In Case T-173/03: Anne Geddes, residing at Auckland (New Zealand), represented by G. Farrington, Solicitor, against Office for Harmonisation in the Internal Market (Trade Marks and Designs) (OHIM) (Agents: E. Dijkema and A. Folliard-Monguiral) – action brought against the decision of the Fourth Board of Appeal of OHIM of 13 February 2003 (Case R 839/2001-4) regarding an application for registration of the Community word mark ‘NURSERYROOM’ – the Court of First Instance (Second Chamber), composed of: J Pirrung, President, N.J. Forwood and S. Papasavvas, Judges; J. Plingers, Administrator, for the Registrar, has given a judgment on 30 November 2004, in which it:

Dismisses the application;

2.

Orders the applicant to pay the costs.
