Potatoes for human consumption are a product in Annex I of the Treaty not subject to a common market organisation. In the absence of a common market organisation, Article 4 of Regulation (EEC) No 26 of 4 April 1962 applying certain rules of competition to production of and trade in agricultural products is still applicable to state aid relating specifically to the product in question. Article 4 lays down that only the first sentence of Article 88(1) of the Treaty shall apply to such aid. Therefore, the Member States are required to inform the Commission, in sufficient time to enable it to submit its comments, of any plans to grant or alter aid. As to the Commission, it cannot object to the granting of this type of aid; it requests Spain not to grant the aid
