State aid (Articles 87 to 89 of the Treaty establishing the European Community) Commission notice pursuant to Article 88(2) of the EC Treaty addressed to the other Member States and other interested parties State aid C 30/2000 (ex N 766/1999) - Bova (Peru) - Netherlands (2003/C 246/07) (Text with EEA relevance) By means of the letter of 27 February 2002 reproduced below, the Commission notified the Netherlands of its decision to close the procedure laid down in Article 88(2) of the EC Treaty. "1. By letter dated 3 December 1999, the Dutch authorities, acting pursuant to Article 88(3) of the EC Treaty notified the Commission of the planned state aid. The Commission asked the Netherlands for further information by letter dated 26 January 2000, and the Dutch authorities replied by letter dated 14 March 2000. 2. By letter dated 22 June 2000, the Commission informed the Netherlands of its decision to initiate the procedure laid down in Article 88(2) of the EC Treaty in respect of the state aid. 3. The Commission's decision to initiate the procedure was published in the Official Journal of the European Communities(1). The Commission requested interested parties to make known their comments on the aid. 4. By letter dated 21 November 2000, the Commission received comments from Germany. By letter of 10 January 2001, it forwarded the comments to the Dutch authorities. It has received no response from the Netherlands. 5. The aid recipient would be Autobusfabriek Bova BV (hereinafter 'Bova'). Bova is situated in Valkenswaard, Netherlands. 6. The project to be aided would deliver 15 buses to a number of Peruvian transport companies. The buses, which would be produced and sold by Bova, should produce 50 % fewer CO2 emissions and discharge fewer greenhouse gases than buses currently being used in Peru and should also consume less fuel. According to the Dutch authorities, the project should contribute to environmental protection in Peru by introducing new emission-reducing technology. 7. The notified aid would be in the form of a non-repayable grant totalling NLG 3022500. The total project cost is NLG 9750000 and the aid intensity is 31 %. 8. By letter dated 29 November 2001 (registered as received on 4 December 2001), the Dutch authorities informed the Commission that they were withdrawing the notification. 9. Pursuant to Article 8(2) of Council Regulation (EC) No 659/1999 of 22 March 1999 laying down detailed rules for the application of Article 88 of the EC Treaty(2), the Commission has decided to close the procedure initiated pursuant to Article 88 of the EC Treaty in respect of the notified aid now that the Dutch authorities have withdrawn the notification."
