- The initiative is meant to further increase legal certainty as regards the application of treaty provisions on the prohibition of the abuse of dominant market positions (Article 102 Treaty on the Functioning of the European Union) and identify the sections of the Article 102 Guidance Paper which no longer reflect the Commission’s enforcement practice.
