FINAL ADOPTION of the general budget of the European Union for the financial year 1995 following the annulment by the Court of Justice in Case 41/95 (96/200/Euratom, ECSC, EC)

THE PRESIDENT OF THE EUROPEAN PARLIAMENT,

Having regard to the Treaty establishing the European Coal and Steel Community, and in particular Article 78 (7) thereof,

Having regard to the Treaty establishing the European Community, and in particular Article 203 (7) thereof, as well as the text of Protocol 16 and Declaration 22 annexed thereto,

Having regard to the Treaty establishing the European Atomic Energy Community, and in particular Article 177 (7) thereof,

Having regard to the Treaty amending certain financial provisions of the Treaties establishing the European Communities and of the Treaty establishing a Single Council and a Single Commission of the European Communities, which was signed on 22 July 1975,

Having regard to the Financial Regulation of 21 December 1977 applicable to the general budget of the European Communities (), as last amended by Regulation (EC, Euratom, ECSC) No 2335/95 of 18 September 1995 (), and in particular Article 14 thereof,

Having regard to the Interinstitutional Agreement of 29 October 1993 on budgetary discipline and improvement of the budgetary procedure (),

Having regard to the adjustment of the financial perspective in the light of the implementing conditions pursuant to paragraph 10 of the Interinstitutional Agreement of 29 October 1993 (),

Having regard to the general budget of the European Union for the financial year 1995 (),

Having regard to supplementary and amending budget No 1 for the financial year 1995 (),

Having regard to the judgment of the Court of Justice of 7 December 1995 annulling the act of the President of the European Parliament of 15 December 1994 declaring the final adoption of the general budget of the European Union for the financial year 1995,

Having regard to the letter of amendment for the financial year 1995 presented by the Commission on 11 January 1996,

Having regard to the deliberations of the European Parliament of 16 and 18 January 1996,

Having regard to the resolution adopted by the European Parliament on 18 January 1996,

Having regard to the letter of amendment for the financial year 1995 established by the Council on 29 January 1996,

DECLARES:

Sole Article

The procedure laid down in Article 78 of the Treaty establishing the European Coal and Steel Community, Article 203 of the Treaty establishing the European Community and Article 177 of the Treaty establishing the European Atomic Energy Community having been completed and that the general budget of the European Union for the financial year 1995 has been finally adopted.

ANNEX

The following adjustments are hereby made to the general budget of the European Union for the financial year 1995 (), and to supplementary and amending budget No 1 for the financial year 1995 ().

1. Amounts

Amendment of certain amounts as shown in Appendix 1 to this Annex.

2. Remarks on the budget

- Deletion of the remark 'The basic regulations leave the Commission some discretion in the management of this measure. Its implementation should conform to Article 5 (2) of the Financial Regulation of 21 December 1977 applicable to the general budget of the European Communities (OJ No L 356, 31. 12. 1977, p. 1), as last amended by Regulation (ECSC, EC, Euratom) No 2730/94 (OJ No L 293, 12. 11. 1994, p. 7)` in the articles and items concerned listed in Appendix 2.

- Deletion of the remark 'ECU 1 000 000 is also earmarked to cover expenditure in connection with a fisheries agreement which the Community will negotiate with Russia on the financing of fishing for herring` in Article B7-8 0 0 (International Fisheries Agreements).
