-tnaqqis sostanzjali tar-regolamentazzjoni huwa appoġġjat meta jkun hemm tendenza ċara lejn il-kompetizzjoni. Studju indipendenti ta' l-ispejjeż u l-benefiċċji ta' l-Awtorità tas-Suq tal-Komunikazzjonijiet Elettroniċi jistima benefiċċji ekonomiċi potenzjali li huma 10-30 darba aktar l-ispejjeż operattivi tagħha (jiġifieri € 250 – 800 miljun) minħabba n-nuqqas ta’ inċertezza regolatorja u r-riżoluzzjoni aktar rapida tal-każijiet. Għall-fornituri tas-servizz li jiddependu fuq l-ispektrum, ir-reviżjoni tintroduċi aktar flessibbiltà, tnaqqas l-ispiża ta’ l-attivitajiet tan-negozju u tneħħi l-ostakoli għad-dħul ta’ parteċipanti ġodda. B’riżultat ta’ dan, il-konsumaturi se jaraw għażla aħjar u prezzijiet aktar baxxi għal dawn is-servizzi;

- Id-Direttiva ġdida dwar it-trasport fuq l-art ta’ merkanzija perikoluża se tgħaqqad flimkien it-tliet mezzi kollha ta’ trasport ta' l-art (permezz tat-triq, il-ferrovija u l-passaġġi ta' l-ilma interni) f’biċċa waħda ta’ leġiżlazzjoni. Il-proposta fiha dispożizzjonijiet uniformi għat-tlieta li huma (fejn ikun possibbli) u tirrevoka d-dispożizzjonijiet skaduti. B’mod partikolari, żewġ direttivi dwar konsulenti ta’ sikurezza fuq merkanzija perikoluża u erba’ deċiżjonijiet dwar derogi nazzjonali se jiġu revokati. Ir-riżultat se jkun test trasparenti u faċli għall-utent, li se jnaqqas il-volum ta’ l- acquis b’madwar 2 000 paġna;

- Ir-reviżjoni tad-direttiva dwar il- ġugarelli se taġġorna r-rekwiżiti ta’ sikurezza u tevita l-effetti ta’ ħsara fuq it-tfal għaż-żmien medju u fit-tul, u fl-istess waqt ittejjeb it-tħaddim tas-swieq interni għall-ġugarelli. Bħala għan primarju r-reviżjoni timmira li timmodernizza r-rekwiżiti ta’ sikurezza tal-ġugarelli fir-rigward tal-karatteristiċi kimiċi, fiżiċi u mekkaniċi tagħhom. Din se tqis l-aħħar għarfien xjentifiku biex tiżgura li fis-suq ta' l-UE jkun hemm disponibbli ġugarelli sikuri biss. Barra minn hekk, il-mod kif id-direttiva hija infurzata fi ħdan l-Istati Membri se tkun imtejba u se jissaħħu l-obbligi għall-Istati Membri li jwettqu sorveljanza tas-suq xierqa u effettiva.

2.4. Inizjattivi li qed tħejji l-Kummissjoni (2008-2009)

L-isforzi tal-Kummissjoni se jiġu intensifikati matul is-sentejn li ġejjin. Il-programm aġġornat ta' l-2008-2009 (Anness 1) jikkonsisti f'45 inizjattiva għall-2008 u 9 inizjattivi għall-2009. Eżempji ta’ l-inizjattivi ta’ simplifikazzjoni li jmiss jinkludu::

- Ir- reviżjoni ta’ l- acquis dwar il-liġi tal-kumpaniji, il-kontabbiltà u l-verifika se tneħħi jew tnaqqas firxa ta’ rekwiżiti amministrattivi li issa jitqiesu skaduti, eċċessivi jew duplikati. Se tneħħi ċerti rekwiżiti tat-tagħrif mid-Direttivi dwar il-liġi tal-Kumpaniji, tissimplifika r-rekwiżiti ta' żvelar għall-kumpaniji u tippermetti lill-Istati Membri li jkomplu jnaqqsu r-rekwiżiti ta’ rrappurtar u verifika għall-IŻM;

- Ir- reviżjoni tar-Regolament ta’ Eżenzjoni Ġenerali Sħiħa (REĠS) se tiġbor f’dokument wieħed id-dispożizzjonijiet kollha li jikkonċernaw l-għajnuniet mill-istat eżenti mill-obbligu li jinnotifikaw, u b’hekk inaqqsu l-piż amministrattiv għall-benefiċjarji, l-Istati Membri u l-Kummissjoni. Ir-REĠS ġdid se jiġbor fih oqsma li diġà huma koperti minn eżenzjonijiet sħaħ fuq taħriġ, impjiegi u IŻM kif ukoll oqsma ġodda bħall-ambjent, il-kapital ta’ riskju u l-għajnuna reġjonali. Se jtejjeb ukoll b'mod konsiderevoli l-aċċess ta’ l-IŻM għal programmi ta’ għajnuna mill-istat, per eżempju l-“bonus ta’ l-IŻM” flimkien ma’ l-għajnuna bażika normalment applikabbli għall-investiment u l-impjiegi se jiġi armonizzat u jiżdied minn 15 % għal 20 % għal intrapriżi żgħar u minn 7.5 % sa 10 % għal dawk ta’ daqs medju;

- Ir- reviżjoni ta’ l-Intrastat se tnaqqas il-piż impost fuq in-negozji mis-sistema ta’ ġbir ta’ data għall-istatistika Komunitarja marbuta mal-kummerċ ta’ merkanzija bejn l-Istati Membri. Il-Kummissjoni se tipproponi fi żmien qasir is-simplifikazzjoni ulterjuri ta’ l-iskema fuq linji tradizzjonali billi jitnaqqas l-għadd ta’ intestaturi ta’ nomenklatura u billi jiżdiedu l-livelli biex jiġi eżentat għadd kbir ta' intrapriżi. Huwa stmat li sa 190 000 intrapriża jistgħu jiġu eżentati mill-obbligu li jirrapportaw l-istatistika. Fl-istess waqt, il-Kummissjoni se tinvestiga għażliet oħra fit-tul inkluża bidla possibbli għal sistema ta' rappurtar b'direzzjoni waħda[8];

- Ir-regolament li jmiss dwar fatturi avvanzati ta’ sikurezza u tajers se jbiddlu madwar 50 direttiva separata b’regolament uniku. Dan se jħaffef sostanzjalment il-piż fuq l-Istati Membri, li ma għandhomx aktar għalfejn jittrasponu r-regoli tal-KE f’dan il-qasam. Barra minn hekk, ir-referenzi diretti għal Regolamenti ta’ l-UNECE se jħaffu konsiderevolment l-allinjament tal-liġi ta’ l-UE mar-regoli ta’ l-UNECE, u b’hekk jippermettu lill-industrija tadatta ruħha aktar malajr għall-iżviluppi tekniċi fil-livell internazzjonali;

- Ir-reviżjoni tad-direttiva dwar Skart ta’ Tagħmir Elettriku u Elettroniku (WEEE) u d-direttiva li tirrestrinġi l-użu ta’ ċerti sustanzi perikolużi fit-tagħmir elettriku u elettroniku (RoHS) se jiċċaraw il-kunċetti, jiffaċilitaw l-implimentazzjoni u l-infurzar tagħhom, inaqqsu l-ispejjeż amministrattivi għal fabbrikanti u amministraturi kif ukoll jipprovdu lill-operaturi b’kundizzjonijiet ugwali aktar trasparenti;

- Il-proposta għal Direttiva ta’ qafas dwar id- drittijiet tal-konsumatur se tipprovdi definizzjonijiet komuni u tirregola d-drittijiet kuntrattwali u rimedji għall-konsumaturi. Billi tagħmel il-qafas regolatorju aktar sempliċi u ċar għan-negozji u l-konsumaturi, din se tikkontribwixxi għat-tħaddim tas-suq intern u l-fiduċja tal-konsumatur;

- L-immodernizzar u l-abbozzar tas-sistema ta’ kontroll tal- Politika Komuni tas-Sajd (PKS) se jtaffu r-restrizzjonijiet għas-settur u jżidu l-użu ta' l-għodda ta' l-IT biex inaqqsu l-obbligi ta' rappurtar.

L-inizjattivi ta’ simplifikazzjoni li huma partikolarment rilevanti għall-IŻM se jiġu wkoll enfasizzati fl-“ Att dwar in-Negozji ż-Żgħar għall-Ewropa ”, li għandu jitnieda fl-2008.

2.5. Simplifikazzjoni lil hinn mill-programm kontinwu

Is-simplifikazzjoni ma tieqafx bil-programmi ffokati bħall-programm kontinwu ta’ simplifikazzjoni, il-programm għat-tnaqqis ta’ piżijiet amminsitrattivi u l-programm ta’ kodifikazzjoni. L-istess imperattiv ta’ sempliċità għandu japplika f'kull livell tal-proposti leġiżlattivi kollha, kif ukoll għall-proċeduri operattivi. Per eżempju:

- Fil-kamp tar-riċerka - kontributur ewlieni għall-istrateġija ta’ Liżbona – ġew proposti wkoll miżuri konkreti[9] biex jiġi ssimplifikat is- seba' programm ta' qafas għar-riċerka, l-iżvilupp teknoloġiku u l-attivitajiet ta' dimostrazzjoni . Ir-regoli amministrattivi u finanzjarji ġew emendati kif xieraq u l-ġestjoni tal-Programm ta’ Qafas tal-proġetti ta’ riċerka individwali ġiet armonizzata;

- Il-Kummissjoni pproponiet li tissimplifika l-istruttura tal-programm Erasmus Mundus matul it-tieni fażi tagħha (2009-13). L-azzjoni Komunitarja fil-kamp ta’ l-edukazzjoni ogħla marbuta ma’ pajjiżi terzi se ssir aktar koerenti bl-armonizzazzjoni ta’ firxa wiesgħa ta’ programmi eżistenti, li bħalissa qed jitmexxew skond regoli differenti minkejja li jkopru essenzjalment l-istess oqsma. Dan se joħloq punt ta’ aċċess uniku għall-partijiet interessati involuti f’kooperazzjoni akkademika ma’ pajjiżi terzi u f’mobilità internazzjonali;

- Il-Kummissjoni ssostitwiet u aġġornat erba’ avviżi distinti dwar mistoqsijiet ġurisdizzjonali differenti f’ Avviż Ġurisdizzjonali Konsolidat uniku skond ir-Regolament tal-KE dwar l-Għaqdiet. Hi ssimplifikat minnufih il-prassi u l-gwida amministrattiva;

- L-introduzzjoni ta’ "ġurnal elettroniku" għas-sajd wasslet biex jitneħħew il-karti fil-proċess kollu ta’ rappurtar ta’ data dwar is-sajd għas-sajjieda u l-amministrazzjonijiet nazzjonali;

- Ir-regolamenti ġodda għall-politika ta’ koeżjoni għall-2007-2013 naqqsu l-għadd ta’ fondi u l-istadji ta’ pprogrammar u ssimplifikaw il-ġestjoni finanzjarja u b’hekk kabbru l-flessibbiltà għall-awtoritajiet lokali li jmexxu l-programmi fil-prattika. Ir-regoli li jirregolaw il-Fond ta’ Koeżjoni u l-Fond Strutturali ġew armonizzati biex l-awtoritajiet lokali u l-benefiċjarji jkollhom ġabra waħda biss ta' regoli x'japplikaw għaż-żewġ Fondi. Fl-istess spirtu, regolament wieħed ġdid tal-Kummissjoni li jimplimenta l-Fondi Strutturali ħa post 10 regolamenti ta' implimentazzjoni.

Barra minn hekk, it-tlestija tas-Suq Intern tibqa' wieħed mill-aktar mezzi b'saħħithom biex jitjieb l-ambjent tan-negozju. It-tneħħija ta’ l-ostakli bejn l-Istati Membri tat spinta lill-PGD ta’ l-UE b’€ 223 biljun jew bi 2.2 % fl-għaxar snin wara t-tlestija tal-pakkett dwar is-Suq Waħdieni fl-1993. Dan jammonta għal € 1 450 ta’ dħul iżjed għal kull familja. Barra minn hekk, l-impjiegi żdiedu b’1.4 % filwaqt li nħolqu 2.75 miljun impjieg ġdid. Ġabra unika ta’ regoli ta’ l-UE tfisser li n-negozji ma jkollhomx bżonn ifittxu u jiddeċifraw 27 ġabra differenti ta' regoli nazzjonali, jadattaw il-prodotti jew is-servizzi tagħhom għalihom u mbagħad juru l-konformità magħhom. Per eżempju:

- Dan l-aħħar il-Kummissjoni pproponiet li timmodifika l- approvazzjonijiet tat-tip tal-vetturi ta’ l-UE billi tintroduċi regoli armonizzati għal vetturi li jaħdmu bl-idroġenu, filwaqt li tippermetti lill-fabbrikanti jiksbu ekonomiji ta' skala minn serje akbar ta’ produzzjoni għas-suq Ewropew kollu, u tiggarantixxi lill-konsumaturi ta’ l-UE li dawn il-vetturi innovattivi se jissodisfaw standards għoljin ta’ sikurezza u ħarsien ambjentali. L-adattament tas-sistema ta’ l-approvazzjoni tat-tip għat-teknoloġiji ta’ għada se jippermetti wkoll lill-industrija tal-karozzi ta' l-UE żżomm il-pass mal-kompetituri globali ewlenin tagħha, filwaqt li ttejjeb il-kompetittività tagħha fis-swieq ta’ pajjiżi terzi.

- F’Diċembru 2007, il-Kummissjoni pproponiet direttiva ġdida bl-għan li jitneħħew l-ostakli għall- kummerċ intra-Komunitarju ta’ prodotti relatati mad-difiża . Sa issa, iċ-ċirkolazzjoni ta’ dawn il-prodotti fi ħdan is-suq intern kienet imxekkla minn taħlita ta’ proċeduri nazzjonali li mhux biss jimponu piż amministrattiv li jaqbeż € 430 miljun kull sena fuq il-kumpaniji u l-awtoritajiet pubbliċi iżda jintroduċu wkoll dewmien twil għat-twettiq, sa diversi xhur. Jidher ċar li dan il-piż huwa sproporzjonat mal-ħtiġijiet proprji ta' kontroll, kif muri mill-fatt li, minkejja li jinħarġu madwar 11 500 liċenzja għat-trasferiment intra-Komunitarju kull sena, tliet applikazzjonijiet biss ġew irrifjutati matul il-perjodu 2004-2006. Din il-proposta se tgħin biex l-industriji ta’ difiża Ewropej isiru ekonomikament u teknoloġikament aktar kompetittivi, ittejjeb il-kundizzjonijiet għall-parteċipazzjoni ta’ l-IŻM fl-iżvilupp u fil-produzzjoni ta’ l-armamenti, tippermetti lill-Istati Membri jissodisfaw il-ħtiġijiet militari tagħhom taħt kundizzjonijiet ta' sikurezza xierqa b'inqas spejjeż u ssaħħaħ is-sigurtà tal-provvista għall-akkwist pubbliku u l-kooperazzjoni industrijali.

2.6. Strumenti ta’ komunikazzjoni u konsultazzjoni mal-partijiet interessati

It-tagħrif ċar u trasparenti dwar il-progress fl-implimentazzjoni tal-programm ta’ simplifikazzjoni huwa kruċjali biex jiġi żgurat il-momentum tal-programm. Għal dan il-għan, il-Kummissjoni waqqfet websajt ta’ simplifikazzjoni[10] biex tipprovdi tagħrif ġenerali dwar l-istrateġija ta’ simplifikazzjoni u tippermetti lill-partijiet interessati jikkontrollaw il-progress tal-programm kontinwu. Barra minn hekk, f'għadd ta' setturi ulterjuri (eż. l-agrikoltura) il-konsultazzjoni mal-partijiet interessati u ma’ l-esperti settorjali ta’ l-Istati Membri hija ffaċilitata permezz ta’ gruppi settorjali.

B’konsistenza mar-riżoluzzjoni tagħha li tintroduċi s-simplifikazzjoni fl-esperjenza prattika tal-partijiet interessati, fil-Ħarifa 2007 il-Kummissjoni nediet websajt ġdida ta’ konsultazzjoni onlajn biex tisma’ t-tħassib u s-suġġerimenti tan-negozji fir-rigward tal-piżijiet imposti mil-leġiżlazzjoni u l-burokrazija żejda b'mod ġenerali. Il-Kummissjoni se tagħmel l-aħjar użu possibbli minn dan il-kontribut tal-partijiet interessati. Minkejja li hija primarjament maħsuba biex tagħti sehem fil-“Programm ta’ Azzjoni għat-tnaqqis tal-piżijiet amministrattivi fl-Unjoni Ewropea”, kull kontribuzzjoni li tindirizza kwistjonijiet usa’ rilevanti għas-sustanza tar-regolamentazzjoni se titqies fit-tfassil ta’ l-istrateġija ta’ simplifikazzjoni.

3. PROGRAMM TA’ KODIFIKAZZJONI

Il-kodifikazzjoni[11] hija parti ewlenija mill-isforz tal-Kummissjoni biex jitnaqqas id-daqs ta’ l- acquis u jsir aktar aċċessibbli.

Il-programm ta’ kodifikazzjoni jinvolvi madwar 400 att ta’ kodifikazzjoni, li l-biċċa l-kbira tagħhom huma proposti leġiżlattivi. Total ta’ 87 att bħal dawn għaddew b’suċċess mill-proċess ta’ kodifikazzjoni u ġew adottati u ppubblikati fil-ĠU (62 att tal-Kummissjoni u 25 att tal-Parlament Ewropew u tal-Kunsill). Dawn is-87 att jieħdu post it-348 att preċedenti. Barra minn hekk, 65 att jinsabu pendenti quddiem il-leġiżlatura u erba’ atti se jiġu adottati dalwaqt mill-Kummissjoni. Għaldaqstant 152 att ta’ kodifikazzjoni ġew diġà finalizzati mill-Kummissjoni.

Biex jitlesta l-programm ta’ kodifikazzjoni sa tmiem l-2008 (Anness 2), ittieħdu miżuri biex jitlestew it-traduzzjonijiet b’lura ta’ testi li qed jiġu kodifikati fil-lingwi ġodda ta’ l-UE. L-adozzjoni ta’ l-atti kodifikati min-naħa tal-leġiżlatura hija soġġetta għar-regoli stabbiliti fil-Ftehim Interistituzzjonali dwar Metodu ta’ Ħidma Aċċelerat għall-Kodifikazzjoni Uffiċjali ta’ l-20 ta’ Diċembru 1994.

4. ASPETTI INTERISTITUZZJONALI

4.1. Proposti pendenti quddiem il-leġiżlatura

Ir-responsabbiltà għal simplifikazzjoni b’suċċess hija maqsuma bejn dawk kollha involuti fil-proċess ta’ teħid ta' deċiżjonijiet. Fl-2007, il-leġiżlatura rnexxielha tlesti x-xogħol b’lura marbut ma' proposti li jmorru lura għall-programm ta' simplifikazzjoni għall-2003-2004.

Madankollu, 44 proposta fil-programm kontinwu ta’ l-2005-2009 għadhom pendenti quddiem il-leġiżlatura (Anness 3). Fil-każ tad-direttivi, ir-regoli tal-KE għandhom imbagħad jiġu trasposti fil-liġi nazzjonali. Għaldaqstant, jistgħu jgħaddu diversi snin qabel ma l-benefiċċji ta’ simplifikazzjoni jkunu jistgħu jitgawdew (u jiġu nnotati) miċ-ċittadini u min-negozji.

Il-Kummissjoni għalhekk ħeġġet lill-istituzzjonijiet l-oħra biex jadottaw il-proposti ta' simplifikazzjoni tagħha fl-iqsar żmien possibbli.

4.2. Is-simplifikazzjoni u l-istituzzjonijiet l-oħra

Taħt l-Istrateġija ta' Liżbona għat-Tkabbir Ekonomiku u l-Impjiegi, il-Kunsill għall-Kompetittività jissorvelja l-implimentazzjoni ta’ l-aġenda għal Regolamentazzjoni Aħjar f’rapport ta’ progress fi tmiem kull Presidenza, li jindika inter alia l-progress tal-programm kontinwu ta’ simplifikazzjoni. Filwaqt li l-Kummissjoni tilqa’ l-interess kontinwu tal-Kunsill f’regolazzjoni aħjar b’mod ġenerali u fis-simplifikazzjoni b’mod partikolari, hi tinnota li l-metodi ta’ ħidma tal-Kunsill għall-eżami tal-proposti ta’ simplifikazzjoni għadhom ma nbidlux fundamentalment, minkejja l-impenji li saru fil-Ftehim Interistituzzjonali dwar Leġiżlazzjoni Aħjar.

Fir-Riżoluzzjoni tiegħu dwar l-Istrateġija għas-Simplifikazzjoni ta' l-Ambjent Regolatorju[12], il-Parlament Ewropew laqa' l-programm tal-Kummissjoni dwar il-kodifikazzjoni u qabel li l-programm ta' simplifikazzjoni għandu jiġi promoss u appoġġjat minn inizjattivi ta' simplifikazzjoni nazzjonali korrispondenti. Il-Parlament qed jistieden ukoll lit-tliet istituzzjonijiet biex jikkonkludu ftehim interistituzzjonali dwar metodi ta’ tħaddim aċċelerati għal miżuri ta’ simplifikazzjoni. Il-Kummissjoni tapprezza l-appoġġ kostruttiv tal-Parlament u l-azzjoni li diġà ttieħdet biex tiġi implimentata l-aġenda għal regolamentazzjoni aħjar. Il-Kummissjoni b’mod speċjali tilqa’ l-emenda li għamel il-Parlament tal-proċeduri interni tagħha għall-eżami ta’ kodifikazzjoni u l-abbozzar ta’ proposti, li tiċċara t-tqassim ta' responsabbiltajiet bejn il-kumitati u tissalvagwardja l-partijiet kodifikati minn emendi mhux xierqa fis-sustanza tagħhom.

Il-Kummissjoni għaldaqstant tħeġġeġ lill-Kunsill u lill-Parlament biex jiżguraw l-adozzjoni rapida tal-proposti ta’ simplifikazzjoni pendenti tagħha u jiżguraw li l-kontenut ta’ simplifikazzjoni jinżamm fil-proċess

4.3. Kooperazzjoni mal-Kumitat Ekonomiku u Soċjali Ewropew u mal-Kumitat tar-Reġjuni

Il-Kummissjoni ppruvat torganizza aħjar il-konsultazzjoni tas-soċjetà ċivili organizzata dwar il-kwalità regolatorja ta’ l- acquis .

Wara talba mill-Kummissjoni, f’Settembru 2007 il-KESE ta l-opinjoni tiegħu dwar l-ambitu għas-simplifikazzjoni tal-qafas regolatorju fis-settur tal-magni. Dan kellu jkopri kemm ir-regoli speċifiċi għas-settur kif ukoll il-leġiżlazzjoni usa’ li għandha x’taqsam mal-magni, per eżempju s-saħħa, s-sikurezza u l-ħarsien ta’ l-ambjent. Il-Kummissjoni beħsiebha ssegwi din il-kooperazzjoni u issa indirizzat talbiet simili lill-Kumitat għal rapporti ulterjuri dwar setturi ewlenin oħra, bħas-settur tal-kostruzzjoni u s-servizzi tan-negozju.

Il-Kummissjoni tilqa’ wkoll ir-rapport dwar regolazzjoni aħjar adottat mill-Kumitat tar-Reġjuni f’Ottubru 2007[13].

5. KONKLUżJONIJIET / RIMARKI TA’ L-GħELUQ

It-tnaqqis tal-burokrazija żejda huwa punt fundamentali fuq l-aġenda politika tal-Komunità. Bħall-komponenti l-oħra ta’ l-Aġenda għal Regolamentazzjoni Aħjar imfassla mill-Kummissjoni fil-bidu tal-mandat tagħha, l-Istrateġija ta’ Simplifikazzjoni laħqet ritmu normali u qed tagħti l-ewwel benefiċċji tanġibbli u impressjonanti. Il-Kummissjoni se tlesti eżami ta’ madwar 95 000 paġna ta’ l-acquis Komunitarju biex jiġu identifikati l-oqsma possibbli li fuqhom l-attivitajiet ta’ simplifikazzjoni fil-ġejjieni jistgħu jiffokaw, u se tintegra r-riżultati fil-programm kontinwu ta’ simplifikazzjoni aġġornat li għandu jiġi ppreżentat fil-bidu ta’ l-2009. Il-Kummissjoni hija determinata li twettaq sa l-aħħar il-programm kontinwu preżenti biex l- acquis ikun kemm jista’ jkun sempliċi, konċiż u aġġornat. Hemm metodu li tqiegħed fil-prattika u l-azzjoni qed tipproduċi r-riżultati.

Madankollu jidher ċar li l-qafas regolatorju ma jistax jitjieb mill-Kummissjoni waħidha. Aktar minn qatt qabel, huwa essenzjali impenn koordinat u determinat fil-livelli regolatorji kollha biex l-intenzjonijiet politiċi mixtieqa jissarrfu f’riżultati tanġibbli u jkun żgurat li jintlaħqu l-aspettattivi ġenwini tal-kumpaniji u taċ-ċittadini. Min-naħa tagħhom, il-Parlament Ewropew u l-Kunsill jaqsmu r-responsabbiltà istituzzjonali għat-tmexxija 'l quddiem tal-proposti tal-Kummissjoni lejn l-istadju finali ta’ l-adozzjoni. Sa issa, minkejja l-isforzi magħrufa, ġew adottati inqas minn kwart tal-proposti kollha ta' simplifikazzjoni ppreżentati mill-Kummissjoni li jeħtieġu adozzjoni mil-leġiżlatura. Naturalment, huwa essenzjali li jinżamm il-kontenut ta’ simplifikazzjoni ta’ dawn il-proposti matul il-proċess ta’ teħid ta’ deċiżjonijiet.

Bl-istess mod, l-awtoritajiet nazzjonali, reġjonali jew lokali responsabbli mit-traspożizzjoni u l-implimentazzjoni tal-liġi ta' l-UE għandhom jistinkaw biex jikkumplimentaw il-ħidma li saret fi Brussell. Ħafna drabi d-dewmien fit-traspożizzjoni jew regolamentazzjoni mhux meħtieġa (gold-plating) tgħawwar l-effett ta’ simplifikazzjoni tar-regoli ta’ l-UE. Il-ħidma li qed titwettaq bħalissa biex jitħejja u jitkejjel il-piż amminsitrattiv f'ċerti oqsma ta' politika hi mistennija li tipprovdi lezzjonijiet interessanti f'dan ir-rigward. B’konformità mal-Komunikazzjoni riċenti tagħha “Ewropa li Tikseb ir-Riżultati – L-Applikazzjoni tal-Liġi Komunitarja”, il-Kummissjoni se tintensifika l-isforzi bikrija tagħha biex ma tippermettix li jsir ksur tal-liġi tal-KE billi ttejjeb il-kwalità ta’ l-għajnuna li toffri lill-Istati Membri biex tiffaċilita t-traspożizzjoni u l-applikazzjoni korretti tad-direttivi.

Fl-aħħarnett, billi l-biċċa l-kbira ta’ l-ispazju regolatorju ta’ l-UE mhuwiex imfassal fil-livell Komunitarju, il-programmi ta’ simplifikazzjoni jistgħu wkoll jiġu żviluppati jew infurzati mill-ġdid fil-livell nazzjonali (u fejn xieraq, reġjonali) biex tiġi trattata l-kwantità żejda ta' burokrazija li żdiedet indipendentement mil-leġiżlazzjoni ta’ l-UE. Fil-ġejjieni, il-Kummissjoni se tagħmel enfasi fuq dan l-aspett meta tħares lejn il-Programmi ta’ Riforma Nazzjonali ppreżentati fil-kuntest ta’ l-Aġenda ta’ Liżbona.

80 | Council Directive 2001/23/EC on the approximation of the laws of the Member States relating to the safeguarding of employees' rights in the event of transfers of undertakings, businesses or parts of undertakings or businesses | Revision | Directive 2001/23/EC does not contain any provisions on conflict of laws. As a result, there is a lack of clarity as to how to apply the provisions of the Directive to cross-border transfers. The aim of the proposal - to be made by the Commission following the two phases of consultation of social partners - is therefore to clarify the application of the Directive to cross-border operations. The proposal would increase legal certainty for economic and judicial agents and result in costs savings for undertakings and better protection for workers. Following the results of the first phase of consultations which took place in November 2007, it appears that the revision of the Directive is not necessary. |

81 | Community initiative on work-related musculoskeletal disorders | Recast | The objective of this initiative is to integrate into a single legislative instrument the provisions on the protection of the health and safety of workers from the risks of musculo-skeletal disorders at work. 82 | Revision of the Pharmaceutical "Variations" Regulations: change to the legal basis, in Directives 2001/83/EC on the Community code relating to medicinal products for human use and 2001/82/EC for veterinary use | Revision | The objective is to simplify the rules concerning post-licensing changes to medicines (so-called ‘Variations’ Regulations). Administrative management of these rules currently mobilise more than 60% of the human resources and financial costs of companies’ regulatory departments. In some cases, this burden may hinder innovation by preventing the introduction of changes that are beneficial to patients and society. The objective of this initiative is to reduce the administrative burden for industry by streamlining the circumstances obliging industry to fill applications for variations of human and veterinary medical products. The current legal basis for implementing rules on changes to the marketing authorisation doesn't allow the Commission to set rules for purely national marketing authorisation. This legal basis should be widened to close the gap for harmonisation. This initiative aims at changing the legal basis for Directives: 2001/83/EC on the Community code relating to medicinal products for human use and Directive 2001/82/EC on the Community code relating to medicinal products for veterinary use. |

Revision of the pharmaceutical "Variations" Regulations: simplification and modernisation of Regulation (EC) No 1084/2003 and (EC) No 1085/2003 | Revision | The objective is to reduce the administrative burden for industry by simplifying the rules for variations of human and veterinary medicinal products. It will include electronic stability control and low rolling resistance tyres. The proposal will repeal some 50 separate Directives and will replace them, where appropriate, with references to UNECE Regulations. The beneficiaries of the simplification aspect of this proposal will primarily be vehicle manufacturers and national approval authorities. Replacing Directives with a Regulation will also ease the administrative burden on the Member States since they would not have to transpose legal acts in the domain of vehicle safety in the future. Furthermore, references to UNECE Regulations will avoid the existing duplication between EU and UNECE law and will thus lead to "better regulation". |

85 | Textiles: simplification and replacement by a single regulation | Revision | The replacement of 3 Directives by 1 Regulation will simplify procedures for Member States, companies and the Commission leading to shorter periods for adoption of new fibre names. For this purpose, the procedure of developing and adopting eco-label criteria will be thoroughly changed and simplified. 93 | Ozone layer: revision of Regulation (EC) No 2037/2000 on substances that deplete the ozone layer | Recast | As the production and consumption of the substances covered have been reduced or phased out, many provisions of the Regulation, after seven years in force, need to be repealed or updated. Other provisions may benefit from simplification such as clarification of definitions and procedures and interaction with other pieces of legislation. This will reduce the cases of ambiguous interpretation and the risk of infringements and consequent administrative burdens. In particular, most of the administrative cost reduction will result from ending exemption provisions on some uses of ozone depleting substances. This partial ban was extended to a total EU wide suspension on the use of processed animal protein in feed for any animals farmed for the production of food on 1 January 2001 with some exceptions like the use of fish meal for non-ruminants. Any presence of prohibited constituents of animal origin in feed is considered as a breach of the feed ban i.e. the zero-tolerance. Following the adoption of the TSE Road map the Commission issued a Commission staff working paper i.e. Work Programme on TSE [SEC(2006) 1527] on future legislative actions in the field of transmissible spongiform encephalopathy. One of the topics concerns a revision of the feed ban provisions. The starting point when revising the current feed ban provisions should be risk-based but at the same time taking into account the control tools in place to evaluate and ensure the proper implementation of this feed ban. | X |

Revision of the Council Directive 94/56/EC establishing the fundamental principles governing the investigation of civil aviation accidents and incidents and of Directive 2003/42/EC on occurrence reporting in civil aviation | Revision or Recast | The older directive needs to be modernised following the establishment of EASA and following the advice of the Group of Experts established by EC Decision 2003/425/EC. Modernise the Marine Equipment Directive 96/98/EC | Recast or Revision | The objective is to modernise and reform the existing system established by Council Directive 96/98/EC on marine equipment. Its main objectives are: 1) to produce a consolidated version of the text following the successive amendments of the Directive 2) to improve the functioning of the Directive's system by addressing the existing shortcomings ; 3) to adapt it to the reform of the New Approach. It is intended to abrogate the existing Directive and replace it with an entirely new one, while recourse to recast is not excluded. At present, the Directive needs periodic amendments in order to keep pace with the safety requirements and technical standards produced by the International Maritime Organisation as well as the international and European standardisation bodies. This produces an inevitable mismatch between the European and international regulatory frameworks, sometimes spanning several years, whose correction will greatly facilitate the work of the sectors concerned and thus favour the competitiveness of the European marine equipment industry. Furthermore, the adaptation of the directive to the new regulatory framework for the free movement of goods (revision of the new approach) is expected to improve the readability of this instrument and reduce the administrative burden on the industry. Timing of adoption is conditional on significant progress being achieved by December 2007 in the legislative process as regards the revision of the New Approach. |
