DE EUROPESE COMMISSIE,
Gezien het Verdrag betreffende de werking van de Europese Unie,
Gezien Verordening (EU) 2016/429 van het Europees Parlement en de Raad van 9 maart 2016 betreffende overdraagbare dierziekten en tot wijziging en intrekking van bepaalde handelingen op het gebied van diergezondheid (“diergezondheidswetgeving”) (1), en met name artikel 259, lid 1,
Overwegende hetgeen volgt:

Mond-en-klauwzeer is een infectieuze virale ziekte bij zoogdieren van de orden Artiodactyla en Proboscidea die ernstige gevolgen kan hebben voor de betrokken dierpopulatie en de rentabiliteit van de landbouw, en die de verplaatsingen van zendingen van die dieren en producten daarvan binnen de Unie en de uitvoer naar derde landen kan verstoren. Bij een uitbraak van mond-en-klauwzeer bij dieren bestaat een ernstig risico op verspreiding van die ziekte naar andere inrichtingen waar dieren van in de lijst opgenomen soorten worden gehouden, zoals vastgesteld in de bijlage bij Uitvoeringsverordening (EU) 2018/1882 van de Commissie (2) (“in de lijst opgenomen soorten”). |

Gedelegeerde Verordening (EU) 2020/687 van de Commissie (3) vormt een aanvulling op de regels voor de bestrijding van de in de lijst opgenomen ziekten als bedoeld in artikel 9, lid 1, punten a), b) en c), van Verordening (EU) 2016/429 en gedefinieerd als ziekten van categorie A, B en C in Uitvoeringsverordening (EU) 2018/1882. Met name voorzien de artikelen 21 en 22 van Gedelegeerde Verordening (EU) 2020/687 in de instelling van een beperkingszone in geval van een uitbraak van een ziekte van categorie A, waaronder mond-en-klauwzeer, en in de instelling van bepaalde maatregelen die in die beperkingszone moeten worden toegepast. Bovendien bepaalt artikel 21, lid 1, van die gedelegeerde verordening dat de beperkingszone een beschermingszone, een bewakingszone en, indien nodig, extra beperkingszones rond of naast de beschermings- en bewakingszones omvat. |

Uitvoeringsbesluit (EU) 2026/582 van de Commissie (4) is vastgesteld op grond van Verordening (EU) 2016/429 en bevat bepaalde noodmaatregelen in verband met uitbraken van mond-en-klauwzeer in inrichtingen waar runderen worden gehouden in het district Larnaca in Cyprus. Meer in het bijzonder is in Uitvoeringsbesluit (EU) 2026/582 bepaald dat Cyprus overeenkomstig artikel 21 van Gedelegeerde Verordening (EU) 2020/687 beperkingszones moet instellen die beschermings- en bewakingszones omvatten, alsmede een extra beperkingszone, waar de maatregelen die in de beschermings- en bewakingszones en de extra beperkingszone moeten worden toegepast, ten minste tot en met de in de bijlage bij dat uitvoeringsbesluit opgenomen data worden toegepast, en dat de beschermings- en bewakingszones en de extra beperkingszone ten minste de in die bijlage opgenomen gebieden moeten omvatten. |

Gezien de huidige epidemiologische situatie in Cyprus en het risico dat infectie met het mond-en-klauwzeervirus zich kan verspreiden via subklinisch besmette dieren van in de lijst opgenomen soorten, moet ook de verplaatsing van dergelijke dieren van elke locatie binnen de extra beperkingszone naar een bestemming buiten de externe perimeters van de extra beperkingszone worden verboden. Uitvoeringsbesluit (EU) 2026/582 moet derhalve worden gewijzigd om in een dergelijk verbod te voorzien. |

In Verordening (EU) 2016/429, en met name artikel 69, is bepaald dat de bevoegde autoriteit van een lidstaat, indien dat nodig is voor een doeltreffende bestrijding van een in de lijst opgenomen ziekte als bedoeld in artikel 9, lid 1, punt a), waarvoor ziektebestrijdingsmaatregelen van toepassing zijn, een vaccinatieprogramma kan opstellen en vaccinatiezones kan instellen. Daartoe moet de bevoegde autoriteit het vaccinatieprogramma uitvoeren en vaccinatiezones instellen die voldoen aan de specifieke voorschriften van artikel 6 van Gedelegeerde Verordening (EU) 2023/361 van de Commissie (5), die Verordening (EU) 2016/429 aanvult. |

Gedelegeerde Verordening (EU) 2023/361 bevat onder meer de specifieke regels die de lidstaten moeten toepassen bij het gebruik van beschermende noodvaccinatie bij dieren om een in de lijst opgenomen ziekte te voorkomen of te bestrijden. In die gedelegeerde verordening zijn ook de voorwaarden vastgesteld waaronder de verplaatsing van gevaccineerde dieren en producten daarvan kan worden toegestaan. In bijlage VII bij die gedelegeerde verordening zijn specifieke voorwaarden voor beschermende noodvaccinatie tegen infectie met mond-en-klauwzeer vastgesteld. |

Op 2 maart 2026 heeft Cyprus bij de Commissie zijn officiële vaccinatieprogramma voor beschermende noodvaccinatie tegen infectie met mond-en-klauwzeer ingediend. Het plan bevat informatie over de geografische en administratieve reikwijdte van de vaccinatiezone en het aantal te vaccineren dieren. Uitvoeringsbesluit (EU) 2026/582 moet derhalve worden gewijzigd om rekening te houden met het door Cyprus ingediende vaccinatieprogramma en het territoriale toepassingsgebied van de vaccinatiezone. |

Sinds de vaststelling van Uitvoeringsbesluit (EU) 2026/582 zijn de noodmaatregelen die in de in de bijlage bij dat besluit opgenomen beschermings- en bewakingszones en extra beperkingszone moeten worden toegepast en het tijdschema voor de toepassing ervan herzien, met name wat betreft de voorlopige reiniging en ontsmetting van de getroffen inrichtingen, die overeenkomstig Gedelegeerde Verordening (EU) 2020/687 moeten worden uitgevoerd. Bijgevolg moet de tijdsduur van de noodmaatregelen in die beschermings- en bewakingszones worden aangepast. |

Bovendien hebben zich sinds de vaststelling van Uitvoeringsbesluit (EU) 2026/582 verdere uitbraken van mond-en-klauwzeer voorgedaan in inrichtingen in de districten Larnaca en Nicosia in Cyprus, ook buiten de gebieden die thans in de bijlage bij Uitvoeringsbesluit (EU) 2026/582 als beschermings- en bewakingszones zijn opgenomen. |

Gezien de huidige epidemiologische situatie ten aanzien van mond-en-klauwzeer in Cyprus en om de verdere verspreiding van die ziekte in die lidstaat, of naar andere lidstaten of naar derde landen te voorkomen, moeten de gebieden die in de bijlage bij Uitvoeringsbesluit (EU) 2026/582 thans als beschermings-, bewakings- of extra beperkingszone zijn opgenomen, dringend worden herzien om ze waar nodig zowel qua locatie als qua geldigheidsduur aan te passen, en moeten ook nieuwe beschermings- en bewakingszones worden ingesteld, rekening houdend met de recentste uitbraken in Cyprus. Dit is ook noodzakelijk om te voorkomen dat de handel in de Unie onnodig wordt verstoord en dat derde landen ongerechtvaardigde handelsbelemmeringen opwerpen. |

Uitvoeringsbesluit (EU) 2026/582 moet daarom dienovereenkomstig worden gewijzigd. |

De in dit besluit vervatte maatregelen zijn in overeenstemming met het advies van het Permanent Comité voor planten, dieren, levensmiddelen en diervoeders, |
HEEFT HET VOLGENDE BESLUIT VASTGESTELD:
Artikel 1
Uitvoeringsbesluit (EU) 2026/582 wordt als volgt gewijzigd:

de volgende artikelen 1 bis en 1 ter worden ingevoegd: “Artikel 1 bis Verplaatsingen van dieren van in de lijst in de bijlage bij Uitvoeringsverordening (EU) 2018/1882 opgenomen soorten van de in de bijlage bij dit besluit opgenomen extra beperkingszone naar een bestemming buiten de externe perimeters van die extra beperkingszone zijn tot en met de in de bijlage opgenomen data verboden. Artikel 1 ter De bevoegde autoriteit stelt overeenkomstig deel 1 van bijlage VII bij Gedelegeerde Verordening (EU) 2023/361 en onder de in die bijlage VII vastgestelde voorwaarden onmiddellijk een vaccinatiezone in, zoals beschreven in de bijlage bij dit besluit.” |

de bijlage wordt vervangen door de tekst in de bijlage bij dit besluit. |

Dit besluit is gericht tot de Republiek Cyprus.
