on certain information to be supplied by steel undertakings

THE COMMISSION OF THE EUROPEAN

COMMUNITIES,

Having regard to the Treaty establishing the European Coal and Steel Community, and in particular Article 47 thereof,

Whereas, under Article 46 of the ECSC Treaty, the Commission is required to conduct a continuous study of market trends and to draw up periodically programmes indicating foreseeable developments in production, consumption, exports and imports; whereas such forward programmes relating to all these matters are drawn up by the Commission and published quarterly;

Whereas the measures taken by the United States steel industry in respect of certain exports to the United States by Community steel undertakings could disturb trade between the European Coal and Steel Community and the United States of America, and also have repercussions on the Community market; whereas, in order to avoid such problems on the Community market and the better to ensure observance of one of the Community's objectives as set out in Article 3 (f) of the Treaty, it is necessary that the Commission be able to draw up more precise forecasts of exports to the American market;

Whereas, to achieve this objective, the Commission must be kept continuously notified of the composition of order books and of deliveries already made to the American market;

Whereas Decision No 14/64 of 8 July 1964 (1) requires undertakings to keep records of orders and a sales journal;

Whereas to enable the Commission to assess more closely the pattern of exports, it is necessary that it should receive from undertakings information in respect of December 1981 and January, February, March and April 1982,

HAS ADOPTED THIS DECISION:

Article 1

1. Undertakings shall provide the Commission monthly by telex with the information specified in the Annex concerning their orders and deliveries in the United States of America. These statements must reach the Commission not later than 10 working days after the end of the month.

2. The products subject to this requirement are those listed in Statistical Office questionnaires Nos 2-72 and 2-81. However, the requirement to supply statements of information concerns only ordinary steel. The statements shall be made in accordance with the form given in the Annex.

Article 2

1. The first statement shall be provided by the 10th working day of the month which follows the publication of this Decision in the Official Journal of the European Communities.

2. The first statement shall be accompanied by the information specified in columns 1, 2 and 3 of the form in the Annex concerning December 1981, and January, February, March and April 1982.

Article 3

This Decision shall enter into force on the day of its publication in the Official Journal of the European Communities.

This Decision shall be binding in its entirety and directly applicable in all Member States.
