REGULAMENTO (CEE) No 3114/83 DA COMISSÃO de 4 de Novembro de 1983 que introduz a terceira alteração do Regulamento (CEE) no 586/77 que fixa as modalidades de aplicação dos direitos niveladores no sector da carne de bovino, e que modifica o Regulamento (CEE) no 950/68 relativo à pauta aduaneira comum

A COMISSÃO DAS COMUNIDADES EUROPEIAS,

Tendo em conta o Tratado que institui a Comunidade Económica Europeia,

Tendo em conta o Regulamento (CEE) no 805/68 do Conselho, de 27 de Junho de 1968, que estabelece a organização comum de mercado no sector da carne de bovino (1), com a última redacção que lhe foi dada pelo Acto de Adesão da Grécia e, nomeadamente, o no 5 do seu artigo 10o,

Considerando que o Regulamento (CEE) no 586/77 da Comissão (2), com a última redacção que lhe foi dada pelo Regulamento (CEE) no 882/79 (3), que estabelece no artigo 9o a definição das formas de apresentação dos produtos sujeitos ao direito nivelador; que a experiência demonstrou que as definições dos quartos traseiros nas versões francesa, neerlandesa e dinamarquesa estão incompletas; que há pois que adaptar as definições em questão nas versões linguísticas citadas e, através de uma alteração do artigo 14o do referido regulamento, adoptar em conformidade as notas complementares correspondentes que figuram no anexo «pauta aduaneira comum» do Regulamento (CEE) no 950/68 do Conselho (4) com a última redacção que lhe foi dada pelo Regulamento (CEE) no 604/83 (5);

Considerando que as medidas previstas no presente regulamento estão conformes ao Comité de Gestão da Carne de Bovino,

ADOPTOU O PRESENTE REGULAMENTO:

Artigo 1o

O Regulamento (CEE) no 586/77 é alterado do seguinte modo:

1) As alíneas f) e g) do no 1 do artigo 9o passam a ter a seguinte redacção:

a) Na versão inglesa:

«f) "Unseparated hindquarters", for the purpose of subheadings 02.01 A II a) 3 and 02.01 A II b) 3: the rear part of the carcase comprising all the bones and the thigh and sirloin, including the fillet, with minimum of three pairs of whole or cut ribs with or without the shanks and with or without the thin flank;

g) "Separated hindquarters", for the purpose of subheadings 02.01 A II a) 3 and 02.01 A II b) 3: the rear part of the half-carcase comprising all the bones and the thigh and sirloin including the fillet, with a minimum of three whole or cut ribs with or without the shank and with or without the thin flank»;

b) Na versão neerlandesa:

«f) "achterspan" bedoeld bij de onderverdelingen 02.01 A II a) 3 en 02.01 A II b) 3: het achterste deel van het hele geslachte dier dat alle beenderen, alsmede de stompen, de dikke en de dunne llendenen en de haas omvat, met ten minste drie paar ribben of delen van ribben, met of zonder schenkel en met of zonder vang;

g) "achtervoet" bedoeld bij de onderverdelingen 02.01 A II a) 3 en 02.01 A II b) 3: het achterste deel van het halve geslachte dier dat alle beenderen, alsmede de stomp, de dikke en de dunne lendenen en de haas omvat, met ten minste drie ribben of delen van ribben, met zonder schenkel en met of zonder vang»;»

c) Na versão dinamarquesa:

«f) Som "bagfjerdinger, sammenhaengende" (pos. 02.01 A II a) 3 og 02.01 A II b) 3) bagkroppen med samtlige knogler, begge koeller, moerbrad, tyksteg, tyndsteg og hoejreb med mindst 3 hele eller delvis afskaarne ribbenspar, ogsaa uden skank og slag;

g) som "bagfjerdinger, adskilte" (pos. 02.01 A II a) 3 og 02.01 A II b) 3) den bageste del af den halve krop med samtlige knogler, koelle, moerbrad, tyksteg, tyndsteg og hoejreb med mindst 3 hele eller delvis afskaarne ribben, ogsaa uden skank og slag.»

2) As alíneas f) e g) do ponto A do artigo 14o passam a ter a seguinte redacção:

a) Na versão inglesa:

f) Som "bagfjerdinger, sammenhaengende" (pos. A II a) 3 og A II b) 3) betragtes bagkroppen med samtlige knogler, begge koeller, moerbrad, tyksteg, tyndsteg og hoejreb med mindst 3 hele eller delvis afskaarne ribbenspar, ogsaa uden skank og slag;

g) som "bagfjerdinger, adskilte" (pos. A II a) 3 og A II b) 3) betragtes den bageste del af den halve krop med samtlige knogler, koelle, moerbrad, tyksteg, tyndsteg og hoejreb med mindst 3 hele eller delvis afskaarne ribben, ogsaa uden skank og slag;

Artigo 2o

O presente regulamento entra em vigor no terceiro dia a seguir ao da sua publicação no Jornal Oficial das Comunidades Europeias.

O presente regulamento é obrigatório em todos os seus elementos e directamente aplicável em todos os Estados-membros.
