Decision No 2/2002 of the Association Council, association between the European Communities and their Member States, of the one part, and the Republic of Hungary, of the other part

of 16 April 2002

concerning the improvement of the trade arrangements for processed agricultural products envisaged by Protocol 3 to the Europe Agreement

THE ASSOCIATION COUNCIL,

Having regard to the Europe Agreement establishing an association between the European Communities and their Member States, of the one part, and the Republic of Hungary, of the other part(1), and in particular Article 1(2) of Protocol 3 thereto,

Whereas:

(1) Protocol 3, as replaced by the Protocol adjusting trade aspects of the Europe Agreement(2), lays down the trade arrangements in processed agricultural products between the Community and Hungary.

(2) Under Article 1(2) of the Protocol, the Association Council is to decide in particular on any amendment of the duties mentioned in the Annexes to the Protocol and on the increase or abolition of tariff quotas.

(3) Under the second indent of Article 2 of the Protocol, the Association Council may also decide that the duties applied may be reduced in response to reductions resulting from mutual concessions relating to processed agricultural products.

(4) The annual quotas provided for in Annexes I and II to this Decision should be opened for the year 2002,

HAS DECIDED AS FOLLOWS:

Article 1

Annexes I and II to Protocol 3 on trade between the Community and Hungary in processed agricultural products shall be replaced by Annexes I and II appearing in the Annex to this Decision.

Article 2

This Decision shall enter into force on the first day of the month following that of its adoption.

It shall apply from 1 January 2002.

DECLARATION BY HUNGARY

"According to World Trade Organisation (WTO) commitments, Hungary will grant no export subsidy for sweet corn products falling under CN Code 0710 40 00, 0711 90 30, 2001 90 30, 2004 90 10 and 2005 80 00 as from 1 January 2002."

Table 2(a): Duties applicable upon import into the Community of goods originating in HungaryNote:

The duties set out in this table are subject to an annual reduction by 10 % of the duties applicable on 31.12.2001. The amounts taken into consideration in calculating the reduced agricultural components (EAR) and additional duties (AD S/ZR and AD F/MR), applicable on importation into the Community of goods listed in this table are those set out in Table 2(b) (from 1.7.2000) of Annex 1 to Commission Regulation (EC) No 2204/1999 of 12 October 1999 (pages 775 to 787 of OJ L 278 of 28 October 1999) ((The final rate of preferential duty, calculated according to this note, shall be rounded down to the first decimal place, except for duties expressed as "EAR", "AD S/ZR" and "AD F/MR" in this table, which shall be rounded down to the second decimal place.)).

The duties set out in this table are subject to reduction by 20 % of the duties applicable on 31.12.2001. From 2003 on, the duties set out in this table are subject to a further annual reduction by 10 % of the duties applicable on 31.12.2001.
