amending recommendations No 811/78/ECSC and No 1006/78/ECSC concerning definitive anti-dumping duties on certain iron and steel products originating in the German Democratic Republic

THE COMMISSION OF THE EUROPEAN

COMMUNITIES,

Having regard to the Treaty establishing the European Coal and Steel Community,

Having regard to Commission recommendation No 3018/79/ECSC of 21 December 1979 on protection against dumped or subsidized imports from countries not members of the European Coal and Steel Communty (1), as last amended by recommendation No 3025/82/ECSC (2), and in particular Article 14 thereof,

After consultations within the Advisory Committee set up by the said recommendation,

Whereas by recommendation No 811/78/ECSC of 21 April 1978 imposing a definitive anti-dumping duty on certain sheets and plates, of iron or steel, originating in Bulgaria, the German Democratic Republic and Romania (3), as last amended by recommendation No 3140/78/ECSC (4), the Commission imposed a definitive anti-dumping duty on sheets and plates, of iron or steel, other than electrical, not further worked than hot-rolled, of a thickness of 2 mm or more, originating in the German Democratic Republic; whereas the duties on imports of like products from Bulgaria and Romania have meanwhile been suspended;

Whereas by recommendation No 1006/78/ECSC of 18 May 1978 imposing a definitive anti-dumping duty on certain galvanized sheets and plates originating in the German Democratic Republic (5), as last amended by recommendation No 3140/78/ECSC, the Commission imposed a definitive anti-dumping duty on zinc-coated (other than electrolytically) steel sheets and plates (galvanized) originating in the German Democratic Republic;

Whereas the amount of these duties is equal to the amount by which the effective price (basic price plus extras) established by contract, free-at-frontier, duty paid, is lower than the effective price (basic price plus extras) as published by the Commission on 30 December 1978 for the products in question; whereas since that date the effective prices published by the Commission have been amended to reflect changes in the lowest normal values in the supplying countries where normal conditions of competition prevail; whereas it is appropriate, therefore, to base these duties on the most recent effective prices published by the Commission for these products applicable at the time of their import,

HAS ADOPTED THIS RECOMMENDATION:

Article 1

Article 1 (2) of recommendations No 811/78/ECSC and No 1006/78/ECSC is hereby replaced by the following:

'2. The amount of the duty shall be equal to the amount by which the effective price (basic price plus extras) established by contract, free-at-frontier, duty paid, is lower than the most recent effective price (basic price plus extras) published by the Commission which is applicable to the products concerned at the time of their entry for consumption in the Community.'

Article 2

This recommendation shall enter into force on the day following its publication in the Official Journal of the European Communities.
